Delhi Court Acquits Former Secretary HC Gupta In Coal Scam Case

A Delhi court on Friday acquitted former coal secretary HC Gupta, ex-joint secretary (coal) KS Kropha and then director KC Samaria in a coal scam case related to irregularities in the allocation of Mahugarhi Coal Block in Jharkhand.
Today marks Gupta's second acquittal in coal block related cases whereas he has been convicted in five other cases and his appeals are currently pending in Delhi High Court.
The CBI has also challenged his acquittal in the first case.
There were total 19 cases filed by the CBI against Gupta, of which 12 are pending before trial courts.
Special Judge Sanjay Bansal while pronouncing the verdict on Friday convicted JAS Infrastructure Capital Ltd and its then director Manoj Kumar Jayaswal for cheating and criminal conspiracy in securing coal block's allocation.
The judge would hear arguments on sentencing on July 8.
A total of 29 corruption cases filed by the CBI are currently pending before two special courts set up to try cases arising out of coal scam whereas 27 cases have been disposed of so far.
On January 16, the Enforcement Directorate informed the top court that 45 complaints (ED's equivalent to a chargesheet), including supplementary ones, were pending under the PMLA.
The top court in 2014 quashed 214 coal blocks allocated by the Centre between 1993 and 2010 after taking note of two PILs and had ordered a trial by a special CBI Judge.
It later increased the number of the courts to two to try the scam-related cases.
The CBI was represented by special public prosecutor R S Cheema, additional legal advisor Sanjay Kumar and public prosecutors A P Singh and N P Srivastava in the case.
The CBI lodged the case on the reference of Central Vigilance Commission against officials of Ministry of Coal for alleged corruption in the matter of allocation of coal blocks to the private companies during period 2006-09.
It was alleged in the FIR that JAS Infrastructure Capital Pvt Ltd and its Director Jayaswal had misrepresented/concealed facts in the application form in order to qualify and obtain wrongful gains/undue benefits in allocation of Mahuagarhi coal block.
The CBI spokesperson in a statement on Friday said, "This is the 19th conviction in coal block allocation cases investigated by CBI. Initially, the CBI had filed final report (closure) in the case on November 20, 2014." The special court had previously taken cognisance and framed charges against JAS Infrastructure Capital Pvt Ltd, Manoj Kumar Jayaswal, H C Gupta, K S Kropha and K C Samaria.
"The allegations in the case were that the accused private persons, namely the promoters of JAS Infrastructure Capital Pvt. Ltd, had made false and misleading claims regarding the financial net worth of the company," the CBI said.
They further misrepresented the appraisal and syndication of debt by financial institutions, with a view to securing the wrongful allocation of a coal block, the CBI spokesperson said.
The company, it was alleged, "deliberately concealed" material facts concerning the previous allocation of coal blocks to other group or associate companies in the application and feedback forms.
"The company had also dishonestly projected the net worth of unrelated third-party companies- Inertia Iron & Steel Industries Pvt. Ltd. and IL&FS- as its own, both in its application and during the presentation made before the Screening Committee for the allocation of Mahugarhi Coal Block," the statement said.
The CBI examined 18 prosecution witnesses in support of its case.

Chief minister Rekha Gupta directed officials on Saturday that all government buildings and sports complexes in the city be made differently-abled friendly. The order comes as part of the ongoing 'Sugamya Delhi Abhiyan' aimed at promoting accessibility and inclusion for persons with disabilities (PwDs). CM Gupta was chairing a meeting at the Delhi Secretariat with cabinet minister Ashish Sood, Dr Mallika Nadda, president of Special Olympics Bharat, and officials from the office of the chief commissioner for PwDs, discussing to expand accessibility in the areas of sports, education, and public services for PwDs. 'Sugamya Delhi Abhiyan is not just a social initiative; it's a mission to build an inclusive future where every individual has equal access to opportunities,' she said, adding hat no individual should be excluded from mainstream society due to disability, and announced that all public buildings and stadiums will undergo accessibility upgrades — including installation of ramps, lifts, Braille signage, wheelchair pathways, and audio-visual aids — to ensure unhindered access for PwDs. Under the campaign, the government will raise awareness and sensitisation about accessibility standards and promote inclusive spaces across Delhi while also implementing accessibility upgrades in public and institutional spaces across the city, officials said. Launched on December 3, 2015, by Prime Minister Narendra Modi, the Accessible India Campaign aims to create an inclusive India by ensuring universal accessibility in infrastructure, transportation, and digital communication for PwDs. The Sugamya Delhi Abhiyan is a city-level extension of the programme. The campaign was initiated to transform Delhi into India's first 'Purple City'. It is structured around the 'Sarkar, Samaj, Bazaar' framework. Infrastructure will be aligned with national accessibility standards in collaboration with government agencies; inclusion will be promoted at the grassroots level by engaging all 21 categories of disabilities, senior citizens, and the local community; and cost-effective, sustainable solutions will be developed in collaboration with vendors, innovators, and CSR partners.

Kota: After ICICI Bank's internal investigation pinpointed Sakshi Gupta, a former relationship manager at the bank's DCM branch in Kota, as the key figure behind a multi-crore fraud involving customer accounts, Kota police have launched an investigation to determine if others were involved and requested relevant documents from the bank. Tired of too many ads? go ad free now Tarun Dadhich, manager of the city's ICICI DCM branch, on Feb 18, 2025, submitted a report at the Udhyog Nagar police station alleging that Gupta, the former relationship manager at the bank, siphoned off Rs 4.58 crore from 110 accounts belonging to 41 customers over a period between 2020 to 2023. Following the police inquiry, Sakshi Gupta was arrested on May 31 and was remanded to judicial custody following a one-day police remand for interrogation. Udhyog Nagar police station Circle Inspector Jitendra Singh said Saturday that while the internal inquiry identified Sakshi Gupta as solely responsible for the fraud, the police have sought additional documents from the bank to probe the possible role of other persons involved with her in orchestrating the multi-crore fraud. However, Singh said, prima facie, no involvement of other persons has surfaced yet. According to the police, Sakshi Gupta withdrew funds from more than 110 accounts belonging to 41 customers over a span of two and a half years, investing the siphoned amounts in the stock market. However, she suffered significant losses. To hide the transactions from customers, she replaced the registered mobile numbers on several accounts with those belonging to her relatives, ensuring that transaction alerts and OTPs were diverted from the actual account holders. In one instance, she used an elderly woman's account—without her knowledge—as a 'pool account', moving over Rs 3 crore through it by Feb 15, 2023. Tired of too many ads? go ad free now The investigation also revealed that Gupta misused debit cards, PINs, and OTPs for unauthorised transactions, and even activated overdraft facilities on 40 accounts without customer consent. Further inquiry found she prematurely closed fixed deposits belonging to 31 customers, redirecting Rs 1.34 crore into unauthorised accounts. A fraudulent personal loan of Rs 3.4 lakh was also disbursed. Multiple transactions were executed using Insta Kiosk installations and digital banking platforms, with Sakshi exploiting four customers' debit cards for ATM and internet banking usage. The proceeds were transferred to demat accounts as part of an attempted cover-up. Meanwhile, an ICICI Bank spokesperson said Friday, "The interest of our customers is of paramount importance to us. Immediately upon discovering the fraudulent activity, we filed an First Information Report with the police. We have a zero-tolerance policy against any fraudulent activity and thus suspended the employee involved. We would like to reassure that genuine claims of impacted customers have been settled. "
