
Identity of man who quoted Shakespeare to prove British citizenship remains unknown
'David Henry Law' was rescued from Rozel Bay in late September 2024, carrying nothing but €265 in cash, a contact lens case, and a pair of glasses.
Whilst he claimed he was a 35-year-old British Citizen - and quoted Shakespeare passages in an effort to prove it - he had no formal identification with him and authorities were unable to verify his identity.
In March, he was sentenced to 15 months in prison for knowingly entering Jersey without leave and seeking to obtain or secure the avoidance or postponement of enforcement action against him.
Mr Law is up for release in September and during his trial, the Court recommended that he ultimately be deported.
However, the island's Customs and Immigration Service say they have still been unable to confirm Mr Law's identity and nationality.
This means there is no obvious legal pathway for deportation, as authorities do not know where to deport him to.
According to Pierre Makhlouf - an immigration lawyer and Director of campaign group Bail for Immigration Detainees - Mr Law is therefore caught in a "highly unusual" legal knot.
If the island were to detain Mr Law beyond the length of his sentence, they would risk breaching European human rights legislation.
However, without verifying his nationality, Mr Law will be effectively stateless upon release from La Moye Prison - and therefore unable to work or apply for housing.
Because he claims he is a British Citizen, he is also not eligible to claim asylum.
Mr Makhlouf says this presents a difficult challenge for Jersey's authorities once the prison sentence ends, adding: "On a legal level, they're holding him in detention, so the first step is they would need to make a decision as to whether or not they would continue to detain him unlawfully.
"If they can't, they're going to have to release him.
"In the UK, there are specific facilities and arrangements that can be put into place to assist someone who would otherwise be homeless.
"That includes asylum seekers but also other people facing removal who cannot be removed - what you have to bear in mind is if someone is placed on the streets, that is a potential breach of their human rights.
"In the end, you have to support them, it's a basic level of the treatment of people that we would all expect."
Speaking about the predicament, Jersey Customs and Immigration Service says it "will consider whether further action is appropriate when he is released, but will not provide comment on what will happen at the end of an individual's sentence."
They add: "Enquiries remain ongoing to establish Mr Law's nationality and identity."

During a call with the US president and European allies on Wednesday, Sir Keir praised Mr Trump for his work to bring forward a "viable" chance of an end to the war. But concerns have been raised over Mr Zelensky's exclusion from the meeting between the Mr Trump and Mr Putin, which is set to take place in Alaska on Friday. Speaking on Wednesday, Sir Keir said: "This meeting on Friday that President Trump is attending is hugely important. Article continues below "As I've said personally to President Trump for the three-and-a-bit years this conflict has been going on, we haven't got anywhere near a prospect of actually a viable solution, a viable way of bringing it to a ceasefire. "And now we do have that chance, because of the work of that the president has put in." Further sanctions could be imposed on Russia should the Kremlin fail to engage, and the UK is already working on its next package of measures targeting Moscow, he said. "We're ready to support this, including from the plans we've already drawn up to deploy a reassurance force once hostilities have ceased," he told allies. "It is important to remind colleagues that we do stand ready also to increase pressure on Russia, particularly the economy, with sanctions and wider measures as may be necessary." Sir Keir and European leaders have repeatedly said discussions about Ukraine should not happen without it, amid concerns the country is being sidelined in negotiations about its own future. Asked if it was his decision to not invite Mr Zelensky to the meeting, Mr Trump said "no just the opposite", before adding that a second meeting with the Ukrainian president could take place afterwards. "We had a very good call, he was on the call, President Zelensky was on the call. I would rate it a 10, you know, very, very friendly," he told reporters in Washington. He added: "There's a very good chance that we're going to have a second meeting which will be more productive than the first, because the first is I'm going to find out where we are and what we're doing." The US president has previously suggested a truce could involve some "swapping" of land. It is believed one of the Russian leader's demands is for Ukraine to cede parts of the Donbas region which it still controls. But Mr Zelensky has already rejected any proposal that would compromise Ukraine's territorial integrity, something that is forbidden by the country's constitution. It added: "Sanctions and wider economic measures to put pressure on Russia's war economy should be strengthened if Russia does not agree to a ceasefire in Alaska." The meeting, which was announced last week, will be the first time in four years that a U.S. president has met Putin since the war began. Zelenskyy arrived in Berlin on Aug. 13 for a virtual conference hosted by German Chancellor Friedrich Merz that will include leaders of NATO members Finland, France, Great Britain, Italy, Poland and the European Union. Vice President JD Vance is also expected to call into the meeting. Zelenskyy said there should be a meeting of the three leaders as the location of the meeting was announced on Aug. 13. Earlier in the day, he said he was not seeing any positive indications from Russia. "At present, there is no sign that the Russians are preparing to end the war, "Zelenskyy wrote on X. "Our coordinated efforts and joint actions - of Ukraine, the United States, Europe, and all countries that seek peace - can definitely compel Russia to make peace."
