Down to the wire: A $338B Texas budget, new rules for faculty senates at universities

Day 138 of the 140-day session of the Legislature resembled a volleyball game where the ball was the scores of bills trying to make through the process and the net was the Capitol rotunda that separates the House from the Senate.
Here are some of the highlights from Saturday's action.
Both Houses signed off on the $338 billion spending plan to fund state government for the two-year cycle that begins Sept. 1. The total — the product of negotiations and compromises hammered out by a House-Senate conference committee — was slightly more than either chamber proposed when each passed its own version of the budget.
The spending plan, which is subject to certification by Comptroller Glenn Hegar, includes $65 billion for the state's sundry education programs and $44 billion for health and human services programs.
Assuming that certification is granted, Gov. Greg Abbott can either sign it into law or veto it. A third option for Abbott is the line-item veto that allows the governor to redline individual appropriations if he chooses.
The budget represents an increase of 1.2% from the present two-year budget.
The document would also, to some degree, tap the breaks on Abbott's border security plan known as Operation Lone Star, which so far has cost Texas taxpayers more than $11 billion since 2021. The 2026-27 budget would allocate $3.4 billion for border security. That's down from about $6.5 billion proposed in the chambers' earlier versions.
Now that President Donald Trump has returned to the White House, federal allocations for border security are expected to be stepped up.
Both chambers have approved and sent to the governor, sweeping legislation that seeks to limit faculty authority over university governance. The bill also expands the governor-appointed board of regents' control over core curriculum, degrees and hiring, and create an investigative office to handle complaints of noncompliance against universities.
The bill also includes provisions to initiate a review of all core courses to ensure alignment with workforce readiness and prohibits any required class from advocating or promoting the idea that one race, sex, religion or ethnicity is "inherently superior to any other."
Public school students would no longer be allowed to use cellphones in school under legislation that is now on its way to the governor.
House Bill 1481 would allow local school boards to decide how the law would be applied. Exemptions would be available for students who require phones for medical and personal safety purposes.
If Abbott signs the measure, students could not use their cellphones during the school day.
Here's how the Texas Legislative Reference Library explains the process by which the governor signs or vetoes bills that pass both chambers and arrives at his desk:
"Bills that pass the House and Senate are sent to the Governor to sign or veto. The Governor has 10 days (not counting Sundays) to return the bill to the Legislature with objection. If after 10 days the bill is not returned to the Legislature by the Governor with objections, the bill becomes law as if the Governor had signed it.
"If the Legislature has adjourned sine die, or if the bill is presented to the governor less than 10 days (not counting Sundays) prior to final adjournment, the Governor has 20 days (counting Sundays) after the final day of the session to sign or veto the bill. If neither action is taken, the bill becomes law without the Governor's signature."
The last day in the process this go-round is June 22.

A moderate House Democrat's town hall devolved into chaos minutes after it began on Tuesday night, with pro-Palestinian activists clashing with both the congressman and fellow attendees in what became a near-constant torrent of interruptions and protests. Rep. Wesley Bell, D-Mo., who defeated far-left "Squad" member Cori Bush in the Democratic primary last year, repeatedly pleaded with protesters to allow him to speak while defending his position on Israel and Hamas. "Stop talking. This is not your town hall. You can leave," Bell told protesters roughly 20 minutes after he began speaking. He said soon after, "While we're sitting here being divided and fighting one another, we've got other folks out there who are taking our democracy from us." At another point, his assertions that Hamas' initial attack on Israel "was not just a terror attack, October 7 was an invasion" was met with boos and jeers from the crowd. Even calls to "surge aid" to Gaza were drowned out by demonstrators, prompting Bell to respond, "You disagree with that?" Despite repeated pleas for calm from both Bell and his moderator, protesters continued to call him a "war criminal" and accuse him of supporting genocide. The event grew more heated as the hour went on, reaching a fever pitch toward the end when Bell disputed a questioner labeling Israel's invasion of Gaza a "genocide." "You don't get to set the genocide definition," an activist yelled. Bell responded, "No, I don't…and here's the thing, people can disagree, that's what makes our country great." "When it comes to the word genocide, I kind of disagree with Israel was attacked by an openly genocidal terrorist group," he said while protesters attempted to drown him out. "Hamas said openly that they want to destroy so you're accusing somebody of genocide, you're standing with an organization that says they want to commit genocide. You don't see that?" He continued over boos, "We need to see a surge in humanitarian aid into Gaza, we need to see an end to the war. We need to see every single hostage returned, and we need to see a viable future for Gaza without Hamas." And while pro-Palestinian protesters took up a majority of the attention, there did appear to be a significant number of attendees who were supportive of Bell, particularly when he attempted to bring the conversation back to local issues. "The number one killer of kids in St. Louis between [ages] 1 and 17 is gun violence, and there's people who want to talk about that too," he said, earning applause. At one point, a woman attempted to confront the demonstrators directly. "Shut up with your White privilege," the woman could be heard yelling. "You've never been hungry, you've never had a child be hungry, and yet you want to stand here and diminish the work he's doing?" It's not clear how or if the activists responded. The town hall's moderator tried to deescalate the situation early on, calling security to escort an unruly demonstrator out minutes after it began. "Let's do this the Democratic way, the democracy way. You can't hear anyone yelling. I hear you. As a mixed-race person, I hear you," she told activists. "We can't get through this if you are yelling and barking and acting like you want to get physical." At the end of the night, however, Bell released a statement thanking all attendees for coming. "I want to thank everyone that came out to our town hall this evening – yes the conversations were passionate at times, but Democracy is messy and we have to passionately defend it," Bell wrote on X. "At the end of the day we're going to continue to fight for the ST. LOUIS region and for our country." Fox News Digital reached out to Bell's office for further comment.

Adam Schiff, a longtime political adversary of President Donald Trump, is bracing for continued legal battles and "baseless smears" from the administration by setting up a legal defense fund. Trump has called Schiff 'shifty' and a 'scam artist' who should be arrested for treason after leading the first impeachment during the president's first term. The Justice Department is investigating potential mortgage fraud, which Schiff has denied. Schiff created a tax-exempt fund Aug. 15 called the 'Senator Schiff Legal Defense Fund.' It's not clear how much the fund raised initially. 'It's clear that Donald Trump and his MAGA allies will continue weaponizing the justice process to attack Senator Schiff for holding this corrupt administration accountable," said Marisol Samayoa, a Schiff spokesperson. "This fund will ensure he can fight back against these baseless smears while continuing to do his job." Schiff's political and legal battles with Trump go back years. As a House member, the former federal prosecutor led the first impeachment against Trump over his dealings with Ukraine during his first term. Schiff also served on the committee that investigated the Capitol attack Jan. 6, 2021. After winning a Senate seat in 2024, Schiff remains critical of Trump. For example, he asked the Federal Communications Commission on Aug. 15 whether Trump sought commitments for media coverage in exchange for approving the merger of Paramount Global, the parent company of CBS, with Skydance Media. The approval came after Paramount agreed to pay $16 million to settle a $20 billion lawsuit from Trump that alleged CBS News deceptively edited a '60 Minutes' interview with former Vice President Kamala Harris during the 2024 campaign against Trump. Trump has pushed for investigations of Schiff since returning to the White House this year. In July, Trump said on social media that federal authorities 'concluded that Adam Schiff has engaged in a sustained pattern of possible Mortgage Fraud.' The accusation is that Schiff claimed a primary residence in Maryland to get a cheaper mortgage interest rate in addition to his California residence required to serve in Congress. Trump alleged the fraud began when Schiff refinanced his Maryland home in 2009 until his designated the home his second residence in 2020. 'I have always suspected Shifty Adam Schiff was a scam artist,' Trump said on social media. Schiff has denied wrongdoing and called the mortgage investigation 'a bit of a letdown' after the more serious allegations Trump leveled at him. Schiff consulted with House counsel and mortgage lenders in declaring the Maryland home occupied in 2003 a "primary residence," rather than a vacation or investment property, in addition to his California residence, according to a source familiar with the declaration. 'And this baseless attempt at political retribution won't stop me from holding him accountable,' Schiff said on social media in July. 'Not by a long shot.' The mortgage investigation came after Schiff opposed Ed Martin, Trump's choice for federal prosecutor in Washington, DC. Martin withdrew and was named to a Justice Department position that didn't require Senate confirmation. 'The allegations against Sen. Schiff are transparently false, stale, and long debunked," said Schiff's lawyer, Preet Bharara. "Now Ed Martin, the most brazenly partisan and politically compromised person possible for the task, has been picked to investigate a political adversary." Trump signaled another inquiry into Schiff over the investigation of Trump's dealings with Russia during his term. A special counsel, Robert Mueller, found that Russians tried to influence the 2016 election in favor but did not find a connection to the Trump's campaign. FBI Director Kash Patel recently declassified and released FBI interview notes from a former House Intelligence Committee staffer who first accused Schiff in 2017 of directing illegal leaks of classified information about Trump and Russia. Schiff's office said Patel's 'latest smear' was 'absolutely and categorically false' in an attempt to distract from Trump's falling poll numbers. Prosecutors reviewed the staffer's accusations at the time and declined to pursue charges. The Justice Department's inspector general reviewed the accusations in a 2024 report that determined the witness 'had little support for their contentions' and 'may not have been credible.' But Trump told reporters Aug. 13 at the Kennedy Center that he hoped something would be done against Schiff about the Russia investigation that he called 'phony' and 'a hoax.' 'These people put our country at great danger, and Adam Schiff was all made up,' Trump said after looking at Attorney General Pam Bondi. 'Hopefully something is going to happen with it.'
