Court of Appeal upholds Sarawak homebuyers' right to claim from booking fee date
In a unanimous decision on Thursday (August 24), a three-member bench, comprising Datuk Azimah Binti Omar, Datuk Wong Kian Kheong and Datuk Ismail Brahim allowed an appeal by the Sarawak Housing Tribunal against developer Lien Dak Development Sdn Bhd, awarding costs of RM10,000.
The judgment followed the Federal Court's precedent in the PJD Regency case and the RJ Realty cases in Sarawak.
The dispute began when buyers Wong Sii Hieng and Ng Siew Eng complained to the Tribunal in 2021 over the late delivery of a Rock Road property purchased in 2016.
The Tribunal ruled in their favour, but the High Court later quashed the award.
The Court of Appeal has now reinstated the Tribunal's decision, reinforcing homebuyers' rights.
Separately, the Court allowed Sentoria Borneo Land Sdn Bhd to discharge its legal team in an ongoing appeal involving purchasers of Borneo Samariang Resort City serviced apartments.
The Tribunal, represented by the Sarawak State Attorney-General's Chambers, is defending its awards under the Housing Development (Control and Licensing) Ordinance 2013.
The case will return for case management on September 12, 2025.

Decades-long wait ends as Melaka hands over 47 approval letter for railway reserve land
ALOR GAJAH: After more than 30 years, the issue involving railway reserve land in Pengkalan here has been resolved, with the Melaka government handing over 47 approval letters for state land application, said Chief Minister Datuk Seri Ab Rauf Yusoh. He said the handover ceremony reflected the state government's concern in understanding the community's needs and ensuring that every policy and development project delivers a positive impact on the people's lives. "A total of 45 applications involved the Pengkalan railway reserve land that had been delayed for three decades, and two plots for temples. "Also approved was Tenaga Nasional Bhd's (TNB) application to place a substation on Plot 1, Mukim Kelemak, Alor Gajah district, which will provide electricity to residential, commercial, hospital, and government office areas, benefiting more than 3,050 users," he said today. He said this at the handover of the approval letters in conjunction with the Wakil Rakyat Untuk Rakyat (WRUR) programme for the Rembia state constituency, which was also attended by the coordinator for the constituency, Datuk Fairul Nizam Roslan. He said this year, 96 state land applications have been approved in the district, followed by the issuance of Notice 5A by the land administrator. Notice 5A is an official document informing applicants of the fees due, including document preparation and registration costs, that they must pay to obtain the land titles. "It is on this land that new homes will be built, gardens will be filled with flowers, children will run and play, and families will gather every weekend. "Its value is not merely measured in square feet, but in the space to build a life and pass down a legacy of peace to future generations," he said. He said the state government imposes land premiums below market rates, ranging between RM9,000 and RM25,000, depending on the land size, compared to hundreds of thousands of ringgit. Putra Heights Inferno: RM864,000 rental aid disbursed in second phase
SHAH ALAM: The Selangor government has disbursed RM864,000 in the second phase of temporary rental assistance to 144 households affected by last year's gas pipeline fire in Putra Heights, Subang Jaya. State Housing and Culture Committee chairman Datuk Borhan Aman Shah said the payments, covering July to September 2025, were credited on Aug 6 through the Selangor Housing and Property Board (LPHS). He said recipient selection followed a data review conducted by the Petaling District Disaster Management Committee, Victim Data Subcommittee and local community representatives. "The list was updated based on factors such as homes already repaired, former tenants who have relocated or those no longer needing assistance,' he said in a statement. Borhan said the aid aims to ease the burden on affected families as they navigate relocation or home repairs, and urged remaining eligible victims to claim their assistance at the Petaling District and Land Office for further verification. In the first phase of the programme, covering April to June, a total of RM2.19mil was disbursed to 365 households. — Bernama
