
HC: Land pooling policy may hit fertile land & social milieu, notified in haste

Chandigarh: While staying Punjab's Land Pooling Policy 2025, the Punjab and Haryana high court has held that the land sought to be acquired is among the most fertile in the state, and it is possible that "it may impact the social milieu.
" In its order released on Saturday, the HC stated that the Land Acquisition Act, 2013, bars the acquisition of multi-cropped land, and such acquisition is permissible only in exceptional circumstances.
The court was also of the view that no timelines have been prescribed, nor has any mechanism been provided to address the grievances of the affected persons.
"We are prima facie also of the view that the policy appears to have been notified in haste and all concerns, including social impact assessment, environmental impact assessment, timelines, and redressal grievance mechanism, should have been addressed at the very outset in the policy, before its notification," the HC observed while staying the policy until Sep 10.
A division bench comprising Justice Anupinder Singh Grewal and Justice Deepak Manchanda passed these orders while hearing a petition filed by Gurdeep Singh, 72, a resident of Ludhiana district. He sought directions to quash the notification dated June 4, 2025, along with the Land Pooling Policy 2025, being ultra vires and an act of colourable legislation, violating fundamental rights.
Speaking for the bench, Justice Grewal observed that the state proposes to take over tens of thousands of acres of fertile land in the entire Punjab for carrying out its proposed development work, without conducting any Social Impact Assessment or Environmental Impact Assessment study.

Although a stand is taken that the assessment would be carried out later when they have definite information about the number of landowners who have opted for the scheme, it has been held by the Supreme Court in several cases that before permitting urban development, the state ought to carry out an environmental impact assessment.
The judge also observed that payment of subsistence allowance has been provided to the landowners, but there is no provision for the rehabilitation of those landless labourers, artisans, and others who are dependent on the land.
"It has also been submitted before this Court that the state's statutory bodies shall themselves develop the land, but no budgetary provisions appear to have been made, nor has anything been put forth before this Court to indicate that the state has adequate resources to finance the development project under the policy," the HC observed.
In its nine-page order, the bench also mentioned that the court has come across several instances wherein the owners surrendered their land to the state development authority under the earlier land pooling policy, but the developed plots have not been allotted even after 10 years.

Gurgaon: Fresh uncertainty looms over the long-delayed relocation of the Kherki Daula toll plaza. A mahapanchayat has resolved that work on the proposed toll plaza at Pachgaon would not be allowed to proceed until construction of a promised underpass begins. The meeting came just days after locals halted work at the Pachgaon site on Thursday, accusing authorities of going back on earlier commitments. They will study the proposal from all angles and submit their assessment to the govt for action. Multiple departments are involved," he said. Local MLA from Pataudi Bimla Chaudhary met the leaders at the mahapanchayat and assured them the underpass would be built. Villagers say the highway authority initially planned a flyover at the location, which was later scrapped. They were then assured that an underpass would be constructed, but no work has started so far. According to protesters, the district administration has told them a committee has been formed to examine the matter and will submit its report within a week. "We have been given assurances before, but nothing has materialised. We will wait for the report, but if work on the underpass does not start, our protest will be intensified. This time, we will not back down," said Mahavir Singh, a resident of Pachgaon. DC Kumar added, "We have asked the villagers not to stop the works and their demand is being examined. Transport dept proposes e-bus charging depot in Mysuru division
Mysuru: The transport department submitted a proposal to the Union govt, for the establishment of an e-bus charging depot at KSRTC Mysuru division to support its electric bus fleet. This dedicated charging infrastructure depot is proposed to be built on 4.5 acres of land at Banni Mantap, where KSRTC is constructing a new suburban bus stand using the land available at the sprawling bus depot. The facility is exclusively to support electric buses operating from Mysuru. It will have features like a charging station, e-bus parking lot, restrooms, and several other facilities. About 100 e-buses can park at a time once this facility is set up in Mysuru. Mysuru KSRTC division has bus depots in different areas of the city such as Vijayanagar, Sathagalli, Kuvempu Nagar, and Banni Mantap for its diesel-operated buses, but the proposed depot is dedicated to e-buses. Mysuru KSRTC division also received e-buses under the scheme. Speaking to TOI, KSRTC Mysuru divisional manager HT Veeresh said that the department already sent this proposal for the establishment of e-bus depot in Mysuru, after identifying 4.5 acres of land available at Banni Mantap. The PM e-drive scheme initiated by the Union govt at a cost of Rs 10,500 cr plans to roll out 14,028 e-buses across nine Indian cities, including Bengaluru, between 2024-26. The scheme also aims to build a network of 72,000 charging points in cities, including Mysuru, along highways to accelerate EV adoption. As the Union govt was also rolling out essential infrastructure such as charging hubs, depots, and related civil facilities to support the incoming fleet, an e-bus depot is also coming up in Mysuru, he said. This e-bus depot is a must for the charging hubs with huge electric plugs exclusively charging electric buses, which are fitted with 145-kilowatt electric motor capacity. This proposal also includes the establishment of charging stations in the city bus stand and KSRTC suburban bus stand, he said.
