
‘Wrong kind of sorry': Qantas hit with $90m penalty for illegally sacking 1800 ground staff
Justice Michael Lee ordered Qantas to pay $50m to the Transport Workers Union — which brought the case — saying it 'would facilitate and promote' unions to take on similar cases where the Fair Work Ombudsman fails to act.
In a statement, Qantas said the company accepted the penalty and judgement which held it 'accountable for our actions that caused real harm to our employees'.
It concludes a saga that began in 2020, when Qantas outsourced baggage handlers, cleaners and other ground staff, axing more than 1800 staff, as COVID-19 took a toll on aviation.
Qantas' appeal to the High Court was unsuccessful, paving the way for the penalty to be awarded.
'Although the outsourcing decision was a single act, it was a carefully planned act directed at, and affecting, a very large number of employees,' Justice Lee said.
He accepted that Qantas was sorry for the illegal outsourcing, but wasn't convinced the measure of regret was 'significant' and described it as 'the wrong kind of sorry'.
The fact former Qantas boss Alan Joyce's name was kept out of direct involvement in the outsourcing decision also left Justice Lee 'with a sense of disquiet and uncertainty as to precisely what went on within the upper echelons of Qantas leading up to the outsourcing decision'.
The union sought the maximum penalty of $121m, while Qantas urged Justice Lee to impose a 'mid-range' fine of between $40m and $80m.
At $90m, the penalty represents 75 per cent of the maximum and is the biggest employer penalty in Australian corporate history.
The remaining $40m is yet to be allocated, but could go back to the 1820 workers who lost their jobs.
Qantas late last year reluctantly agreed to pay $120m in compensation to the sacked workers, taking the overall bill for its wrongdoings to $210m.
'It will send a message to Qantas and other well-resourced employers that not only will they face potentially significant penalties for breaches of the (Fair Work act), but those penalties will be provided to trade unions to resource those unions in their role as enforcers of the (FWA),' Justice Lee said on Monday.
He also criticised Qantas chief Vanessa Hudson for failing to appear before the court.
Justice Lee noted Qantas chief people officer Catherine Walsh during the hearings apologised for the company's behaviour, but 'it seemed to me obvious that the person who could give the most direct and compelling evidence of corporate change and contrition' was Ms Hudson.
'Going back to the issue as to whether Qantas is truly contrite, I have hesitation in reaching a conclusion,' he said.
Ms Hudson on Monday apologised for the 'genuine hardship' it caused its former team and their families.
'Over the past 18 months we've worked hard to change the way we operate as part of our efforts to rebuild trust with our people and our customers. This remains our highest priority as we work to earn back the trust we lost,' she said.
The national carrier is working to regain the public's trust after a raft of scandals left the airline's reputation in tatters.
These included a botched COVID-19 credits program and and a post-pandemic restart of domestic and international services marred by poor customer service, lost luggage, flight delays and cancellations.
Maurice Blackburn principal Josh Bornstein, who represented the TWU in the case, said the record penalty meant corporate Australia was on notice that courts would not tolerate blatant attacks on workers' rights.

Radio stars Amanda Keller and Brendan 'Jonesy' Jones couldn't believe their ears after uncovering a report revealing just how dependent Gen Z workers are on their parents. On Thursday, the WSFM breakfast hosts discussed a study by US-based ResumeTemplates that laid bare some eye-opening statistics about the younger workforce. Both parents themselves, the pair were gobsmacked to learn that nearly half of Gen Z workers admit their mothers "regularly talk to their boss." "Nearly half of Gen Zers have mum regularly talk to their boss. They're in their mid 20s," Keller said. Keller, who has two Gen Z sons, Liam and Jack, was even more stunned to discover: "77 per cent – this I find extraordinary – have taken a parent to a job interview." Jonesy winced at the figures. "As a boss, you go, 'Come on'," Keller added. The survey also found 53 per cent of parents had spoken directly with a hiring manager on their child's behalf, and 45 per cent regularly chat with their child's current manager. "These are people in their mid 20s!" Keller exclaimed. The statistics didn't stop there. Keller noted that 83 per cent of Gen Zers "have their parents pack their lunch for them", 50 per cent had parents step in over workplace conflicts, and nearly half relied on a parent to ask for time off. "This is an interesting one – 49 per cent say a parent helped them ask for time off," Keller said. "Because the parent would say, 'Look, we're going on holiday, I'll talk to your boss about it'. "This is where, as a parent, you're desperate to step in, because this benefits you. You get your family holiday." Keller went on to point out that 46 per cent of parents were even stepping in to ask for a raise or promotion. "These aren't kids who are 16. These are kids who are older than that. I find that quite extraordinary," she said. Listeners were quick to react to the shocking revelations. One hiring manager chimed in on social media: "Yes we see this all the time! They have very little confidence… simple rule here if mummsy has to help you… we don't need you!" Another wrote on Instagram: "This is extraordinary… I would think turning up to an interview with a parent in tow is a sure-fire way not to get a job. Screams lack of confidence and probably ability from the get-go. Although I'd love to hear from a parent who has accompanied a mid-20 adult to an interview to find out WHY!!" Some listeners suggested the COVID-19 pandemic might have played a role in stunting workplace confidence. "Those are indeed pretty extraordinary statistics however I'm going to add that thanks to COVID, many of these young people were robbed of 2–4 years of their real-life work experience trajectory, so looking at it that way some of them are still teenagers!" one said. "But if you don't vibe with that view, I'll add that this generation was helicopter parented, and are generally avoidant of answering a ringing phone. Some are having their resumes scanned and shortlisted, and having interviews by AI bots!! "If that were your face-to-face experience level, wouldn't you be terrified of an actual person?! All this to say, in comparison their parents possess worldly superpowers."

‘Americanisation of our culture': Tipping frequency, values on the rise in Australia
New research has shown Australians are tipping more and at higher amounts when they dine out, with one state leading the charge in the 'divisive' practice. Fresh data from Australian payment company Zeller has revealed Victorians are tipping higher amounts than any other state, with the value and frequency of tipping across the country increasing for the last three years. The frequency of tips recorded by the payment platform has increased 13 per cent year on year, while tipping values have risen 25 per cent. Zeller director of growth Josh McNicol said tipping is 'definitely a divisive issue because Australians can sometimes see it as the Americanisation of our culture'. 'Unlike in America where tipping really forms part of the server's wage, in Australia it's more about recognition of a great service or a great experience,' he said. 'It really comes down to the business owner, the restaurateur, to know how their customers would react to something like this and then decide (if) this (is) a feature in their payment terminal they want to switch on or off.' Though each state has seen a spike in tipping, it's less common in regional areas, where the behaviour has declined by 10 per cent. The controversial practice seems here to stay, with Aussies increasingly being prompted for tips when ordering food or drinks through a QR code, or paying on a rideshare app. While some venues have been criticised for adding gratuity to a bill automatically, Australian Restaurant & Cafe Association CEO Wes Lambert said it is completely legal and increasingly commonplace within the hospitality industry. 'The ACCC requires restaurants and cafes to inform diners and consumers about any mandatory fees, such as weekend and public holiday surcharges, on top of standard menu prices before they order,' Mr Lambert told 'Every business has a different revenue and cost structure, certainly when you go to hire a solicitor and the fee is $600-an-hour plus expenses, those expenses are variable but they let you know it exists. It's just like this and becoming more commonplace. 'So in practice, that is how it is supposed to work, but often times consumers might not read the fine print, and can certainly be surprised when it is added to the bill.' For those who do choose to pay on top of their bill, the nation's biggest tippers were Victorians at an average of $39.50 – more than double the average value of NSW residents' tips at $16.90. West Australians were the least generous state, tipping an average of $12.48. Mr McNicol attributed the disparity to 'Victoria, particularly Melbourne, has for a long time been recognised as the centre of Australia's dining and hospitality sector'. Restaurants that offer table service received the highest average tips of any individual sector. 'There's a cultural element there where Australians are happy to support the battlers and those people that are working to provide them a great service,' Mr McNicol said. 'Technology has really enabled the service industry to catch up and to allow tipping to become a little bit more a part of the natural flow. 'Whether Australians like it or hate it, it's something that we are steadily seeing more in our day-to-day lives.'

The four-day work week would benefit you, me and the rest of the country
Now, there is absolutely no question that the four-day week will benefit all Australians. It will benefit those of us who work. It will benefit people who look after kids. It will be an extra day for less childcare (groaning under demand). It will be another moment to do all those things which make our lives run: batch cooking, GP appointments, bill paying, breathing, walking, cuddling, cleaning. I reckon it will even cut down on Australian levels of anxiety. Nothing would make us more productive than having lower levels of stress. Same for working from home. Do we need to be under our bosses' noses? Surveillance capitalism at its worst.
