
Fishmonger jailed 6 months for possessing turtle eggs after Kuching High Court allows prosecution's appeal
KUCHING (April 25): The High Court here today sentenced a fishmonger to six months in prison for illegally possessing 490 turtle eggs three years ago, after allowing the prosecution's appeal.
Judge Leonard David Shim delivered the revised sentence against Amir Tahrimie Ya'kob, 37, after the prosecution successfully appealed for a review of the original punishment from the lower court.
Shim also upheld the RM24,500 fine imposed earlier on Amir by the Sessions Court.
On June 27, 2024, Amir pleaded guilty in the Sessions Court to a charge under Section 37(1) of the Wild Life Protection Ordinance 1998, punishable under Section 37(2)(a) read with Section 29(1)(c) of the same law.
He was charged with possessing 490 turtle eggs of the Cheloniidae species without authorisation from the wildlife controller at a premises on Jalan Sultan Tengah around 6pm on July 15, 2022.
The Sessions Court sentenced him to a fine of RM24,500 in default six months' imprisonment and Amir paid the fine.
The appeal of the case was conducted by deputy public prosecutor Arvin Khan, while Amir was represented by lawyer Theresa Dunstan Udam.
According to the facts of the case, a team of wildlife officers from the Sarawak Forestry Corporation (SFC) conducted an inspection at a shop believed to be storing turtle eggs, which is a protected species.
The inspection uncovered five transparent plastic bags containing 490 turtle eggs.
Further investigation revealed that Amir failed to produce any written authorisation from the wildlife controller permitting him to possess the eggs. Arvin Khan Kuching High Court lead Leonard David Shim

Barkery Ladi Jangga, 36, pleaded guilty before Magistrate Oon Kork Chern to a charge under Section 19(1)(b)(vi) of the Commercial Vehicle Licensing Board (CVLB) Act 1987, punishable under Section 19(3) of the same Act, which provides a fine of between RM1,000 and RM10,000 or up to one year in prison, or both. He committed the offence at around 8.27am on May 26 this year during a weighbridge inspection by Road Transport Department (JPJ) personnel along the Stapang-Sibu route. The inspection found the lorry driven by the accused was carrying 16,540kg of cargo, exceeding the maximum permissible Gross Vehicle Weight of 11,000kg as stated in the CVLB licence by 50.36 per cent. Man in Kuching fined RM4,000 for having psychotropic pills

KUCHING (Aug 20): The Sessions Court here today fined a man RM4,000 in default six months' jail after he pleaded guilty to possessing 1.37g of Etizolam tablets. Mohd Firdaus Samat made the plea before Judge Saiful Bahari Adzmi after the charge under Section 9(1) of the Poisons Act 1952, punishable under Section 32(2) of the same Act, was read to him. He committed the offence at a house in Kampung Bintawa Tengah here on June 8, 2025. The facts of the case stated that he was detained by a team from the Sarawak Narcotics Criminal Investigation Department on suspicion of drug-related activity. A search of a bedroom in the house uncovered a black leather bag on the bed, which contained a foil pack with orange pills believed to be Erimin 5, along with RM1,770 in cash suspected to be proceeds from drug sales. A chemical analysis later confirmed the pills to be Etizolam, which is a substance listed under the First and Third Schedules (Psychotropic Substances) of the Poisons Act 1952.
