Pakistan reintroduces Anti-Terrorism Act with preventive detention powers for military, civil forces

The National Assembly of Pakistan passed the Anti-Terrorism (Amendment) Bill, 2024, restoring the provision of preventive detention for individuals suspected of terrorism, The Express Tribune reported on Tuesday.The amendment, which was passed on Wednesday, empowers both military and civil armed forces to detain individuals suspected of terrorism for up to three months.According to The Express Tribune, the bill, presented by PakistMinister of State for Interior and Narcotics Control Talal Chaudhry, was approved after a clause-by-clause reading, with the House rejecting proposed changes by Jamiat Ulema-e-Islam (F)'s Aliya Kamran and accepting an amendment from Pakistan Peoples Party's Syed Naveed Qamar.As per the amendment, Section 11EEEE of the Anti-Terrorism Act (ATA), initially enacted in 2014 in the aftermath of the Peshawar Army Public School attack, had expired in 2016 due to a sunset clause, The Express Tribune reported.The latest amendment reintroduces this provision, allowing authorities to detain individuals based on credible intelligence or reasonable suspicion to preempt terrorist activities.The law also allows for the establishment of Joint Interrogation Teams (JITs), composed of members from law enforcement and intelligence agencies, to carry out in-depth investigations and gather operational intelligence.According to the bill's statement of objectives, Pakistan's current security landscape demands stronger legal tools to empower the government, military, and law enforcement agencies in dealing with individuals posing a serious threat to national security, as reported by The Express Tribune.The bill was taken up for voting, with 125 members supporting the motion and 59 opposing it.As per the bill, as stated by The Express Tribune, sub-section (1) of Section 11EEEE allows detention beyond three months, subject to constitutional safeguards under Article 10, which protects against unlawful arrest and detention.A key revision to sub-section (1) of Clause 2 states: "The Government or, where the provisions of section 4 have been invoked, the armed forces or civil armed forces, as the case may be subject to the specific or general order of the Government in this regard, for a period not exceeding three months and after recording reasons thereof, issue order for the preventive detention of any person who has been concerned in any offence under this act relating to the security or defence of Pakistan or any part thereof, or public order relating to target killing, kidnapping for ransom, and extortion, bhatta, or the maintenance of supplies or services, or against whom a reasonable complaint has been made or credible information has been received, or a reasonable suspicion exists of his having been so concerned, for purpose of inquiry," as quoted by The Express Tribune.Further amendments in sub-section (2) specify that any detention ordered by the armed or civil armed forces must be investigated by a Joint Investigation Team. This team would include a police officer not below the rank of SP, and members from intelligence, military, and other enforcement agencies.Additionally, a new provision (2A) declares that these powers under sub-sections (1) and (2) will remain in effect for three years from the enactment of the Anti-Terrorism (Amendment) Act, 2025.Pakistani Law Minister Azam Nazeer Tarar clarified that this law is meant to be used selectively and includes checks."A clause is being added to the bill stating that there are solid reasons for arrest. The arrested person will have to be presented before a magistrate within 24 hours, and a clause has also been included to be enforceable for a specific period," he stated, as quoted by The Express Tribune.Reacting to the passage of the amendment, Pakistan Tehreek-e-Insaf Chairman Barrister Gohar Ali Khan criticised the move, calling it a repeat of earlier legislation that infringes on "fundamental human rights".

Govt. embarks upon swapping high interest loans with low interest ones
Faced with the mounting interest burden of high-cost loans obtained in the past, the Telangana Government has reportedly decided to swap the high-interest loans with low-interest borrowings so as to ensure that it can save significant amounts in the coming days. The effort can be seen from the fact that the Government has opted for low-interest open market borrowings through the auction of securities conducted by the Reserve Bank of India (RBI) in the past few weeks. The State Government raised a huge ₹5,000 crore through the auction of securities on August 5, with interest rates pegged around 7.1%. It has raised ₹3,500 crore on July 29 with interest rates of 7.15% to 7.16%, and the same is the case with ₹2,500 crore raised on July 15 with interest rates pegged at 7.1%. Though the tenure of the borrowings is longer, they are likely to come in as a cushion to the Government owing to their low interest rates. The development follows the huge loans obtained by the BRS Government at high interest rates, which have become a burden on the State Government that is forced to pay interest of around ₹25,000 crore since the last two fiscal years. Chief Minister A. Revanth Reddy said, during his Independence Day address on Friday, that the Government completed debt servicing of ₹2.2 lakh crore, which included principal of ₹1.32 lakh crore and interest component of ₹88,178 crore since the Congress assumed power less than two years ago, indicating the seriousness of the issue. Senior officials said the low-interest loans will help set off the high cost of government debts, but not the off-budget borrowings. OBBs are primarily financed by the financial institutions which cannot be swapped, senior officials said. Keeping this in view, the government addressed a communication to Union Finance Minister Nirmala Sitharaman seeking her approval for the restructuring of high-interest loans. The communication cited the loan of ₹31,795 crore raised by the Kaleshwaram Lift Irrigation Scheme SPV from the Power Finance Corporation and Rural Electrification Corporation with interest rates ranging from 10.75% to 11.25%. 'Additionally, I would like to bring to your notice that several projects initiated with high interest loans remain incomplete due to various reasons resulting in sub-optimal yields compared to their original projection,' the CM said, seeking the Union Finance Minister's intervention in directing the financial institutions like PFC and REC to restructure loans that were extended to the SPVs/corporations.

Chair troubles Kadapa MLA again
The Independence Day celebrations held at Kadapa on Friday (August 15) left a bitter aftertaste for Kadapa MLA and Government whip Reddeppagari Madhavi Reddy, with the district administration reportedly failing to provide her with a chair among the delegates in the gallery. Along with her husband R. Srinivasa Reddy, who is a member of the TDP Political bureau and the party's district president, the MLA arrived at the venue only to find the designated seats occupied by officials and their family members. After standing for a few minutes at the venue, the couple left without making much fuss. Ms. Madhavi Reddy termed the incident 'a clear violation of the protocol' and said she would complain about the issue to the Speaker and the Privileges Committee. Saying that she had no hard feelings towards anyone, the Government Whip, however, insisted that her seat deserved respect. A video of the incident was widely circulated on social media platforms, triggering a debate. It may be recalled that the MLA had hit the headlines in the past, when she was allegedly denied a chair in the Kadapa Municipal Council meeting, where she stood next to the YSRCP Mayor's chair throughout the entire proceedings.
