
Man Gets 20-Year Jail Term For Raping Step-Daughter
A Delhi court has sentenced a man to 20 years of rigorous imprisonment for raping his teen stepdaughter, observing there was no straitjacket formula for sentencing.
The court said the "twin objectives" of deterrence of crimes and reformation of a convict needed to be balanced.
Additional sessions judge Ankit Mehta was hearing the arguments on the quantum of sentencing against the 32-year-old man, convicted for rape under IPC and Section 6 (aggravated penetrative assault) of the POCSO Act.
On August 2, the court said, "Accused inserted his finger in the private parts of the victim, amounting to rape or penetrative sexual assault. It was further proved that the convict had watched the victim while she was taking a bath and had also lain down upon her." The sentencing, the court said, had to be commensurate with the relevant factors, including nature and gravity of the offence, how the crime was committed, the condition of the victim, the convict's age and whether the convict was a habitual offender.
"There is no straitjacket formula for the same, and as such, both the aggravating and mitigating factors need to be considered. Further, sentencing needs to balance the twin objectives of deterrence and reform of the convict," the verdict said.
The court awarded Rs 10.5 lakh compensation to the minor survivor.

A fast-track special court in Rewari has rejected the bail plea of a woman teacher accused of repeatedly sexually assaulting a Class 12 male student, who was a minor at the time of the alleged incidents. She also took him to a hotel in Rewari district in June 2024 where she made relations. Police investigation found that the teacher stayed with the minor at hotels, with payments made in cash by her. Defence counsel RK Yadav argued that the POCSO Act distinguishes between sexual assault and penetrative sexual assault, and that in the photographs relied on by the prosecution, the two were only kissing. He said the alleged incidents took place in June and August/September 2024, but the FIR was registered only on March 13, 2025, causing inordinate delay and raising the possibility of a concocted version. The defence also pointed out that the teacher had lodged a complaint against the student for harassment on September 15, 2024, at Sector 6 police station in Dharuhera. 'The boy's father had apologised in writing to the SHO, taking responsibility that his son would not repeat the act, and both father and son signed the apology,' Yadav said. Yadav further told the court that on January 17, 2025, the student had entered the teacher's home, caught hold of her, and touched her private parts with ill intention. 'The teacher shouted, and her husband caught hold of the boy, but he fled. Three days later, an FIR was registered against the boy. On March 3, 2025, the boy's father filed a complaint to the Rewari SP, allegedly in retaliation to the FIR against his son,' Yadav added. The defence argued that the teacher, mother of an adolescent girl and a six-year-old boy, is the primary caregiver, and her husband cannot care for their daughter alone. 'She is ready to give undertaking that she/her family member would not come even within 50km of the place of the incident or the victim/complainant and they have shifted to another district,' Yadav said.

'He then started demanding ₹2 lakh, threatening to leak the footage online.' Terrified, the teenager turned to her friend Arjun, believing he would help her out of the crisis. She even handed over her social media passwords so he could 'deal with' Harsh. However, Arjun allegedly colluded with Harsh, obtained the videos, and began his own blackmail attempts. The sub-inspector added that both accused have been booked under Sections 75 (sexual harassment), 308(2) (extortion), and 351(3) (criminal intimidation) of the Bharatiya Nyaya Sanhita (BNS) and Section 8 (sexual assault against a child) of the POCSO Act. The police have launched a manhunt to track them down.

(Shutterstock/ Representational image) A bench of justice Rakesh Kainthla upheld the Juvenile Justice Board's (JJB) 2024 recommendation that the accused be tried as an adult following a preliminary assessment conducted by the medical board. The assessment, conducted in accordance with Section 15 of the Juvenile Justice Care and Protection of Children Act, 2015, found that the accused had an IQ of 92 and was fully aware of the consequences of his acts. 'The conduct of the petitioner (juvenile) of repeatedly raping the victim, cleaning the blood and threatening her not to reveal the incident to any person, showed that the petitioner was aware of the consequences of his act,' the high court said in its order delivered on July 28, made available on August 7. 'Hence, the findings recorded by the JJB cannot be said to be bad. These findings are sustainable based on the material on record.' The teenager is accused of raping the girl multiple times when she visited his house on February 12, 2021. The girl, in her submission, alleged the accused took her to a cowshed where he raped her and then to his house where she was raped again. The boy was charged under section 376 of the Indian Penal Code (IPC) and the Section 4 of Protection of children from sexual offences (Pocso) Act. The JJB, in June 2024 , ordered the medical board to conduct a preliminary assessment. Based on the board's assessment, JJB referred the case to the children's court for the accused to be tried as an adult. 'The nature of the offence suggested that the petitioner knew the consequences of his act. The statement of the victim showed that the offence was committed in a calculated manner, and the petitioner had sufficient mental and physical capacity to commit the crime. Therefore, the matter was submitted to the children's court for trying the petitioner as an adult,' JJB said in its June 2024 ruling. The accused moved the high court challenging the ruling, asserting that the preliminary assessment was not concluded within three months as provided under Section 14(3) of the JJ Act. The high court, however, dismissed these arguments, saying 'the time period of three months is directory and not mandatory, and the submission that the proceedings are vitiated due to non-completion of the inquiry within three months vitiated the inquiry cannot be accepted.'
