LDS Church loses lawsuit over payment of sexual abuse settlements

SALT LAKE CITY (ABC4) — The Utah District Court has ruled against the Church of Jesus Christ of Latter-day Saints in a lawsuit filed over the payment of sex abuse settlements.
The Church sued its insurance companies, National Union Insurance and ACE Property & Casualty Co., claiming that the companies should pay for a sexual abuse lawsuit involving the church that was settled in West Virginia.
The case, filed initially by the church in 2021, centered around the church disputing the policies of two insurance companies it had contracted with to restitute lost payments tied to a West Virginia sexual abuse settlement — which involved the sexual abuse of children by a man named Michael Jensen.

The lawsuit alleged that the church failed to report a reasonable suspicion of child sexual abuse as required by West Virginia law, failing to protect the children from their abuser. The church settled the case, but their insurance companies — National Union Insurance and ACE Property & Casualty Co. — would not cover the settlements.
The Church then sued the insurance companies in federal court in Salt Lake City, claiming that the companies were in breach of contract. They lost.
The court ruled against the LDS Church on April 6, stating that insurance companies contracted by the church 'did not owe the church a duty to defend or indemnify under any implicated policy,' and as a result, the companies did not 'breach their contractual obligations to the Church under any policy or the implied covenants of good faith and fair dealing inherent in the contracts they entered into with the church.'
The church also came under fire in 2022 after an Arizona bishop learned that a member of his ward was sexually assaulting his 5-year-old daughter. The bishop then followed church policy and called the Mormon Abuse Help Line.
He later informed police that church attorneys in Salt Lake City who staff the help line claimed that because he learned of the abuse during a counseling session, the church considers it a spiritual confession, and he was therefore legally bound to keep the abuse secret.
The abuser was identified as Paul Douglas Adams, a U.S. Border Patrol employee who was living with his wife and six children in Bisbee, Arizona. Adams abused the bishop's daughter for seven more years, and went on to abuse his second daughter, according to the Associated Press. He reportedly finally stopped in 2017 — and with no help from the church — because he was arrested.
The incident led the Associated Press to obtain thousands of pages of sealed court documents that show, in detail, how the church's help line can divert abuse complaints away from law enforcement.
The financial details of the ruling against the LDS Church in regard to the sexual abuse in West Virginia has been redacted.

And, Ms. Lopez said that as she shouted instructions in Spanish to the man inside the vehicle, an agent drew a rifle at her. 'It came across as essentially a final warning, to step back,' Ms. Lopez said, adding that the men then laughed at her and 'started cracking up.' Crews searching off Cape Cod for a missing fishing vessel two days overdue have located a sunken vessel. A boater contacted Brewster Fire and Rescue just before 2:00 p.m. to report a sunken ship around two miles north of the Brewster shoreline, Brewster police chief Heath Eldredge said. Members of Massachusetts State Police and Massachusetts Environmental Police arrived at the location of the sunken ship and took control of the investigation. The F/V Seahorse was last known to be fishing near the Target Ship Wreck near Eastham and was due back in port on Sunday. The Coast Guard said a cell phone ping last placed the ship two miles offshore of Chatham. The vessel is captained by Shawn Arsenault and Orleans police said two people are believed to have been on board at the time the vessel departed. On Tuesday, June 10, U.S. Coast Guard Sector Southeastern New England said via Facebook that the boat, F/V Seahorse, 'was known to be fishing in the vicinity of Target Ship Wreck near Eastham in the Cape Cod Bay.' 'A cell phone ping last placed the vessel two miles offshore Chatham,' the agency added. The ship's captain has been identified as Shawn Arsenault. The Coast Guard also described the 30-foot vessel as white with 'a mermaid on the bow and 'SEAHORSE' painted on the stern in rough lettering.' In a news release shared on Tuesday, the Orleans Police Department, who are assisting in the search, said the boat departed Orleans, Mass., on Sunday, June 8, and had since not returned. As reported by ABC affiliate WCVB, the boat carried Arsenault, 64, and his girlfriend, Felicia Daley, 54. The couple was reportedly planning to go clamming. PEOPLE reached out to the Coast Guard on Wednesday, June 11, for additional information. In an email to CBS affiliate WBZ, Coast Guard Lt. Quinn LeCain said Arsenault was reportedly seen throwing electronic equipment overboard. 'We can't confirm what exactly was thrown overboard. There was a Facebook comment saying that it was his old GPS," LeCain said. Coast Guard Cmdr. Cliff Graham similarly stated, per WCVB. "It was reported he was throwing something overboard. I can't confirm what kind of equipment or what it was specifically." Meanwhile, Sam Miller said she and her dad found a GPS unit with 'F/V Seahorse' on it at a beach Sunday morning, WBZ reported. "Just hoping they find him quickly," Miller told the outlet. "I noticed in the surf there was something floating, so I went down to see what it was, and it turned out to be, we could tell it was a GPS unit off of a boat." Miller's family left a note on Arsenault's truck, and then contacted the harbormaster when they noticed the truck had not moved the following day, per WCVB. The harbormaster then notified the Coast Guard. He just got a new radar, a fish finder, and he was all excited about that. He got it all hooked up. He said he was going not coming home until he has his 30 bags." Members of the public with information about the boat are encouraged to call the Coast Guard or the Orleans Police Department, which PEOPLE also reached out for comment.
