Misuse doesn't warrant law annulment: judge

Justice Aminuddin Khan has noted that the misuse of a law does not justify its annulment.
"The blasphemy law was also being misused. In order to stop this manipulation, later it was decided that investigation of such a case be conducted by an officer of the rank of superintendent police," said the judge while heading a seven-member Constitutional Bench (CB) of the Supreme Court on Tuesday.
The bench was hearing of the intra-court appeals filed against a Supreme Court verdict that annulled the trial of May 9 rioters in military courts in October 2023. A five-member SC bench had also revoked some sections of the Pakistan Army Act, 1952 in its order.
Arguing against the appeals, famous lawyer and PTI leader Salman Akram Raja stated that the apex court ruling in the FB Ali case was in line with the 1962 Constitution. In the FB Ali case, a five-member SC bench had allowed the trial of a civilian in a military court.
Justice Jamal Mandokhail inquired about the powers of military courts under the Army Act, 1952 asking whether a person who is not part of the military could be tried in a military court solely on the basis of his crime. Raja responded that in the FB Ali case, it was stated that the trial of civilians in military courts is only permissible if fundamental rights are ensured.
Justice Muhammad Ali Mazhar asked how FB Ali, who was himself a civilian, was court-martialed.
Salman Akram Raja replied that the court had ruled that ensuring fundamental rights was necessary and that there was no violation of fundamental rights in the trial.
He said the FB Ali case discussed Article 2(d)(1) of the Army Act, 1952 and affirmed that the act introduced through a presidential ordinance was valid, while also stating that it could be reviewed under fundamental rights.
Justice Mandokhail asked about the definition of "nexus" in the FB Ali case.
Salman Akram Raja replied that it referred to inciting the armed forces. He argued that the FB Ali case had been interpreted in a way that gave the impression of allowing the establishment of separate courts.
Justice Aminuddin Khan noted that Salman Akram Raja was arguing against the main decision. In response, Raja mentioned that Justice Ayesha Malik's ruling was also relevant.
Justice Muhammad Ali Mazhar then questioned why sections of the Army Act, 1952 had been declared void. Raja said appeals are filed against judgments, not reasons, and that courts can modify reasons while maintaining the operative part of the ruling, which happens regularly.
Justice Mandokhail recalled that in 1968, an ordinance granted judicial powers to a tehsildar in Balochistan, but when it was challenged in the Supreme Court in the Azizullah Memon case, the court struck it down. He added that the practice continued for 14 years even after the 1973 Constitution.
Raja argued that the law changed in 1987 with the introduction of Clause 3 of Article 175. He asserted that if the court upheld Justice Ayesha Malik's ruling on Article 10-A, it would be a victory for his argument.
Likewise, he said that even if the court ruled that a court could not be established outside Clause 3 of Article 175, it would still support his stance.
The court later adjourned the hearing till next Monday.

ISLAMABAD: The Islamabad High Court (IHC) fixed for urgent hearing today (Thursday), a petition filed by ex-senator Farhatullah Babar against alleged harassment by the Federal Investigation Agency (FIA). The petition was filed Wednesday under Article 199 of the Constitution by advocates, Imaan Mazari and Hadi Ali Chattha against the Ministry of Interior and the FIA and others as respondents, 'Seeking intervention of Court against the unlawful, illegal, arbitrary and mala fide conduct in continuously harassing the petitioner through repeated issuance of ambiguous and illegal notices and summons, in what is an illegal fishing expedition/roving enquiry by the FIA in violation of laws and principles of natural justice.' The petition said that the FIA enquiry was initiated on March 25 on the complaint of a private citizen, unknown to him, living in Morgah, Rawalpindi alleging 'suspected corruption, tax evasion and illicit asset accumulation' and he appeared before the FIA on March 28 a day before Eid holidays. No copy of the complaint was provided to him. Interestingly, on 11 April 2025, a detailed questionnaire of 12 questions was slammed at him through WhatsApp, directing him to answer them all by 7 April 2025, four days prior to receiving it. The questions delved deep into the past, requiring collecting information from multiple offices within and outside the country. Despite this, the petitioners provided answers to all the questions. Instead of acknowledging the answers provided to the questionnaire, the FIA then asked the petitioner on May 27 to explain the source of properties which it claimed to have received from the Election Commission of Pakistan (ECP) when he served as senator and also explain some banking transactions, within five days. The petitioner rejected the alleged transactions of Rs1,500,000 in his account on 3 April 2025 and another alleged transaction of Rs3 million on 5 July 2025 (almost a month away in the future). Thereupon, the petitioner was then directed to appear in person, the petition said. Just when the petitioner prepared replies to these questions, the FIA sent him another notice by WhatsApp, asking him to appear in person, disregarding the previous notice to send written replies. A day before Eid on June 6, Farhatullah Babar uploaded on X (formerly Twitter) extracts from his replies to the FIA and said; 'Two days ago, FIA regurgitated questions already replied to by me on May 12. One Q alleged transaction of 3 M on 5-7-25 (still a month away). Just when replies were being readied, the FIA WhatsApped to appear in person next day (June 5) on eve of Eid holidays. Punjab, Sindh clash over local governance

Information ministers from Punjab and Sindh clashed on Wednesday, exchanging barbs over the state of local governments and governance styles in their respective provinces, both ruled by coalition partners — the PML-N in Punjab and the PPP in Sindh. The war of words comes amid increasing pressure for local government (LG) elections in Punjab, which have been overdue for months. CEC Sikandar Sultan Raja last week warned that an impending order on the matter could embarrass the provincial government. Sindh Senior Minister and Information Minister Sharjeel Inam Memon questioned the PML-N's reluctance to hold LG elections despite claiming to represent Punjab's mandate. "If the Punjab government fails to recognise local institutions, it is undermining the Constitution," Memon said, adding that managing the province through the commissioner system was regrettable and undemocratic. Memon accused Punjab's government of denying people grassroots representation and vowed that the PPP would continue to push for LG elections in Punjab. "We will not abandon the people of Punjab," he said, denouncing the PML-N's "arrogant attitude" and "politics of rights violations". He stated that the perception of Punjab as "the fiefdom of a single party" must be dispelled. He also lamented the Punjab government's "politics of hatred and division." Memon's statement drew a sharp rebuke from his Punjab counterpart, Azma Bukhari. The Punjab information minister stated that the PML-N had previously established a strong LG system in the province and would do so again. Bukhari mocked the PPP, saying the party—which secures 400 votes in a provincial assembly constituency and 50 votes in a union council seat contest —would soon be put to the test. "The arrogant rulers in Sindh should have mercy on the province's suffering people. They have been in power for three consecutive terms, yet their performance remains zero," the information minister said. Meanwhile, PPP Parliamentary Leader in the Punjab Assembly, Syed Ali Haider Gilani, entered the fray, reminding the PML-N-led provincial government that the PPP is a coalition partner and that without its support, the government could not pass the upcoming budget. "The foundation of this [provincial] government rests on the PPP's support," Gilani said. He praised the PPP's "unparalleled services" in Sindh over the years in infrastructure, health, education, and social protection.
