The Court of Cassation in Abu Dhabi rejected an appeal against a ruling awarding a patient Dhs100,000 in compensation due to a non-gross medical error by the treating physician.
The error resulted in the patient experiencing difficulty in walking due to a permanent disability of approximately 20% of the original functionality of the foot. The court clarified that the UAE legislator has been keen on balancing the need for doctors to have reassurance, confidence, and freedom in practising their profession, while also ensuring patients are protected from medical errors and have the right to compensation for resulting damages.
The court referred to Article 18 of Decree-Law No. 4 of 2016 concerning Medical Liability, which stipulates that compensation claims arising from medical liability are only admissible after recourse to and review by Medical Liability Committees.
Additionally, Article 19 of the same law mandates that all complaints related to medical errors be submitted or referred to the health authority, which has the right to refer complaints to the Medical Liability Committee, the court stated.
The committee then must prepare a report on each case and submit it to the health authority within thirty days from the date of referral.
According to case file, the Medical Liability Committee stated in its report that the healthcare provided by the doctor did not meet established medical standards and that he committed a non-gross medical error by failing to directly dealing with the case and delaying surgical intervention, resulting in difficulty in walking and a permanent disability of 20%.
The court noted that the case files lacked evidence proving the patient was employed at the time of the surgery, especially since his age at that time exceeded the legally mandated retirement age. Additionally, medical reports confirmed that the patient arrived at the hospital in a wheelchair, indicating he was unable to walk before the surgery. The court explained that the appealed ruling awarded the appellant Dhs100,000 as compensation for material and moral damages, which it deemed sufficient. Consequently, the court rejected the appeal.

However, the doctor did not repeat the tests to check for inflammation, did not conduct a CT scan to follow up on such cases, and did not choose the appropriate antibiotic. These errors constituted gross medical negligence, causing the son to suffer from material and moral damages. The mother filed a lawsuit, demanding that the hospital and the treating doctor pay Dhs350 thousand, plus legal interest at a rate of 12 per cent, as well as fees, expenses and charges. The Court explained that the hospital had actual authority over the doctor in terms of supervision and guidance. Furthermore, the report of the Higher Committee for Medical Liability, which was appointed to investigate the case, confirmed presence of error and negligence during the operation. The medical report showed that recognised medical principles had not been followed, as the operation had been performed without taking the necessary precautions. Therefore, the court found that the plaintiff's son deserves compensation for this damage, and estimates it at Dhs75,000 for both material and moral damages.

DOHA: Al Wakra Municipality, through its Health Control Section, has carried out a series of food safety inspection campaigns from July 14 to 20 across various food establishments within its jurisdiction. The initiative forms part of the municipality's ongoing efforts to ensure food safety and protect public health. A total of 1,589 inspections were conducted at outlets involved in the sale and handling of food, aiming to verify their compliance with approved health regulations. These inspections led to the detection of four health violations, and official reports were filed against the non-compliant establishments in accordance with Law No. (8) of 1990 on the regulation of human food control. As part of the campaign, 115 kilograms of unfit food items were confiscated and destroyed. Additionally, around 8,000kg of fish displayed at the Al Wakra Fish Market were examined to ensure they met health and safety standards. Abu Dhabi shuts down Cocobona Cafeteria after repeated food safety violations

Abu Dhabi Agriculture and Food Safety Authority (ADAFSA) has issued an administrative closure order against "Cocobona Cafeteria" in Abu Dhabi, holding commercial licence (CN-3952783), for violating Law No (2) of 2008 concerning food in the Emirate of Abu Dhabi and its associated regulations. The closure was also due to the establishment's risk to public health. ADAFSA stated that the food control report indicated the administrative closure was a result of repeated food safety violations and the failure to implement effective corrective measures, necessitating immediate action to ensure food safety and consumer health. The authority emphasised that the closure order will remain in effect until the violations are rectified and that the establishment may resume work only after fully addressing all issues and complying with all food safety requirements. ADAFSA urged the public to report any violations observed in food establishments or suspicions regarding food products by calling the toll-free Abu Dhabi Government number 800555 so that inspectors take necessary actions to ensure safe and healthy food.
