Gov. Polis uses state grants to lean on local governments that buck housing policies

Colorado Gov. Jared Polis signed an executive order Friday that pushes local governments to comply with certain state housing laws as a condition of receiving state grant funding.
The order directs several state agencies to identify funding opportunities that can be prioritized for local governments and projects that align with state housing priorities. It highlights seven state laws passed in the last two years that aim to increase housing options across the state.
Polis said the goal of the executive order is to ensure those who receive discretionary grant funding from the state are prioritizing state efforts to increase housing stock, affordability and sustainability. He estimated over $100 million dollars in state funding will be subject to the order.

'Today we're taking action to make sure that the limited state funding opportunities are prioritized for local governments that are following state housing laws and land use laws and doing their part so hardworking Coloradans to afford to live, work and thrive across our state of Colorado,' Polis said at a press conference in his office at the Colorado Capitol, where he signed the executive order Friday.
While many local governments have supported housing policies approved by the Colorado Legislature in recent years, others opposed the policies and indicated concerns about compliance. Polis said he wants local governments to be able to go through DOLA to help them achieve compliance with new state housing laws.
'We want to make sure everybody is working in good faith and has a plan to implement these laws,' Polis said. 'Some counties have just thought about it and worked on it more than others, and we want to make sure that everybody thinks about it and works on it and gets it done because housing is a statewide issue.'
Laws covered by the executive order include 2024 measures to prohibit residential occupancy limits, require higher-density housing near transit stops, prohibit local minimum parking requirements, legalize the construction of accessory dwelling units, and encourage more sustainable affordable housing, as well as 2025 polices that set regional building codes for factory-built homes and allow some multifamily buildings to have just one staircase.
Housing availability and affordability has been a growing crisis in Colorado that state legislators worked to improve since 2023. A 2023 housing executive order Polis signed said the state is short tens of thousands of housing units, and his new order says the same concerns continue to escalate.
Some of the laws included in the order are not yet implemented, so the provisions of the executive order will apply after the measures take effect.
The executive order requires state agencies including the Colorado Department of Transportation, the Colorado Energy Office, the Department of Local Affairs, and the Office of Economic Development and International Trade to submit a list within 30 days of potential competitive grants and other discretionary funding sources that could be subject to the requirements of the order.
The order will be updated once the governor's office compiles a list of grants and funding to be included, and it will apply to funding awarded after Oct. 6.

Groups to join lawsuit against Polis over alleged ICE cooperation
DENVER (KDVR) — A lawsuit was filed against Governor Jared Polis after a state official said the governor ordered him to comply with a subpoena from the U.S. Immigration and Customs Enforcement. Monday, more groups announced they are joining the litigation and called out the governor in the process. The new groups include lawmakers, labor groups and immigration advocates, all calling out Polis for what they say is a violation of a law he just signed two weeks ago. Gonzalez is a prime sponsor of two bills, SB21-131 and SB25-276. Supporters of the lawsuit are questioning whether the governor violated those bills. Bill sponsors along with other lawmakers, including some chamber leaders, are standing with unions representing state workers calling out the governor: supporting a lawsuit that alleges he instructed the Division of Labor Standards and Statistics Director of the State's Department of Labor and Employment to share what's known as PII or personal identifying information with ICE. Colorado Wins, Towards Justice and Colorado's AFL-CIO announced Monday they will be joining the lawsuit along with Scott Moss, the state department director who came forward with the allegation. Groups worry Homeland Security's request for information from the Department of Labor could have other intentions. 'If they are familiar with the undocumented community, they might be working in a location that has other undocumented workers. And so their work history which was part of the information that was requested, their workplace history could lead to targets of those workplaces,' said Diane Byrne, president of Colorado Wins. ICE said they were requesting the information for an investigation involving unaccompanied children in an effort to make sure the children were being properly cared for. But supporters of the lawsuit say nothing on the subpoena indicates this investigation is criminal rather than civil. 'There is nothing on the face of the subpoena that suggested that this is related to a criminal investigation. It cites the civil code, it has not been through any sort of judicial process. It was not issued by a court and not approved by a court. There is nothing here to suggest that this is related to a criminal investigation and it's unclear to us why the governor would be bending over backwards to try to find a justification that isn't there,' said David Seligman, Executive Director of Towards Justice. Keeping kids safe is a top priority, child exploitation is a deeply concerning issue, and has no place in our state. Complying with this federal subpoena meets the requirements laid out in state law and providing this information is in service of investigating and preventing any criminal activity, which Governor Polis is deeply committed to.' Coloradans spend more time working than people in most states: Study
DENVER (KDVR) — Coloradans spend more time on the clock than people in most states in the U.S., according to a new report. Qualtrics XM, a data tool for businesses, released a report in March analyzing what percentage of the past year people spent working. The study used data from the American Time Use Survey, conducted by the U.S. Bureau of Labor Statistics, for all 50 states. Data: Income levels in Colorado among highest in the US, according to report A handful of states had fewer than 10 survey responses and were excluded from the main story, but were included in a separate list. According to the report, people in these states spent the highest percentage of their past year working: Utah: 25.17% Mississippi: 23.89% North Carolina: 23.51% Alabama: 23.44% Colorado: 22.95% According to the report, Utahns work an average of eight hours and 29 minutes per day, and their time on the clock accounts for over a quarter of the year. Utah and Mississippi were the only states where the average workday exceeded eight hours. Colorado ranked at No. 5, with an average workday lasting seven hours and 44 minutes. After a year with 260 workdays, Coloradans work an average of 120,617 minutes. Report: Colorado has one of the best economies in US despite shortfalls In the report, Qualtrics XM noted several reasons why people in some states work more hours than others. 'In states like Colorado, where housing and general cost-of-living expenses are high, workers may need to work more to afford their lifestyles,' the report states. Other contributing factors include low unemployment rates and a high demand for labor, low wages, industry influences and prevalence of part-time work. Colorado joins lawsuit against ATF over deal ending ban on rapid-fire triggers for rifles
DENVER (KDVR) — Colorado is one of 16 states that have sued the Trump administration over its plan to allow the sale of forced-reset triggers that make semiautomatic rifles fire more rapidly and return devices already seized to their owners. The suit announced Monday argues that returning the triggers would violate federal law, pose a threat to residents and law enforcement and worsen gun violence. It was filed in federal court in Maryland. Governor signs bill requiring training for semiautomatic guns, banning rapid-fire conversion devices 'It's hard enough for our local law enforcement officials to protect Colorado communities from gun violence without the federal government willfully ignoring the law,' said Attorney General Weiser. 'The law is clear: machine guns, and devices that turn a semiautomatic weapon into a machine gun, are illegal. We're suing to stop the ATF and the administration from making our communities more dangerous by distributing thousands of devices that turn firearms into weapons of war. These weapons have no place in our communities, and I will continue to fight to keep Coloradans safe from gun violence.' The Colorado law banning the sale of rapid-fire conversion devices, including forced-reset triggers, was signed into law in April and will go into effect on Aug. 1, 2026. Second Amendment supporters have called on the U.S. Attorney General to investigate the measure as an infringement on the U.S. Constitution. Weiser said in a release announcing the state's participation in the lawsuit that machine gun conversion devices like the forced-reset triggers are frequently used in violent crimes and mass shootings. The state attorney general said that by using these devices, firearms can exceed the rate of fire of many military machine guns. 'ATF has noted a significant rise in the use of these types of devices, leading to incidents of machine-gun fire increasing by 1,400% from 2019 through 2021,' Weiser said in a press release. There had been several legal battles over the devices, which replace the typical trigger on an AR-15-style rifle. The Biden administration had previously argued the triggers qualify as machine guns under federal law because constant finger pressure on the triggers will keep a rifle firing, essentially creating an illegal machine gun. The ATF previously classified the triggers as machine guns, but under a directive from the Trump Administration, the bureau signed the settlement agreement that promises to stop enforcing federal law against the devices. New requirements begin July 1 for Colorado concealed carry permits Rare Breed Triggers, the maker of the devices, had argued that the Bureau of Alcohol, Tobacco, Firearms and Explosives was wrong in its classification and ignored demands to stop selling the triggers before being sued by the Biden administration. The Justice Department reached a deal announced last month with Rare Breed Triggers to allow the sale of forced-reset triggers. The company was previously represented by David Warrington, Trump's current White House counsel. Under the settlement, Rare Breed Triggers agreed not to develop such devices to be used on handguns, according to the Justice Department. The settlement requires the ATF to return triggers that it had seized or that owners had voluntarily surrendered to the government. The states' lawsuit is being led by the attorneys general of Delaware, Maryland and New Jersey. Other states involved are Colorado, Hawaii, Illinois, Maine, Massachusetts, Michigan, Minnesota, Nevada, Oregon, Rhode Island, Vermont, Washington, along with the District of Columbia.
