Implement Common Bar Course to address CLP under-performance, says lawyer

PETALING JAYA : A lawyer is calling for the government to introduce the Common Bar Course (CBC) immediately to tackle the poor performance of aspiring lawyers at the recent Certificate in Legal Practice (CLP) examination.

Vince Tan said the legal profession has long recognised the need for the CBC to be put in place.
'We keep talking about it, but it has yet to be implemented,' he told FMT.
Tan, a director of the Young Lawyers Community, also called for private universities to raise the entry requirements for law schools to ensure only 'the best of the best' enter the profession.
Last year, deputy law and institutional reform minister M Kulasegaran said the government was looking at introducing the CBC with the aim of meeting international standards, particularly the UK's Bar Professional Training Course.
A recent follow-up with the deputy minister revealed that the Legal Profession Qualifying Board (LPQB) was in the process of drawing up a proposed structure for the CBC, before setting up a research team comprising academics from local universities to develop a draft curriculum.
A report recently released by the LPQB also spoke of the 'poor' to 'average' command of English among CLP candidates, inadequate preparation, failure to understand questions, the regurgitation of model answers, and a refusal to take the examination seriously.

Former Selangor Bar chief V Kokila Vaani said the proposed CBC would involve continuous assessments instead of relying solely on a one-off examination.
She said this would allow for better evaluation of key skills such as legal reasoning, advocacy, communication and client interaction, which were crucial for real-world legal practice but often overlooked in traditional academic assessments.
Kokila said the CBC, if properly implemented, would enhance legal training in Malaysia and produce competent, practice-ready lawyers.
Six-month internships
Apart from the CBC, the LPQB report also recommended that CLP candidates undergo a six-month internship with legal firms before being allowed to sit for the examination.
Justin Yap, a CLP graduate from the 2019 class, said he supported the proposal as the examination was heavily theoretical, despite law being a practice-oriented profession.
'An internship at a law firm would expose candidates to real-world legal work and deepen their understanding of how legal principles apply in practice. However, the internship must be well-structured,' he said.
Tan said while internships were important, they may not be sufficient to prepare law graduates for legal practice.
He said a six-month internship may be ineffective if interns were only given routine clerical tasks, such as photocopying, instead of engaging in real legal work.
'True learning starts in pupillage,' he said.

(File pic) PETALING JAYA : The human resources ministry has dismissed claims that the government blocked the participation of labour representatives to the now-concluded 2025 International Labour Conference (ILC). The ministry said the non-representation of workers at the conference held in Geneva was caused by the absence of legitimate leadership in the Malaysian Trade Unions Congress (MTUC), the country's largest trade union umbrella organisation. 'In February, the Court of Appeal ordered MTUC to conduct a re-election of its leadership within 90 days under the watch of a joint special committee,' it said in a statement today. 'This election was later postponed to August, leaving MTUC without a legitimate leadership to represent workers in any official platform.' The ministry stressed that the selection of the Malaysian delegation to the ILC was made transparently under the guidelines of the International Labour Organization, after seeking advice from the Attorney-General's Chambers. It also urged MTUC to expedite its re-election to restore stability to the trade union movement and ensure Malaysia's full participation in the ILC next year. On June 4, Malaysiakini reported that the joint special committee's chairman, J Solomon, denied knowledge of needing to hold an election within three months of the committee's formation. He had earlier criticised the government for failing to register labour delegates for the ILC.

Deputy prime minister Fadillah Yusof said Petronas is relooking its entire operation because of the decline in crude oil prices. KUCHING : Petroliam Nasional Bhd's (Petronas) move to trim its workforce stems from global challenges and is not connected to the national oil firm's issues with Petroleum Sarawak Bhd (Petros). Deputy prime minister Fadillah Yusof said Petronas's restructuring plan is necessary amid the decline in crude oil prices. He said he plans to meet with the company to get more details of the exercise. 'That (the decline in crude oil prices) is why Petronas has to relook its entire operation. I'm planning a meeting with them to get a briefing on the matter and to ensure that the number of layoffs can be reduced, if not avoided,' he told reporters attending the Aidiladha sacrificial event at Taman Hussein Mosque here today. On June 5, Petronas president and CEO Tengku Muhammad Taufik Aziz said the national oil firm is cutting 10% of its workforce to cope with challenging operating conditions, particularly because of falling crude prices. He said the number of staff involved in the downsizing process stands at about 5,000, and those affected will be notified in stages next year. On May 21, the federal and state governments reached an understanding on matters involving Petronas and Petros. According to the joint declaration, Petronas will continue its functions, activities, responsibilities and obligations entrusted to the company in Malaysia under the Petroleum Development Act 1974 and its regulations. Any agreements and arrangements between Petronas and its subsidiaries with third parties for the purpose of liquefied natural gas sales from upstream operations through to LNG exports to foreign parties remain unaffected. A media statement by the Prime Minister's Office following the joint declaration said all relevant federal and state laws relating to gas distribution in Sarawak are to co-exist and be respected by all parties.
