Hazleton man facing felony drug charges released on bail

A 28-year-old Hazleton man charged with dealing drugs in Shenandoah was released from Luzerne County Prison on Tuesday after posting bail, according to court records.
Andy Rosario appeared for a nebbia hearing and was arraigned before Schuylkill County Judge James P. Goodman.
The Schuylkill County Detective's Office charged Rosario in April, alleging he sold suspected fentanyl and methamphetamine to a confidential informant in Shenandoah on Feb. 21.
The purpose of Tuesday's proceeding was to prove whether the money Rosario sought to post for $75,000 bail came from legitimate sources. He brought to the hearing a bondsperson, Amanda Devers Love, who later posted bail on his behalf with the judge's permission.
First Assistant District Attorney Michael J. Stine said that Rosario brought a few of his family members along to present pay stubs to the court and prove he could pay the required amount for a bail bond from Love.
Rosario, who was being held in Luzerne County Prison since April 23, participated via videoconference from the prison.
Schuylkill County detectives said that Rosario met the informant at an undisclosed location, and Rosario provided the drugs in exchange for money.
The drugs were then submitted to the Pennsylvania State Police Bureau of Forensic Services Laboratory for testing.
One of the two plastic bags tested, which was thought to contain methamphetamine, was found not to be a controlled substance. The nature of the substance was not mentioned.
The other — purported to be fentanyl — was actually a mixture of cocaine and xylazine, commonly used as a horse tranquilizer, police said.
Rosario was charged with five felony counts of possession with intent to deliver and a felony count of criminal use of a communications facility. He also faces misdemeanor charges of possession of a controlled substance. All charges were held for court after a preliminary hearing in May.
Rosario is represented by attorney Frank T. McCabe II of Forty Fort.

A Pennsylvania man charged with assault and other crimes after police said he tried to strangle a Bradford County woman and attacked a state trooper will serve up to a decade in prison. Joseph C. Caporusso, 37, of Zion Grove, Pennsylvania, was sentenced in Bradford County Court to a minimum of 15 months and a maximum of 10 years in state prison for his conviction on charges of aggravated assault and burglary, both felonies, and simple assault, a misdemeanor. The charges stem from an incident that took place Dec. 29, 2024 at a residence on state Route 187 in Asylum Township, south of Wysox, according to Pennsylvania State Police at Towanda. Responding troopers learned from the victim, a 44-year-old woman, that Caporusso had stopped at her home under the guise of being lost. The victim said she didn't know her assailant but gave troopers a detailed description of him and his vehicle, state police said. Caporusso allegedly distracted the victim in her driveway and choked her until she slipped into unconsciousness. He then dragged her into the house and attempted to assault her again, troopers said. At that time, the victim regained consciousness and was able to break free from the suspect and flee the scene. Caporusso also fled the residence in his vehicle in the same direction as the victim before crashing, state police said. The victim acknowledged that Caporusso seemed to be having some sort of mental episode." Caporusso has been in custody at the Bradford County Correctional Facility in lieu of bail since his arrest. (WBRE/WYOU) — Attorney General Dave Sunday joined a coalition calling on the U.S. Drug Enforcement Administration to take action on the ban of a drug linked to deaths in Pennsylvania and across the country. In a letter to DEA Administrator Terry Cole, 21 Attorneys General issued a warning on bromazolam, a dangerous and unregulated designer drug often referred to as 'designer Xanax.' According to the release, the synthetic drug is 'highly potent and unpredictable, especially when mixed with opioids.' 'Designer' benzodiazepines, such as bromazolam, appeared in Pennsylvania starting in 2022, when they were part of 59 overdose deaths, with bromazolam most commonly found, AG Sunday stated. That figure nearly tripled a year later, according to the Pennsylvania Department of Health. Authorities noted that Narcan is ineffective against the drug in overdose emergencies. 'It is a race to stay ahead of drug traffickers when dealing with synthetic drugs, and lives depend on immediate action that will give law enforcement the tools to proactively target traffickers. This substance has no legitimate purpose and is becoming far too common in Pennsylvania and across the nation.' Attorney General Dave Sunday Authorities reported that some drug traffickers selling bromazolam are incorrectly labeling the drug as 'legal prescription drugs' or they may be adding bromazolam to other drugs, including fentanyl, other opioids, or methamphetamine. Attorney General Sunday joined the Kentucky-led letter along with Attorneys General from Alabama, Arkansas, Florida, Georgia, Indiana, Iowa, Louisiana, Mississippi, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Virginia, and West Virginia.
