School, ag advocates largely endorse Nebraska school finance reform proposal

LINCOLN — Education advocacy organizations and the state's largest rural-focused organizations largely endorsed an 'incremental' proposal Monday to reform Nebraska's core school finance formula.
Legislative Bill 303, from State Sen. Jana Hughes of Seward and introduced at the request of Gov. Jim Pillen, would bring down maximum school property tax rates by 3 cents, from $1.05 to $1.02.
More state funds would be funneled toward the state's 245 school districts using the state aid formula, the Tax Equity and Educational Opportunities Support Act (TEEOSA) passed in 1990. TEEOSA includes many funds that amount to a district's 'equalization aid,' based on 'needs' minus 'resources.'
For the 2024-25 school year, 75% of the state's school districts did not receive equalization aid. The Hughes effort continues a push by her and Pillen to increase the number of districts receiving equalization aid. The bill also would increase recently established 'foundation aid,' by 6%, to $1,590 from $1,500 roughly per each K-12 student.
The state would invest nearly $120 million in new state funding over the next two years, which is included in Pillen's recommended budget as a strategic investment, in a year where the state must close a projected $432 million budget deficit.
In addition, LB 303 would create a 15-member School Finance Reform Commission, consisting of superintendents, the state education commissioner, lawmakers and representatives from the Nebraska Department of Education. The goal of that group is to find longer-term solutions.
'This is a little bite at the apple, and I hope we keep making chunks at it as we go forward,' Hughes told the Education Committee, where she serves as vice chair.
Hughes, a former school board member for Seward Public Schools, said school finance has been 'largely left on auto steer for decades.' She said she appreciated Pillen's willingness to start pulling some levers in the formula 'to steer us on a new course.'
Hughes has dedicated her time in the Legislature to school finance reform. In her second year last summer, for Pillen's desired special session, she proposed a 10-year plan to lower maximum property tax rates.
By the end of her 'Lower The Levy Cap' plan, the state would have taken on a majority of operational expenses for schools to reverse increasing reliance on property taxes.
Pillen had a similar goal, but his summer plan sought to take on all operational expenses, eliminating the general fund property tax rate for schools, before lawmakers pivoted to Hughes' model, which fell short in the 17-day special session.
The governor repeated his ambition Monday that the state should fund, but not run, local K-12 schools. He said the state must find a balance among federal, state and local funding.
'School districts often live under uncertain budget circumstances,' Pillen said. 'That's not the way to educate and have a focus on our kids.'

Shane Rhian, chief financial officer for Omaha Public Schools, was the lone opponent testifying against Hughes' bill. He argued the bill would hurt OPS's budget in the near future and amount to 'another erosion of local control.'
Rhian said one variable that could impact OPS the most is the full district might no longer qualify for universal free lunch and breakfast soon, leading to a projected loss in $30 million in state aid, approximately 9 cents for property taxes.
He suggested keeping the current $1.05 lid for property tax rates, keeping foundation aid at $1,500 (which was established in 2023) but reducing the assumed portion that districts could contribute in the TEEOSA formula.
TEEOSA currently sets this 'local effort rate' as the hypothesized value that school districts could contribute as $1 per $100 of valuations in the district. This goes into the 'resources' side of the equation, essentially hurting school districts that have lower tax rates.
Hughes' bill would drop this to 97 cents, in line with her 3-cent drop in the maximum tax lid.
Rhian said it should be 96 cents, without reducing the top tax rate cap, which would put the state on the hook for more funding to schools. It would not lower how much schools can raise in property tax rates.
'We appreciate Senator Hughes and the governor for their commitment to funding public schools and stand ready to be a partner in lowering the property tax burden for our patrons,' Rhian said.
OPS has taken the stance of opposing legislation that could cause the district, the largest in the state, to be more reliant on state funding, earning the ire of some past committee members.
Andrew Rikli, superintendent of Papillion-La Vista Community Schools, the fourth largest district in the state, said dropping the maximum tax rate can provide substantive tax relief.
He and Liz Standish, associate superintendent for business affairs for Lincoln Public Schools, said they appreciated the bill represented an incremental step and that there would be a commission to help understand the complex formula.
'As much as we might want to make a major change, for those of us that work in school finance day to day, there's a lot of moving parts and you get really nervous about unintended consequences really quickly,' Standish said.
Rikli said the commission over time can best monitor and respond to changes as needed, rather than perennial updates since the law's enactment in 1990.
Tim Royers, president of the NSEA, representing 26,000 teachers statewide, recommended including school board members, chief financial officers or frontline educators and not just superintendents. He and Hughes noted the commission will need to fix the proposed group's membership so lawmakers are nonvoting members of the executive branch commission, as required under the constitutional separation of powers.
Royers described LB 303 as 'the best school funding bill to come from the governor's office in at least a decade.'
The NSEA generally stays neutral on TEEOSA-related bills, because of different district-level impacts, but NSEA supports the across-the-board increase in foundation aid.
Pillen created that model to give all districts roughly $1,500 per student. LB 303 would increase that to $1,590 under Hughes bill, while bills from State Sens. Dave Murman of Glenvil and Wendy DeBoer of Omaha could lead to greater foundation aid overall, based on inflation or a district's specific needs.
Colby Coash, on behalf of the school boards association, said his members appreciated the increased state investment in LB 303 for being an 'easily scalable bill.'
'But more than that, and in comparison to what we saw happen in the special session and previous sessions, we think this is a doable piece of legislation and it keeps local control central, which is really important to our members,' Coash said.
Hughes said that if the state has additional funds, such as through a lower-than-projected deficit or increased revenue possibly through sales taxes, it would be used to lower valuations inside TEEOSA. This includes agricultural land, which has seen valuations skyrocket.
State Sens. Tom Brandt of Plymouth and Myron Dorn of Adams, both farmers, partnered with Hughes on her bill. They identified about two dozen 'luxury' items and services, such as dating services or pet grooming, that are currently sales tax exempt that they say could be used to bring in new revenue for tax relief.
Bruce Rieker, senior director of state legislative affairs for the Farm Bureau, cautioned the committee that members must not stop. He noted that in the next two years, property taxes would increase by approximately $600 million, meaning even with LB 303, that's an increase of $475 million statewide.
Hughes said her long-term goal is moving school property tax rates statewide closer together. Over time, she said the state can focus more on student success and teacher or staff retention.
'It is a small step, but it is a step in the right direction,' Hughes said of her bill. 'If we can keep going down this path and whittling away this, I think we can get into a place where we're all in a better spot.'
Dave Welsch, a farmer and current school board president for Milford Public Schools, with more than 33 years of school board experience, told the Education Committee he's worked intensively the past 10 years around the TEEOSA formula.
He said the formula needs to be reviewed every year but encouraged a more comprehensive review and offered what he called 'The Simple Plan.' It seeks to repurpose the 'resources' side of TEEOSA and bring maximum property tax rates down to 45 cents. To do so, Welsch proposes repurposing the state's existing property tax relief programs and finding $240 million.
'LB 303 makes some steps in the right direction,' Welsch said. 'But if you don't have a target to aim at, you're going to miss it every time. Taking small steps, sometimes you get off track.'

Nebraska auditor: Financial wrongdoing in local governments seems ‘increasingly commonplace'

(Paul Hammel/Nebraska Examiner) LINCOLN — After Nebraska State Auditor Mike Foley issued a recent statement exposing alleged financial improprieties involving several local governments, he said his office faced a surge of callers requesting probes of their towns, too. It's a common response, Foley said, after news hits of a small-town investigation by the auditor. 'The phone starts ringing,' he said, repeating a common refrain: ''Hey look at us. Look what's happening in my village or county too.'' While grateful for the interest, Foley said such complaints are 'disconcerting' in that they could signal rising misuse of public resources in smaller public entities across Nebraska. He said the alerts also 'distract' from one of his office's other main tasks, bird-dogging the 'mega agencies' of state government. 'How much time can you spend on the Decatur Housing Authority when you've got DHHS sitting over there with 40% of the state budget?,' Foley said, referring to the Nebraska Department of Health and Human Services. Nebraska State Auditor Mike Foley said he won't announce a decision on whether he will seek reelection in 2026 until late this year or early in the next. He told the Nebraska Examiner he's happy as auditor. 'I've got a great team, very dedicated, very talented people. Happy to be here,' said Foley, 71. Foley, a Republican, said he has enjoyed his auditor tenure — 'both times.' His most recent election in late 2022 had him sworn in Jan. 5, 2023. He also served as auditor from 2007 through 2015. In between, Foley served as Nebraska's lieutenant governor. Foley began the 2014 election cycle as a candidate for governor but was defeated in the primary by future running mate Pete Ricketts, who selected Foley as his lieutenant in September 2014. Ricketts is now a U.S. senator. Foley also previously served in the Legislature, serving a Lincoln-area district from 2000 to 2007. — Cindy Gonzalez In his most recent press release June 3, Foley grouped highlights of eight audit letters he sent local governments. His office's allegations ranged from a Decatur housing chief giving herself more than $18,000 in unsupported payments to a Nemaha County commissioner caught on camera using a county gas pump to fuel his personal truck. Not all caller alerts result in investigations, Foley said, particularly if the person complaining doesn't provide enough detail. When a probe of a local government entity is launched, he said, an auditor team typically spends weeks collecting and analyzing information. In many cases, he said, someone is fired or results are turned over to law enforcement. Foley said the Auditor's Office staff of nearly 50 is down from about 60 three decades ago — and has audit oversight of roughly 2,500 units of local government. Under their watch are state agencies, officers, boards, commissions, certain political subdivisions and federal funds under contract. While acknowledging state budget concerns and competing demands, he noted that the state spends about $200 to audit every $1 million in spending. 'That's not a very good ratio.' Standing out as troubling trends during auditor reviews, Foley said, are misuse of credit cards and government-owned vehicles. 'Credit cards are an enormous headache for auditors and for these agencies,' he said, adding that too many agencies allow too many credit cards to be in circulation and are too loose with controls. Agencies are starting to install GPS trackers on public vehicles, he said, which has led to improvements. Foley assembled those eight letters sent over six weeks to local governments as part of an effort to underscore his sense that there has been an 'uptick in improper financial practices in local governmental entities.' (He said the auditor's office, meanwhile, continues to do other work and conduct other reviews.) 'Unfortunately, these more recent eight examples of both accounting incompetence and apparent financial malfeasance at political subdivisions are not unusual,' said Foley. 'Based upon my office's ongoing work, especially over the past year or so, they seem increasingly commonplace — making heightened vigilance, by public servants and citizens alike, ever more crucial.' The examples cited: Decatur Housing Authority in Burt County: In addition to allegedly processing about $18,000 in excessive compensation and unsupported reimbursements to herself, the executive director reportedly mishandled cash rental payments resulting in roughly $8,000 in 'missing money.' She reportedly tried to delete hundreds of computer files. Furthermore, Foley noted that his office earlier this year had sent a separate audit letter to the woman's previous employer pointing to an alleged salary overpayment to herself of about $11,000. The auditor's report on the Decatur Housing Authority did not indicate an effort by the audit team to contact the housing director, who was reportedly terminated from her job in February. The report said it forwarded information to various law enforcement and government agencies. The housing authority board, in its response to the state, said it was implementing steps recommended by the auditing team. Cedar County: A former Cedar County commissioner allegedly used a county pickup truck for personal business — though the commissioner denied that a few photos included in the report represented him on unofficial business. The same commissioner, according to the auditor's report, allegedly allowed payment for county services with gift cards that were largely unaccounted for — something also denied by the commissioner. The auditor's report said the former commissioner didn't provide an explanation for a gift card that was produced during the review. The county also was accused of not following proper bidding procedures for nearly $1 million in contracts. Village of Pleasanton in Buffalo County: Public employees allegedly spent more than $20,000 on village business at Menard's over a two-year period, and one employee allegedly used about $2,000 in rebate coupons as well as several hundred dollars in store credit vouchers for personal purchases. Separate 'shoddy accounting' practices, according to the auditor, resulted in the village paying thousands of dollars of claims. Village of Farnam in Dawson County: The audit team, as part of its review, identified 22 months of utility and other services, or about $2,700, that the former Village Clerk did not bill to herself. At the time of the auditor's letter, she was on the Village Board. She was found guilty of official misconduct in May, paid $3,151 in restitution, and a sentencing is set for July. Nemaha County and Nemaha Rural Fire District 4: Auditors reported that a county commissioner was photographed March 24 using a fuel pump that can be accessed after hours by personnel with insider knowledge. Dundy County: A deputy county clerk who resigned from her position at the request of the Dundy County Board continued to work and was paid full-time wages despite a considerable drop in responsibilities. Custer County: Employees are able to clock in and out of work using mobile devices, and a county highway worker was alleged to be at home or at her kids' events when she was supposed to be at work. She resigned before she could be questioned, the auditor said. Village of Litchfield in Sherman County A Village Clerk, prior to resigning, allegedly paid herself at least $2,200 more than allowed and was paid $763 in 'suspicious' reimbursement. The village allegedly failed to withhold proper taxes from employee paychecks, opening the community to retroactive payments and penalties. Nebraska Secretary of State Bob Evnen announces reelection bid

(Zach Wendling/Nebraska Examiner) LINCOLN — Nebraska Secretary of State Bob Evnen is seeking reelection as the state's chief elections officer. In his campaign kick-off event Friday, the secretary of state touted the state's elections as the nation's most 'secure or accurate.' But he said he wonders whether any non-citizens might have gotten on the voter rolls. Evnen appeared to be trying to balance defending the state's elections his office administers and echoing the concerns of some Republicans and President Donald Trump over election integrity since the 2020 presidential election, national framing that some election experts have warned could undermine trust in elections. 'There is more work to be done, and we must continue to focus on being proactive in the future,' Evnen said. 'Threats to election security are not static.' U.S. Sen. Deb Fischer, R-Neb., and Lt. Gov. Joe Kelly joined Evnen's reelection announcement, as well as a handful of Nebraska state senators. Evnen is running for his third term as secretary of state, but this race follows his closest contest to date, a 2022 GOP primary in which he faced two populist Republican challengers who combined to hold him under 50% of the vote. He won the general election without any major party opponent. His office, in addition to overseeing elections, also handles business registrations and international relations. Kelly emphasized that the country has seen 'some very poorly orchestrated elections,' but 'not in Nebraska.' 'We've been so lucky to have Bob Evnen,' Kelly said. Kelly and other speakers praised Evnen for how he has represented Nebraska when speaking to other counties about trade opportunities with the state, and for his handling of elections. Nebraskans passed a state constitutional amendment in 2022 requiring the Legislature to implement voter ID in Nebraska. Nonpartisan poll watchers have praised Evnen's office for its implementation of the law, and Fewer voters were turned away under the law than in other states with similar laws. Evnen, in talking about the voter rolls and what he described as the risks of non-citizens voting, said years of the U.S. having an 'open border' left him questioning 'whether some of those people ended up on voter rolls.' Election watchdogs have said that framing from some Republicans is based on the 'myth' of widespread voting by non-citizens. The Heritage Foundation, a conservative think tank, analyzed election conduct from 2003 to 2024 and found 24 instances nationally of noncitizens voting out of millions of votes cast. Evnen also reemphasized his support for Trump's executive order overhauling the administration of U.S. elections. The secretary signed on to a joint letter with 19 other Republican secretaries of state this year that requested more access to federal immigration data to help verify voter registrations. Evnen told KETV earlier this year that he would like to investigate whether 46 Nebraskans who have voted over the past several elections are U.S. citizens. When the Nebraska Examiner asked the Secretary of State's Office earlier this year how many non-citizens had been removed from voter rolls or voted in past elections, a spokesperson said the agency has not 'removed anyone due to their status as a non-citizen, nor do we believe that there are many such people registered to vote.' Evnen's office, in the regular course of business, removed 13,550 voters from the voter rolls after the November 2024 election – most due to death or relocation from the state. Such removals are routine and required by federal and state law. Evnen said Friday that his office is working with the Nebraska Attorney General's Office to establish a process to confirm the citizenship of people registered to vote in Nebraska. Current Federal law doesn't require proof of citizenship to register — but it bans noncitizens from voting in elections. Other states, such as Wyoming and Louisiana, have passed state laws requiring anyone registering to vote to provide proof of citizenship. Those bills align with the Safeguard American Voter Eligibility Act, which the U.S. House passed in April. The SAVE Act would require proof of citizenship in federal elections. If the SAVE Act passes the Senate and becomes law, it would codify parts of the Trump executive order that Evnen calls a 'new and hopeful chapter.' 'The President's executive order all but points to Nebraska as the model for how free and fair elections should be conducted,' Evnen said. Evnen has talked about potentially requesting more time from the Legislature to verify signatures on petition drives for ballot measures after questions were raised about the validity of some signatures gathered for recent petitions, including ones targeted in a lawsuit aimed at stopping medical marijuana. Legislation seeking to provide more time fell short this year. Evnen also said Friday that he is 'proudly pro-life and pro-Second Amendment' — topics beyond the scope of his office that could signal that the Secretary of State has bigger aspirations. He said he expected a challenger in 2026, whether from his right flank, a Democrat or both. South Sioux City Police hosted this year's State FOP conference
SOUTH SIOUX CITY, Neb. (KCAU) — South Sioux City was the host to dozens of law enforcement officers from across Nebraska for the Fraternal Order of Police State Conference. The event lets officers connect with others and learn about recent legislation. Several speakers spoke on how the murder of George Floyd in 2020 caused a shift in attitudes towards police, but that shift was less than negative in Nebraska. 'We know that the support from law enforcement, especially across the state, has actually grown because of that,' said Sgt. Anthony Conner, the Nebraska Fraternal Order of Police president. 'I think people saw how tough our job is because it was on the front cover of every paper, and [the] top story of every news. So they saw how tough our job was, so support has actually grown.' Nebraska Governor Jim Pillen signed a bill that aims to help retain officers. It makes tuition waivers available to first responders going to community college. Governor Pillen said several bills were passed to help law enforcement. 'One of the things that's been a big priority for us is that we increase the pay, you know, as so recruitment and enhance recruitment is making a tangible number of gains and results,' said Pillen The Governor also praised Nebraska's law enforcement officers.
