Plea in SC challenges Assam's ‘push-back policy' for deportation

New Delhi, May 30 (UNI) A writ petition has been filed in the Supreme Court challenging the Assam government's controversial 'push-back policy' aimed at tackling infiltration from Bangladesh. The plea, moved by the All BTC Minority Students Union (ABMSU), alleges that the state government is arbitrarily deporting Indian citizens without adhering to legal procedures under the guise of targeting illegal migrants.
Advocate-on-Record (AOR) Adeel Ahmad mentioned the matter before a bench comprising Chief Justice of India BR Gavai and Justice AG Masih, seeking urgent listing.
'I have filed a writ petition as well, challenging the pushback policy of Assam,' Ahmad submitted before the court.
The petition asserts that the policy violates fundamental rights under Articles 14, 21, and 22 of the Constitution and is being misused in the aftermath of a Supreme Court order dated February 4, 2025.
In that ruling, a bench of Justices Abhay S. Oka and Ujjal Bhuyan had directed the state to deport 63 individuals whose Bangladeshi nationality had been verified by both the Ministry of External Affairs (MEA) and the government of Bangladesh.
However, ABMSU's petition claims that invoking the February 4 order, the Assam government has launched a sweeping campaign of informal deportations across border districts such as Dhubri, South Salmara, and Goalpara, even in cases where individuals have not been declared foreigners by any tribunal, have not undergone nationality verification, or have not been informed of their right to appeal.
The Supreme Court is yet to take a call on the listing of the matter.

Ambedkar have once again reaffirmed their belief in democracy and the Constitution,' Mr. Priyank stated, adding that their overwhelming support had not only strengthened his resolve but also silenced those resorting to personal and ideological attacks. Reflecting on the historical and intellectual legacy of Kalyana Karnataka, Mr. Priyank remarked that the region had been a cradle of progressive thought since the days of the Vachana movement, and would never allow the 'regressive and polluted ideology' of the RSS and the BJP to take root. 'The BJP's attempt to undermine me through personal slander reflects its inability to counter me politically, ideologically, or intellectually. They have launched these attacks because I have fearlessly exposed their failures and corruption,' he said. 'I am not alone. With me are thousands who follow the path of Ambedkar and Basavanna. This spiritual and ideological army gives me the strength and confidence to continue the fight against injustice,' Mr. Priyank said. Reaffirming his commitment to the marginalised, the Minister pledged to carry forward his mission to uplift the underprivileged and continue his efforts to dismantle social inequality. New Delhi: The Opposition on Saturday accused the Centre of 'misleading the nation' and reiterated its demand for a special Parliament session on Operation Sindoor after Chief of Defence Staff General Anil Chauhan said that India lost fighter jets on the opening day of the recent military confrontation with Pakistan due to tactical mistakes. In an interview to Bloomberg TV in Singapore, General Chauhan said: 'What is important is not the jet being down, but why they were being downed. What mistakes were made --- those are important. Numbers are not important. The good part is that we were able to understand the tactical mistake which we made, remedy it, rectify it, and then implement it again after two days and flew our jets again, targeting at long range.' Referring to the statements, Congress president Mallikarjun Kharge posted on X: 'The Modi Government has misled the nation. The fog of war is now clearing.' He added: 'The Congress party demands a Comprehensive Review of our Defence Preparedness by an independent expert committee, on the lines of the Kargil Review Committee.' Citing Donald Trump's statements, Kharge said the US president has again repeated his claim about 'brokering a ceasefire'. 'This is a direct affront to the Shimla Agreement.
