
Cop charged with fatally shooting man gets July 9 court mention date
KUCHING: The Magistrate's Court has fixed July 9 for mention of a case involving a Bukit Aman traffic policeman charged with causing the death of a man along Jalan Stephen Yong.
Magistrate Ling Hui Chuan allowed the application by police prosecuting officer Insp Nur Shafiqa Nyaie Ilin for the accused, Lance Corporal Genesis Nitchell David Reddy, 30.
Genesis was represented by lawyers Russel Lim and Brenden Ting from the National Legal Aid Foundation.
Earlier, the court was informed that the prosecution had yet to receive the ballistics report, chemical analysis on gunshot residue and DNA, as well as the full post-mortem report on the deceased.
Genesis, 30, from Kampung Semaba, is charged with the murder of Muhammad Zaki Iderus, 34, who was fatally shot while inside a vehicle on April 26.
He was charged under Section 302 of the Penal Code, which carries the death penalty or imprisonment for between 30 and 40 years, and not less than 12 strokes of the cane, upon conviction.
On May 7, the police officer was charged in court but no plea was recorded as the murder charge falls under the jurisdiction of the High Court.
On April 26, Padawan police chief Supt Mohd Irwan Hafiz Md Radzi was reported as saying that two men had arrived at the Batu Kawa police station at around 5.30am to report that their companion had been shot.
Following the report, six individuals including the policeman were remanded to assist with the investigation. – Bernama

SIBU: A Chinese national who pleaded guilty to dangerous driving resulting in the death of Sabah State Courts director Marutin Pagan, was Tuesday sentenced to five years' imprisonment and fined RM20,000, in default three months' jail, by the Magistrate's Court here. Kuala Lumpur Sessions Court Judge Rosli Ahmad, to whom the case was previously reassigned, ordered that Sun Xue Song's jail term take effect from the date of his arrest on March 30. Advertisement Sun, 42, was charged under Section 41(1) of the Road Transport Act 1987, which carries a maximum penalty of 10 years' imprisonment and a fine of up to RM50,000 upon conviction. Rosli said the court took into account the accused's plea of guilt, the circumstances of the offence, mitigation presented and the broader public interest. 'I accept the accused's guilty plea and convict him as charged. After considering all circumstances, I sentence him to five years' imprisonment from the date of arrest and a RM20,000 fine, in default three months' imprisonment,' he said. The court also ordered that Sun be disqualified from holding a driving licence for five years from the date of the charge and for his passport to be returned upon completion of his sentence. In mitigation, Sun's counsel Terence Tiong Ing Jie submitted that the accused, an engineering graduate, had lawfully entered Malaysia for employment to support his 70-year-old mother and seven-year-old son. He further noted that the accused had no prior convictions, had fully cooperated with the authorities, voluntarily surrendered himself following the accident and expressed sincere remorse over the victim's death. 'The accused made a bereavement payment of RM70,000 to the deceased's wife, not as an attempt to seek leniency but as a sincere act of compassion,' said Tiong. The court was also informed that the collision occurred along a known accident-prone stretch of Jalan Kanowit-Durin. According to the statement of facts, the incident occurred on March 30 at approximately 1 pm when the accused was driving a Proton X70 along Jalan Kanowit-Durin towards the Kanowit roundabout. At the same time, a Toyota Fortuner driven by Margaretha Jeramy Marutin, with four passengers, including the deceased, Marutin Pagan, was already navigating the roundabout. Sun failed to stop and give way at the designated road markings and dangerously entered the roundabout, resulting in a collision which caused the Fortuner to overturn and land on its side outside the roundabout. Marutin sustained multiple injuries and was rushed to Kanowit Hospital, where he was later pronounced dead. A post-mortem confirmed the cause of death as 'head and chest injuries due to a road traffic crash.' Sun initially claimed trial on April 7 before Magistrate Romario Jonoi but changed his plea to guilty during pre-trial case management on May 16. The case was initially handled by Magistrate Oon Kork Chern, who later recused himself due to a personal acquaintance with the deceased. The matter was then reassigned to Judge Rosli Ahmad. Bruneian man jailed over a year for assault and mischief
BANDAR SERI BEGAWAN: The Magistrate's Court recently sentenced a local man to 15 months' imprisonment after finding him guilty of assaulting a man and causing property damage during an incident last year. Ezzeddin Abdul Rahman faced two charges — voluntarily causing hurt to the male victim by punching him on the right side of his head, and committing mischief by using a slingshot to shoot a nut at the front glass window of the victim's house, resulting in BND1,900 in damages. During the trial, Deputy Public Prosecutor Abdul Musawwir Haji Mahli produced eight witnesses, including the victim and his daughter, who were eyewitnesses to the incident. Their accounts were corroborated by CCTV footage showing the defendant damaging the property before attacking the victim. A medical report confirmed injuries consistent with blunt force trauma. The defendant, in his defence, denied the charges and claimed he acted in self-defence, also alleging that his police statement was made under duress. However, the court found his explanations contradictory, inconsistent, and implausible. Magistrate Qamarul Affyian Abdul Rahman ruled that the prosecution had proven both charges beyond reasonable doubt, preferring their evidence over the defendant's testimony. RM193,000 gone: Woman pensioner falls victim to phone scam
CHUKAI: A pensioner was poorer by RM193,000 after falling victim to a phone scam syndicate. Kemaman police chief Supt Mohd Razi Rosli said on May 25, a 63-year-old woman (victim) received a phone call from a suspect impersonating an agent from Takaful Malaysia. He said the suspect claimed the victim had filed a false insurance claim, which could lead to her being fined and imprisoned. 'The first suspect then connected the call to another suspect who pretended to be a police officer. 'The suspect asked the victim to provide her bank card details and the security password for her savings account for verification purposes. The panicked victim complied with the suspect's instructions out of fear of being imprisoned,' he said in a statement today. However, Mohd Razi said that on June 8, the victim was shocked to discover that her savings had been reduced by RM193,000. On checking, the victim found that 20 money transfer transactions had been made to four unknown bank accounts between May 29 and June 8. 'Police advise the public to first verify the phone numbers used by suspects through the 'Semak Mule' online application provided by the Commercial Crime Investigation Department. 'The case is being investigated under Section 420 of the Penal Code,' he added.
