Honolulu's lawsuit against fossil fuel companies leads climate change legal fight
In 2020, Hawaii's capital city sued major oil companies, including ExxonMobil, Shell and Chevron, arguing they knew for nearly half a century that fossil fuel products create greenhouse gas pollution that warms the planet and changes the climate. The companies have also profited from the consumption of oil, coal and natural gas while deceiving the public about the role of their products in causing a global climate crisis, the lawsuit says.
Honolulu's lawsuit blames the companies for the sea level rise around the island of Oahu's world-famous coastline. It also warns that hurricanes, heatwaves and other extreme weather will be more frequent, along with ocean warming that will reduce fish stocks and kill coral reefs that tourists love to snorkel over.
The lawsuit seeks an unspecified amount of damages. Attorneys and media representatives for most of the companies didn't immediately respond to emails and phone messages from The Associated Press seeking comment on the lawsuit.
ConocoPhillips and Phillips 66 representatives sent emails saying they don't comment on pending litigation.
A hearing is scheduled in state court on Tuesday for a defense motion that argues the lawsuit should be dismissed because the state's two-year statute of limitations expired. Honolulu's claims are based on allegations that have been publicly known for decades, the defense motion for summary judgment says.
'The issue of climate change and how to tackle it has long been part of public discussion and ongoing scientific research and debate for many decades,' a Shell spokesperson said in an email. 'There is a vast public record of media articles, scientific journals and government reports for well over 50 years that make this clear. The suggestion that the plaintiffs were somehow unaware of climate change is simply not credible.'
While the case is still far from trial, it's much closer than some 30 similar lawsuits nationwide brought by other states, cities and counties. Lawyer arguments and the judge's questions on Tuesday will give a sense of how both sides will present their cases, said Michael Gerrard, founder and faculty director of the Columbia University Sabin Center for Climate Change Law.
'The first trial in any of these cases will be very significant,' he said. 'It will get a large amount of nationwide or even global attention because the oil companies have not yet had to take the stand and defend themselves in a trial.'
Honolulu's lawsuit has reached this hearing stage, partly because the Hawaii Supreme Court denied motions to dismiss it, and the U.S. Supreme Court refused to take it on.
Meanwhile, a similar lawsuit by Maui County, where a massive wildfire nearly two years ago burned down most of Lahaina and killed 102 people, is on hold.
The state of Hawaii has also filed a similar suit, despite the U.S. Department of Justice in May suing Hawaii and Michigan over their plans for legal action against fossil fuel companies, claiming their climate actions conflict with federal authority and President Donald Trump's energy dominance agenda.
Hawaii's attorney general's office filed a motion last week seeking to stop the Department of Justice's federal lawsuit: 'Allowing this case to proceed would give the United States license to wield the federal courts as a weapon against any litigation between nonfederal parties that an incumbent presidential administration dislikes.'
Honolulu's lawsuit has drawn the attention of Naomi Oreskes, a prominent Harvard University science history professor, who submitted a declaration in a motion opposing the defendants' motion for summary judgment.
Oreskes drew parallels between the fossil fuel and tobacco industries. 'The fossil fuel industry and its allies and surrogates created an organized campaign to foster and sustain doubt about anthropogenic global warming and prevent meaningful action,' she wrote. 'They did this by influencing consumers and the general public.'
Soon before a lawsuit by a group of youths against Hawaii's transportation department was scheduled to go to trial, both sides settled the case last year, agreeing on an ambitious requirement to achieve zero greenhouse gas emissions across all transportation modes no later than 2045.

As the program manager for the CleanTech Alliance's WECAN (Washington Energy: Carbon Advancement Network) innovation cluster, Leroy works to advance policy, education and market support for carbon removal and capture businesses. It's a role that combines his U.S. Army training and education with his passion for combating climate change. During an Army operation in Palau in 2020, LeRoy served as company commander, leading diving projects that included maintenance on navigation buoys and other submerged infrastructure offshore of the island nation. But before that work got started, COVID-19 policies required his team to isolate in individual hotel rooms for two weeks. It gave the West Point graduate plenty of time to reflect on his future and what mattered to him, including his concern over the devastating impacts of climate change on marine environments. 'The military really pounds in their values into you, and emphasizes living a values-driven life,' LeRoy said. For the Army that includes loyalty, duty, respect, selfless service, honor, integrity and personal courage, which he and his wife have developed into a framework for themselves and their three children. In June, LeRoy earned a master's degree in mechanical engineering from the University of Washington with a focus on renewable energy systems, which complements his earlier master's in engineering management from the Missouri University of Science and Technology. Since January, he has channeled his Army background and university education into his work at the Seattle-based CleanTech Alliance. The Pacific Northwest offers ideal conditions for carbon reduction efforts that leverage timber industry waste, marine chemistry, and mineralization in rock formations. Local entrepreneurs and researchers are developing these nature-based solutions alongside more engineered approaches for capturing carbon from industrial processes. LeRoy's engineering background prepped him for talking to smart people with expertise in wide-ranging areas, even if it's a specialty field he doesn't know well. His experience as an Army officer additionally gave him the confidence to lead groups of diverse individuals and interests, engage in challenging conversations and work toward solutions. AI could strengthen the credibility of carbon markets, report says
Artificial intelligence could address a key problem with carbon markets by helping ensure that environmental projects funded through the markets are effective at countering climate change, a new report says. Machine intelligence could determine whether a project such as preserving a forest will actually reduce carbon emissions and is worthwhile. The determinations would address widespread criticism that carbon markets are funding projects with little climate benefit. 'AI is paving the way for a market that is reliable, ethical and robust,' said the report, published recently by Future Investment Initiative Institute, a Saudi Arabia-based nonprofit that advocates for AI. Dutch foundation launches class action lawsuit against FIFA over transfer rules after Diarra ruling
A Dutch group seeking compensation on behalf of soccer players who might have lost income due to transfer regulations has filed a class action lawsuit against the sport's governing body FIFA and five other football associations. The Justice for Players foundation said in a statement Monday that men and women across the world who have played for a club in the European Union or the United Kingdom since 2002 are eligible to join the legal procedure. The legal move follows a landmark ruling from top EU court last year stating that some parts of FIFA's transfer regulations did not comply with the bloc's laws on competition and freedom of movement for labor. The foundation says it is fighting for the right of players 'whose earnings were compromised as a result of FIFA's restrictive rules on termination of contracts and transfers." In addition to FIFA, Justice For Players is also taking legal action against the national football associations of the Netherlands, France, Germany, Belgium and Denmark. 'Preliminary estimates indicate that the number of affected footballers may comprise approximately 100,000 players,' it said. By ruling in the Lassana Diarra case that some FIFA regulations on player transfers are contrary to EU legislation relating to competition and freedom of movement, the European Court of Justice has paved the way for deep changes in the sport's economy. Diarra, a former Real Madrid, Arsenal and Chelsea player, signed a four-year contract with Lokomotiv Moscow in 2013. The deal was terminated a year later after he was unhappy with alleged pay cuts. FIFA and then the Court of Arbitration for Sport found the Russian club terminated the contract 'with just cause' and ordered the player to pay 10.5 million euros ($11.2 million). Diarra argued his search for a new club was affected by FIFA rules, making his next employer jointly responsible for paying compensation to Lokomotiv. Some analysts have compared the ruling to the 1995 decision on Belgian Jean-Marc Bosman. That ruling removed restrictions placed on foreign EU footballers within national leagues and allowed players in the bloc to move to another club for free when their contracts ended. But for now, the decision on Diarra has not changed how the global soccer transfer market, worth more than $10 billion each season, functions. Justice for Players said that economists at Compass Lexecon consulting firm estimate that FIFA regulations caused the affected players to earn about 8% less over their careers. 'All professional football players have lost a significant amount of earnings due to the unlawful FIFA regulations,' said the foundation chair, Lucia Melcherts. 'The past and even current system unduly favours FIFA who has far too much unilateral power. In any other profession, people are allowed to change jobs voluntarily.'
