
Danyl McLauchlan: The politics of the second Covid inquiry

Phase 2 of the Royal Commission of Inquiry into the Covid-19 reponse is now under way. Phase 1 was supposed to be the only phase but all of the opposition parties were unhappy with the narrow scope and terms of reference Labour set for the investigation.
Those parties are now in government, and Labour is unhappy with the design of the terms of reference. The inquiry's subtitle is 'Lessons learned', and so far we've learned that even the once-elevated nature of our royal commissions can be broken by partisan hackery.
These inquiries are supposed to be the gold standard of political oversight. They are convened when something is so terrible or so important – a terrorist mass murder; the abuse of children in state care – it must transcend politics. Most of the mechanisms by which MPs, public officials and corporations routinely conceal their perfidy and incompetence are superseded. Even the police and intelligence agencies can be subject to public oversight. Justice must be seen to be done.
This was a problem for Labour. There had to be a review of the nation's greatest crisis since the war. But it's all very well to demand transparency and oversight into state agencies, private companies and even previous governments. Much less appealing to subject themselves to such uncomfortable scrutiny.
The heroes of the pandemic response – Chris Hipkins, Sir Ashley Bloomfield, Dame Jacinda herself – could be called before the public hearings and cross-examined as if they were common senior officials. This would never do.
After the pandemic
Many things went well during the early stages of the Covid response. It really was world beating. But as the crisis wore on some things went … less well.
Labour knew that the loathsome jackals in the media would focus on the latter over the former. They would pick over the economic measures – also a success, until they weren't. Our post-Covid recession was one of the worst in the OECD, and naysayers and political partisans would use this unhappy coincidence to publicly besmirch the reputations of then-Reserve Bank governor Adrian Orr and then-finance minister Grant Robertson – Ardern's best friend. Unthinkable.
And then there were the anti-vaxxers: the true villains of the Covid era. Traitors. Fifth columnists. Literal fascists. Throughout the pandemic Ardern's government diligently insisted it was following the science, but with the benefit of hindsight, some of the claims made about the efficacy of vaccines in preventing transmission of the virus were less evidence-based than the public was led to believe.
Unfortunately, these statements were used to justify the vaccine mandates, the most divisive policy of the response. The anti-vaxxers would seize on this, use any public hearings to spread their deranged conspiracy theories.
For all of these reasons, Labour's Royal Commission was an unusually private, circumscribed affair. It would be 'future focused' and non-adversarial. It would mostly take place behind closed doors. It would not look to find fault or assign blame. It would have a surprisingly narrow scope: there would be no international comparisons, no examination of the economic impacts or the Reserve Bank's monetary policy. It would not examine clinical or judicial decisions.
When the commission's report was published in late 2024 it was very credible, far from a whitewash. But it was limited by design. By then the government had changed, and New Zealand First negotiated a 'a full-scale, wide-ranging, independent inquiry conducted publicly with local and international experts into how the Covid pandemic was handled in New Zealand'.
This is phase 2. Labour is as disdainful of this inquiry as the right-wing parties were of its own. Hipkins points out that it also has selective terms of reference, excluding the early stages of the pandemic – when New Zealand First was in government alongside Labour. He alleges it's been designed as a platform for the Covid conspiracy theorists.
Belief vs disbelief
It is natural for Labour to despise the anti-vax movement. It is hard to feel sympathy for a group that accuses you of genocide, sentences you to death in a show trial then riots outside Parliament while you're trying to contain a pandemic.
But one of the stark lessons of the Covid era is that there's a non-trivial percentage of the population that does not trust the government, public health system or the media. They were adept at co-ordinating their resistance using digital technologies.
They will be there during the next crisis and Labour never developed a strategy to deal with them beyond sticking their hands over their ears and screaming 'Nazis'. This allegation was, in itself, a category of misinformation. The parliamentary occupiers were primarily hippies, rural Māori and evangelical Christians.
Why was the pandemic response so divisive? What tore the team of five million apart? Philosopher Michel Foucault wrote about a form of tyranny he called the biopolitical state. Alongside the democratic government, he pointed to an unelected apparatus of clinics, hospitals, physicians and bureaucracies managing the health of the population, governing hygiene, sexuality and sanity.
The biopolitical state denies that politics or ideology exist in medicine or public health. This is all science and they are protecting society. But during the 20th century this form of power sterilised young women it considered promiscuous and subjected gay men to electro-shock treatment. The Royal Commission of Inquiry into Abuse in Care documented psychiatrists and nurses torturing children who were Māori, Pasifika, disabled or neurodiverse.
One of Foucault's catch-phrases was 'wherever there is power there is resistance', and because biopolitics presents itself as the embodiment of science and reason, those who resist it revolt against reason itself – a perfect description of the anti-vax movement.
There's no contradiction in believing our pandemic response was mostly successful and its critics mostly crazy, yet still wanting those sweeping public health measures properly scrutinised. NZ First's motives for its inquiry might be dubious but so were Labour's. At least this new investigation does not pretend that the most profound political event in a generation is beyond politics.

The party was drumming up support for their candidate in the Tāmaki Makaurau by-election in South Auckland on Saturday. Peeni Henare will contest the seat for Labour against Te Pāti Māori candidate, former broadcaster Oriini Kaipara, after the death of Te Pāti Māori MP Takutai Moana Tarsh Kemp in June. Henare, who narrowly lost to Kemp at the last election, spent Saturday morning at the bustling Ōtara Market. He was joined by Labour leader Chris Hipkins and other party members, including Georgie Dansey, who will enter parliament on Labour's party list if Henare is successful. Speaking on the government redesigning New Zealand's passport to place the English words above the te reo Māori text, Hipkins said he was opposed to the change. "It's a massive step backwards. We can be proud to have Aotearoa, New Zealand on our passports. It has been there for decades, and no one has complained about it." Henare said the government was not focusing on what mattered. "I'm a big advocate for te reo Māori. It's concerning that the government isn't focused on real issues hurting our people, the cost of living. It's absolute silly games... from this government." Henare said he got a clear vibe from South Aucklanders that people wanted a change in government. "The message was very clear as we walked around the Ōtara Market that people want to see the back of this government." Henare said the passing of Takutai Kemp was very sad. But he said that did not mean Labour should not contest the Tāmaki Makaurau seat. "Anybody who thinks a green seat in the chamber of Parliament is a free pass for anybody is absolute folly. "Should I be successful at this by-election, our tuahine Georgia Dansey, a wahine Māori, will be coming into Parliament." He said Labour was seeking a clear mandate to represent Tāmaki Makaurau in the by-election and the 2026 elections. A 2016 and a 2023 New Zealand passport. Trade on agenda as Trump lands in Scotland for diplomacy and golf

Photo / Getty Images He said the meeting would be 'more of a celebration than a workout', appearing to row back on previous comments that a bilateral trade deal struck in May needed 'fine tuning'. 'The deal is concluded,' he told reporters on the tarmac at Prestwick. But the unpredictable American leader appeared unwilling to cede to a UK request for reduced steel and aluminium tariffs. Trump has exempted British exports from blanket 50% tariffs on both metals, but the fate of that carve-out remains unclear. 'If I do it for one, I have to do it for all,' Trump said in Washington before embarking on his flight, when asked if he had any 'wiggle room' for the UK on the issue. The international outcry over the conflict in Gaza may also be on the agenda, as Starmer faces growing pressure to follow French President Emmanuel Macron and announce that Britain will also recognise a Palestinian state. Protests Trump is due to return to the UK in September for a state visit – his second – at the invitation of King Charles III, which promises to be lavish. During a 2023 visit, Trump said he felt at home in Scotland, where his mother Mary Anne MacLeod grew up on the remote Isle of Lewis before emigrating to the United States at age 18. 'He's original, he does things the way he wants to. Police Scotland, which is bracing for mass protests in Edinburgh and Aberdeen as well as close to Trump's golf courses, have said there will be a 'significant operation across the country over many days'. Scottish First Minister John Swinney, who will also meet Trump during the visit, said the nation 'shares a strong friendship with the United States that goes back centuries'. US discontent The trip to Scotland puts physical distance between Trump and the latest twists in the case of convicted sex offender Jeffrey Epstein, the wealthy financier accused of sex trafficking who died in prison in 2019 before facing trial. In his heyday, Epstein was friends with Trump and others in the New York jet-set, but the President is now facing backlash from his own Maga supporters who demand access to the Epstein case files. Many support a conspiracy theory under which 'deep state' elites protected rich and famous people who took part in an Epstein sex ring. But Trump is urging his supporters to move on from the case. The Wall Street Journal, which published an article detailing longstanding links between Trump and the sex offender, is being punished by the White House. Its reporting team plan to travel to Scotland on their own and join the White House press pool but it has now been denied a seat on Air Force One for the flight home. While Trump's family has undertaken many development projects worldwide, the President no longer legally controls the family holdings. The cold (and occasionally hot) war between Trump and his predecessors
This skirmishing among the select group of men who have held the nation's highest office is a historical anomaly and is sending ripples through the political system. 'If not completely unprecedented, it's aberrational,' said Barbara Perry, co-chair of the presidential oral history programme at the University of Virginia's Miller Centre. 'Ex-presidents feel that they are part of this exclusive club. There are so few people who have been president, and you share this common bond, a brotherhood of sorts. And that is bipartisan and in some ways nonpartisan.' Not this time. Trump's launch of an investigation into Biden, a political opponent, over the autopen violates democratic norms and comes as Biden is seeking to focus on his legacy. Some Democrats want Obama to speak out more forcefully, while he fires back that they should stop looking for a 'messiah'. Bush, the only living former Republican president, is keeping a low profile as Trump reshapes the GOP in a way that reflects a broad rejection of his legacy and that of his father. Senator Chris Coons (D-Delaware) said Trump is attacking the former presidents in large part because he needs enemies. 'Biden beat him and was a good president who delivered on things that Trump failed to deliver on - but he attacks Bush and Obama with equal flair,' Coons said. 'Trump defines himself by who he fights and how he fights. He thrives on the drama of constant tension. A war of all against all, in order to keep people tuning in to the next episode, is how he runs his life.' Trump's supporters contend that his predecessors represent a failed system that has been rejected by voters, so it's not surprising that tensions would erupt. 'Former Presidents Clinton, Obama, and Biden are all part of the same club that's spent decades serving the corrupt DC establishment and protecting the failed status quo. President Trump wears their criticism as a badge of honour,' said White House spokeswoman Liz Huston. 'President Trump remains the ultimate outsider, and he's focused on keeping his promises to hardworking, patriotic citizens and making America greater than ever before.' Photo / Getty Images Obama's role is among the most notable, as he seeks to present a counterpoint to Trump without becoming a high-profile spokesman for the opposition. In a June 17 appearance in Hartford, Connecticut, Obama left little doubt how he views the Trump administration. 'The system is captured by those who, let's say, have a weak attachment to democracy - I don't even think that's a controversial statement at this point,' Obama said. The United States, he added, is getting 'dangerously close' to normalising autocratic behaviour, in part because so few people are pushing back on falsehoods like the notion that the 2020 election was rigged. 'In one of our major political parties, you have a whole bunch of people who know that's not true but will pretend like it is,' Obama said. 'And that is dangerous.' Clinton also has not been silent. He has been promoting The First Gentleman, his latest political thriller with James Patterson, and has been asked about Trump at his book events. In a June 1 appearance on CBS Sunday Morning, Clinton took Trump to task for his cavalier attitude toward judicial rulings, and he predicted that voters will rebel if Trump continues on this path. 'Look, we've never seen anything like this before in my lifetime - somebody who says, 'Whatever I want should be the law of the land. It's my way or the highway,'' Clinton said. Photo / Matt McClain, The Washington Post Biden has been playing defence as the Trump administration and congressional Republicans pursue investigations into whether he was so diminished that his staff used an autopen to improperly approve presidential decisions. They have provided no evidence, but the probes have prompted several Biden aides to invoke their Fifth Amendment rights. Biden has blasted the claims as an attempted 'distraction' from Trump's 'disastrous legislation that would cut essential programs like Medicaid and raise costs on American families, all to pay for tax breaks for the ultra-wealthy and big corporations'. In a sense, the Democratic former presidents are stepping into the vacuum that confronts any party out of power. As Trump presses ahead with his sweeping, chaotic agenda, many Democrats view him as an existential threat and are hungry for someone to hit back. Obama is in some ways a natural contender. A Gallup poll in January found that 96% of Democrats had a favourable view of Obama, and a survey a month earlier found that 84% of them said Obama was an outstanding or above-average president. 'My own view is that Obama, who is the most popular and probably most influential Democrat, should be very seriously considering speaking out more and giving voice to the values and the vision of the Democratic Party on a steadier basis,' said Alex Keyssar, a historian at the Harvard Kennedy School. 'I'm sympathetic to the idea that it needs to be done, and he may be uniquely positioned to do it.' At a recent Democratic fundraiser in New Jersey, Obama focused not only on Trump's actions – 'I mean, that's who he is' – but also on Democrats who, he suggested, are spending too much time hand-wringing and not enough fighting back. 'I think it's going to require a little bit less navel-gazing and a little less whining and being in fetal positions,' Obama said, according to excerpts released by his office. 'And it's going to require Democrats to just toughen up.' On the other hand, just 4% of Democrats in a CNN poll in March volunteered Obama's name as the leader who best reflects the party's core values. Representative Alexandria Ocasio-Cortez (D-New York) was named by 10%, former Vice-President Kamala Harris by 9% and Senator Bernie Sanders (I-Vermont) by 8% – bolstering the notion that the party lacks a clear leader. This is not the first time presidents and ex-presidents have gone after one another, although usually the attacks have been more sporadic and less personal. At the Democratic National Convention in 2004, Clinton, who by then had been out of office for four years, levelled a sharp attack on Bush, a Republican seeking reelection, accusing him of squandering the country's unity after the September 11, 2001, terrorist attacks. But those critiques were broad arguments made as part of well-established political rituals, bearing little resemblance to today's hard-hitting exchanges. As Trump faces growing pressure to release material related to sex trafficker Jeffrey Epstein, for example, he has lashed out on a Truth Social post at Obama, Biden and other officials. 'Why are we giving publicity to Files written by Obama, Crooked Hillary, Comey, Brennan, and the Losers and Criminals of the Biden Administration?' Trump wrote. The post was part of Trump's ongoing drumbeat about his fellow presidents. On June 1, Trump told reporters aboard Air Force One, 'President Obama was a terrible president. President Biden was the worst president in the history of our country. President Bush should not have gone into the Middle East and blow the place up, so I don't give him high marks either.' Photo / Demetrius Freeman, The Washington Post Trump's criticism of Biden in particular has become so reflexive that he recently slammed his predecessor for appointing Jerome H. Powell, even though it was Trump himself who appointed the Federal Reserve chairman. Powell has displeased Trump by not lowering interest rates. Andrew Bates, a Democratic strategist who worked in Biden's White House, said Trump is levelling his attacks in an effort to change the subject. 'He is eager to talk about his predecessor and anyone else because he knows that his support is cratering and the prices he ran on lowering on are going up,' Bates said. Coons said Biden has been judicious about firing back, especially given the direct nature of Trump's attacks. 'Trump has been so aggressive and so personal and so biting,' Coons said. 'If you are a newly-elected president and you are criticising your predecessor's policies, that strikes me more as fair game. But … Trump has made his attacks on Biden so personal and so persistent that it's hard to ignore them.' Trump has been slower to attack Bush, the only living former Republican President. But he and his aides have been clear that they view Bush's decision to launch the Iraq War in 2003 as a historic blunder, an issue that flared up after Trump's decision last month to bomb Iran. For his part, Bush has been notably quiet as Trump has remade the Republican Party that Bush and his father built, demolishing such longtime Republican principles as free trade and low deficits. But after Trump dismantled the US Agency for International Development, Bush recorded a video with Obama and others thanking USAID employees for their contribution to the country. 'You've shown the great strength of America through your work, and that is our good heart,' Bush said. Bush spoke on the video with particular emotion about PEPFAR, the global Aids-fighting initiative he created that Trump has sought to cut. 'This program shows a fundamental question facing our country: Is it in our national interest that 25 million people who would have died now live?' Bush said. 'I think it is.' As the ex-presidents continue trying to calibrate the aggressiveness of their responses to Trump's onslaught, Keyssar emphasised the novelty of the entire exercise. Presidents have always been courteous even when taking office after a predecessor whose agenda they reject, he said. 'Eisenhower did not blame Roosevelt or Truman, and in fact ended up accepting the New Deal,' Keyssar said. 'Neither Kennedy nor Johnson attacked Eisenhower. Nixon did not attack the Democrats, saying Vietnam was their war.' At the New Jersey fundraiser, Obama told Democrats they should not look to former presidents or anyone else to lead them out of the wilderness. Rather, he said, they should focus on winning critical races this November and next year. 'Stop looking for the quick fix. Stop looking for the messiah,' Obama said. 'You have great candidates running races right now. Support those candidates.' Scott Clement contributed to this report.
