uMkhanyakude District challenges intervention
This after Buthelezi placed the district municipality under administration and announced the appointment of Bamba Ndwandwe as administrator on Monday last week.
Ndwandwe, a seasoned local government veteran, has extensive experience working with various municipalities across the province.
According to Buthelezi, Ndwandwe assumed his duties on 1 July and will serve as the ministerial representative until December.

Buthelezi also announced the initiation of a forensic investigation into allegations of corruption and maladministration that have been brought to his attention.
This investigation, being conducted in terms of Section 106 of the Municipal Systems Act, aims to thoroughly examine the various allegations.
The intervention will ensure officials are held accountable should any wrongdoing be uncovered by investigators. Buthelezi further urged the municipal leadership to fully co-operate with the administrator and investigators.
'This cooperation is crucial to ensure the challenges facing the municipality receive the urgent attention they deserve,' he said.
'Fight back'
uMkhanyakude Speaker Solomon Mkhombo claims the intervention has something to do with next year's local elections.
'He is using his position to say he is providing intervention in the interest of good governance. We know he is a wolf pursuing his political interest.
'We have written two letters to him, praying for him to open an engagement opportunity. We are still waiting for his response, but if he is not willing, we will be left with only one choice: to challenge the matter in court.
'We feel a lot of constitutional rights have been violated, and cannot fold our arms while being bullied.
'He is bringing a Section 106 investigation and we will co-operate with that investigation, provided it does not push any political agenda,' he said.

Mkhombo said they viewed the MEC's action as undermining the legitimate authority of elected councillors and the will of the electorate that placed them in office.
'We do not have any reason to cooperate with the administrator; we will continue to work on our own, because as far as we are concerned, all the triggers that were raised before have been resolved.
'The previous intervention lasted almost five years, from February 2021 to 30 April 2025. When the intervention lapsed in April, the MEC misrepresented facts to Council on the basis that the intervention had not lapsed or terminated.
'Council refuted his claim in a letter addressed to him,' said Mkhombo.
He went on to say that they are gravely concerned about the 'premature, unnecessary and procedurally unfair intervention that disregards the autonomy and constitutional rights of the local government institution', adding that the current state of governance at uMkhanyakude 'does not warrant this drastic measure'.
'The intervention should be used as a last resort, only when all other avenues have been exhausted, and only when there is a clear and sustained failure by the council to fulfil its executive obligations. We firmly believe this threshold has not been met in this instance,' he said.

Auditor-General raises concern over governance failings in northern KZN municipality

The embattled uMkhanyakude District Municipality has come under renewed pressure after Cogta confirmed that the MEC had received formal correspondence from the Auditor-General requesting immediate intervention following the uMkhanyakude District Municipality's continued failure to address material irregularities. The AGSA's instruction is based on findings relating to the municipality's long-standing non-implementation of a credit and debt collection policy, as required under Section 62(1)(f)(ii) of the Municipal Finance Management Act (MFMA). 'The failure of the municipality to implement its credit and debt collection policy for a number of years and to take reasonable steps to recover outstanding debt from consumers is likely to result in a material financial loss for the municipality,' said Maluleke. The AG further noted that 'the failure of the accounting officer to take appropriate actions to address the material irregularity led to a decision by the AGSA's Material Irregularity Committee to approve reporting in the audit report of the municipality.' The correspondence defines a material irregularity under the Public Audit Act as a contravention of legislation or breach of fiduciary duty that results in, or is likely to result in, financial loss or substantial harm to a public institution or the general public. 'The department stated that the MEC will abide by the AG's request and comply with the given deadline,' a department spokesperson stated. The latest development comes in the wake of a standoff between MEC Buthelezi and uMkhanyakude municipal leadership earlier this month. On July 14, the MEC was forced to break locks and hold a meeting outside the municipal offices after the speaker and municipal manager allegedly blocked his access. During that visit, he announced that the municipality would be placed under administration in terms of Section 139(1)(b) of the Constitution and introduced Bamba Ndwandwe as the appointed administrator. He also revealed that a Section 106 forensic investigation had been launched to probe allegations of corruption and maladministration. After that incident, the municipality responded by rejecting the intervention, accusing the MEC of undermining local democratic processes and acting without due consultation. 'The intervention infringes upon the constitutional rights of the council… and creates an impression that elected representatives are dysfunctional, which is not a fair reflection,' Speaker T.S. Mkhombo had said in a statement at the time. Mkhombo argued that uMkhanyakude had made strides in stabilising governance and finances since the end of a previous intervention in April. The municipality also warned of possible legal action, saying it was exploring a review under the Promotion of Administrative Justice Act (PAJA). However, with the AGSA's direct involvement now confirming governance and financial management lapses, the pressure on the municipality's leadership has intensified. 'MEC Buthelezi holds the AGSA's office in the highest regard and is committed to acting in the interest of the residents of the uMkhanyakude District,' Cogta said. 'These residents bear the brunt of failed service delivery due to a lack of governance, financial, and consequence management measures within the District.' Zondi insisted that the ANC should promptly initiate an internal investigation into the allegations and refer the two MECs to its integrity commission. 'It is in the interest of the two MECs to have their names cleared, and it is in the ANC's interest to clear its own name quickly,' he stated, emphasising the critical importance of a swift response to uphold the credibility of the government. Political turbulence surrounded Hlomuka and Simelane, after claims surfaced that their personal business affiliations may have improperly influenced government contract awards. In an interview with Newzroom Afrika, Hlomuka contended that he had distanced himself from the implicated company, insisting he was no longer part of it and was unaware of its ongoing activities. 'If it has received any tenders, that information will come out in the investigation,' he added, urging patience for the forthcoming revelations. Provincial Premier Thami Ntuli has demanded thorough explanations from both MECs following the serious corruption allegations. Asserting the need for transparency, Ntuli confirmed that he had proactively reached out to both executives for clarification as soon as he became aware of the claims. 'I would be writing to them so that they give me full information regarding the allegations,' he noted, awaiting their responses by today. Hlomuka's spokesperson Muzi Mahlambi confirmed that the premier had written to the MEC requesting him to give explanation on the allegations regarding school nutrition. Mahlambi alluded that the MEC has also responded to the letter. 'The MEC (Hlomuka) has responded to the letter from the Premier, however, we must give both the MEC and Premier space to process the responses as per premier's request. "What we also need to indicate is that the current tender or contract that is in place now is not disturbed,' said Mhlambi. Further complicating matters for the ANC, Health MEC Simelane faces scrutiny over her family's potential improper gain from government contracts. The implications of her alleged business ties could further erode public confidence in the party's commitment to ethical governance. Zondi reiterated the need for the party to reconcile these allegations with its core promise of ethical governance, which he stated was crucial for any hopes of renewal. 'Defending its own is to assume their innocence without verification,' he cautioned. 'It has caused the party many problems in the past.' With mounting pressure from within and outside the party, the ANC's response to the allegations against Hlomuka and Simelane will be pivotal in shaping its future. Simelane-Mngadi rubbished the allegations against her, threatening to take legal action against people who have implicated her in the Ithala corruption loan scandal. It was alleged that the MEC used her position of power as the chairperson of the Agriculture and Rural Development portfolio committee some years ago to get funding for a family company in Ithala and in government. The allegations surfaced on social media platforms a week ago. However, in statements she issued last week, she reiterated that the allegations were false and malicious, saying she was exploring the legal route. 'I'm exploring legal action to protect my name and my integrity and take to task those who deliberately and nefariously wish to impugn my good name. In our system of government, the separation of powers is clear, MPLs, including committee chairpersons, have no role in Supply Chain Management or operational decisions of departments. Therefore, I could not have influenced any procurement processes."These facts are easily verifiable, and their deliberate distortion shows that this is not an attempt to inform the public, but rather a well-calculated political smear campaign,' concluded Simelane-Mngadi.
