EoDB push: T to soften punishments for minor offences across depts

Time of India5 days ago
Hyderabad: In a major reform initiative, the Telangana govt is working to decriminalise and deregulate select provisions across various departments, aiming to simplify governance and promote ease of doing business (EoDB).
As many as 17 state departments across 23 sectors are involved in this effort, which aligns with the Jan Vishwas (Amendment of Provisions) Act, 2023, and broader national reform goals.
While departments such as forest, labour, and municipal administration have already submitted preliminary proposals, others are in the process of finalising theirs. Central Acts will be handled by the Union govt, while amendments to state laws will be implemented by the state.
For instance, the Telangana forest department has proposed removing imprisonment clauses for certain minor offences, replacing them with enhanced monetary penalties. Under the existing Telangana Forest Act, 1967, offences such as tree felling on private land, forest trespass, and encroachments can lead to jail terms ranging from one to six months — often affecting farmers and tribals near forest areas.

Under the proposed amendment, tree felling may attract a fine of up to Rs 10,000 — with provisions for sealing timber depots or sawmills found in violation — instead of jail time.

A senior forest official said: "The state will amend the Telangana Forest Act, while central Acts such as the Wildlife Protection Act and Forest Conservation Act will be addressed by the Centre." Some reforms under the Jan Vishwas Act have already been enacted at the central level.
Meanwhile, the industries department, the nodal agency for EoDB, is encouraging departments to decriminalise minor infractions and simplify compliance to attract foreign investment.
Recognising that certain financial penalties may be viewed as criminal sanctions under international law, some clauses are being relabelled as 'fees' rather than fines.
A senior official from the department told TOI, "The municipal administration department and the Hyderabad Metropolitan Development Authority are working on flexible zoning and building regulations. At present, even industrial units must allocate 33% of land for setbacks, parking, and open spaces, which is a significant disincentive for multinational companies."
Maharashtra was one of the early movers in decriminalisation efforts, while Gujarat implemented wide-ranging reforms under EoDB. Karnataka focused on decriminalising violations in Municipal and Industrial Development Acts. While streamlining regulatory processes and compliances, Uttar Pradesh reduced criminal liability under its industrial and municipal laws.
The Telangana industries department is also pushing to streamline labour laws.
Currently, establishments that breach working hour norms face criminal penalties. Proposed amendments aim to reduce these penalties and convert them into administrative fees.
Additionally, the labour department is working to allow 24x7 operation of commercial establishments, with provisions for shift-based employment.
In a parallel development, the state govt is also preparing to amend recruitment rules to enable employment of persons affected by leprosy, in compliance with a Supreme Court directive. The law department has asked all departments to submit details of posts currently not available to such individuals, with a view to tabling relevant legislation in the upcoming assembly sessions.

Stray dogs attack 2 students on Bangalore University campus during morning walk

Stray dogs attacked two students of Dr BR Ambedkar School of Economics University on Tuesday on the Bangalore University campus while they were on a morning walk, weeks after Bruhat Bengaluru Mahanagara Palike (BBMP) drew flak over a plan to feed stray dogs non-vegetarian food at a cost of Rs 2.88 crore. Dr BR Ambedkar School of Economics University is on Bangalore University's campus, spread over about 1,000 acres. The campus witnesses more than a thousand footfalls daily, and many living in nearby areas go there for morning walks. It also houses the National Law School of India University (NLSUI). The students, Soujanya G J from Haveri and Rega Nikshitha from Telangana are in the final year of their graduation course. 'They were on their morning walk at two different places. The incidents were reported between 6.30 am and 7 am. We do not know what triggered the stray dogs. The victims were shifted to a hospital for further treatment and they are recovering there,' said a source at Bangalore University. Speaking to G Lokesh Ram, a student leader and research fellow, said the dog menace was rampant at the university. 'A lot of stray dogs that are caught in residential areas are sterilised and are abandoned here. It is not just about morning walk, but also it is hard for us to walk during day and night time in the campus. As we speak, I suspect that there are about 300-350 stray dogs on the campus and there is less space for them to get food,' he added. Vikas Suralkar Kishor, Special Commissioner, BBMP, told that he would not deny the students' claims. But he said it was illegal to relocate stray dogs. 'Generally, if there is a case of dog bite complaint, we take those dogs and keep them under observation for 10 days to check if they have rabies. In case of general complaints, we catch the dogs, vaccinate and sterilise them before releasing them to the same area. But now, we have started multiple observation centres where dog bites have been reported repeatedly. We keep these dogs in observation centres,' he added. Dr T Chandraiah, Joint Director of Animal Husbandry, did not respond to calls made by The BBMP in July launched a scheme to feed rice and chicken to 5,000 street dogs in selected areas of the city. The civic body was about to spend Rs 22 per dog a day and the estimated budget was Rs 2.88 crore. Also in July, a pack of dogs attacked Seethappa, 68, who had stepped out of his house around 3 am in Kempegowda Layout of Kodigehalli. Earlier, in August 2024, stray dogs fatally attacked Rajdulari Sinha, a retired schoolteacher, inside the Air Force East residential camp in Jalahalli. According to the state health department, Karnataka reported 2.81 lakh dog bite cases and 26 people died till July 31. Vijayapura reported 15,527 dog bite cases, followed by Bengaluru city (13,831), Hassan (13,388), Dakshina Kannada (12,524), and Bagalkot (12,392), among other places.

'Trials get dragged for years in India ...': Another AI crash victim's kin moves US court; seeks info from the black-box

NEW DELHI: Son of a Ahmadabad plane crash victim has moved US federal court against aircraft manufacturing company Boeing and sought "raw details of information from the black-box. " Hir Prajapati, son of victim Kalpana Ben Prajapati said that he filed the suit in US for an early verdict and cases in India get dragged for years. "We have hired Mike Andrews. We expect the raw details of information from the black-box to come before us at the earliest so that we can make further decisions regarding the next course of steps, along with our lawyer," Hir said. "In India, trials get dragged for years. We are fighting the case in the US so that a decision is pronounced early. We believe we will get justice. When the incident happened, the Govt helped us a lot. Police too helped us. We are thankful to the doctors too who handed over the bodies to us after a swift DNA mother, Kalpana Ben Prajapati, died in the accident. I had initially booked a 9th June flight for her but she had fast and she told me that she cannot travel that day. So, I then rescheduled it to 11th June. But she told me that she doesn't want to travel on an odd date. So, I finally booked a ticket for 12th June," he added Meanwhile, prominent US-based law firm Beasley Allen will represent at least 65 families from India and the US whose relatives died in the AI-171 plane crash in Ahmedabad. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Do you have a mouse? Play Game Undo The law firm's aviation attorney and the lead lawyer for the AI-171 crash, Mike Andrews, is on a visit to India to meet families. He visited the plane crash site in Ahmedabad. Talking to media persons, Andrews said that the families he met in the UK and India expressed a burning desire for answers, transparency, and information. Andrews said that the legal options available to the family will primarily be based on what data shows and what the investigation reveals. "We visited the crash site and spoke with some of the individuals who were there. We were able to take some photographs and get a feeling of the size of the scene," said Andrews. The Boeing 787-8 plane en route to London from Ahmedabad crashed into a medical hostel shortly after take-off, killing 241 out of 242 people onboard and 19 on the ground. Andrews said that the data will give them an idea of which entity may or may not be responsible for the crash. He added that if Boeing is found to be responsible for this crash, the cases will be filed in the Federal court in the US. When asked about reports of a pilot error being responsible for the incident, Andrews said that more often than not, pilots who are deceased are the ones who are blamed. He added that in other incidents where the planes landed safely, the pilots were not blamed because those pilots can still speak for themselves. Andrews said that previous crashes taught us that the rush to reach a judgement on any crash is premature and speculative. "We need to wait to get all of the data," he said.
