Delhi HC seeks NIA's reply on Engineer Rashid's plea in terror funding case

The Delhi High Court on Thursday sought the NIA's stand on a bail plea by Baramulla MP Engineer Rashid in a terror funding case.
A bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar issued notice on the parliamentarian's appeal against a trial court order which refused to grant him bail on March 21.
The bench also asked the National Investigation Agency (NIA) to respond to a separate plea by Rashid challenging the framing of charges in the case.
It clarified that the NIA's reply shall be filed only with respect to the question of a delay of around 1,100 days in mounting the challenge against the charges.
The court listed both cases for hearing on July 29.
Rashid has been lodged in Tihar jail since 2019 after he was arrested by the NIA under the Unlawful Activities (Prevention) Act in the 2017 terror funding case.

Nagpur: The Nagpur bench of Bombay high court suspended the sentence of two men convicted under the Protection of Children from Sexual Offences (Pocso) Act, and granted bail, since the survivor had failed to identify them during the trial proceedings in the district court. The two appellants had been sentenced to 20 years of rigorous imprisonment by district court for allegedly threatening, extorting, and forcing a 16-year-old boy into performing oral sex. However, HC observed that the survivor neither identified the accused in court nor gave a clear description during his testimony. Justice Urmila Joshi Phalke, presiding over the single-judge bench, noted that there was no substantial evidence to support the conviction, observing that the survivor could not confirm the identity of the accused and that no medical evidence of sexual assault was presented. The survivor, during the district court trial, had stated that the assailants had their faces covered with scarves during the incident. Additionally, the victim's friend, the only other witness present at the time, also failed to identify the accused in court.

Nagpur: Ramtek police busted a flesh trade operating under the guise of a hotel business at Ghotitoka, Ramtek, leading to the rescue of a middle-aged woman. While one of the accused was arrested, the hotel owner, the supposed mastermind, managed to flee. Acting on a tip-off, a police team raided the hotel where they questioned one Mangesh Karemore (39), a resident of Ramtek, at the reception counter. Karemore said that the hotel is owned by Subhash Savarkar, said police. During the search, police discovered a woman who was allegedly pushed into flesh trade. Police said Karemore and Savarkar lured the woman by promising money, provided rooms for clients, and coordinated transactions via mobile phones. Senior police inspector Ramesh Shete told TOI that the racket functioned like an escort service. "All dealings were done over the phone. Customers were directed to the hotel, which has six rooms behind it. That's where the woman would meet the clients," Shete said. Savarkar was out on bail since 2023 after a conviction in a similar offence. Police believe he fled the scene after getting wind of the raid. Kaushambi (UP): A man accused of raping an 8-year-old girl here has been found innocent after an SIT probe revealed that the allegations were false and motivated by personal rivalry, police said on Tuesday. For the family of the man, Siddharth Tiwari, it was too late. His father died by suicide last week after all his efforts to convince the authorities of his son's innocence failed. Based on the Special Investigation Team's (SIT) findings, the rape charges against Siddharth were dropped and he was granted bail by court on Monday. The incident took place in Lohanda village under the Saini police station limits. On May 28, a complaint was received from a resident, alleging that his daughter was sexually assaulted by Dhunnu alias Siddharth Tiwari. Based on the complaint, Siddharth was arrested on May 29, police said on Tuesday. Later, police formed an SIT, led by Inspector Dhirendra Singh of Kadadham police station, amid protests from locals. The SIT found that Siddharth had only slapped the girl and she was not sexually assaulted. The complaint was exaggerated due to a personal rivalry, Superintendent of Police (SP) Rajesh Kumar said. Following the SIT report, sections related to rape and the Protection of Children from Sexual Offences (POCSO) Act were removed from the FIR, and Siddharth was granted bail by the chief judicial magistrate's court on Monday, the SP said. Days after Siddharth's arrest, things took a grim turn when his father, Rambabu Tiwari (50), a farmer, died by suicide on June 4 as his efforts to prove his son's innocence failed. His death triggered protests in Lohanda, and angry locals blocked National Highway 2 on June 5. The protesters fought with police, who used force to disperse the crowd. Later, Rambabu's last rites were conducted amid tight security. Police said they have registered a case against 10 named and 25-30 unidentified people in connection with the highway blockade and taken four into custody. On a complaint by Siddharth's family, a separate case has been registered against five people, including village head Bhoop Narayan Pal, who is on the run. A reward of Rs 25,000 has been announced for anyone providing information leading to his arrest, police said. SP Rajesh Kumar said three police officials -- Saini SHO Brijesh Karvariya, outpost in-charge Alok Rai, and investigating officer Krishnaswaroop Yadav -- have been suspended for negligence in handling the case.
