Attempt To Grope Breasts 'Aggravated Sex Assault' But 'Not Rape': Calcutta High Court

The Calcutta High Court on Friday, suspending an earlier order by a West Bengal trial court convicting and sentencing an accused under the Protection of Children from Sexual Offences (Pocso) Act, observed that an attempt grope the breasts of a victim can only support the charge of "aggravated sexual assault" and not "attempt to rape", under the act.
The trial court found the accused guilty of both "aggravated sexual assault" and "attempt to rape", and had sentenced him 12 years of rigorous imprisonment.
Hearing the appeal, a division bench of Justice Arijit Banerjee and Justice Biswaroop Chowdhury also observed that the medical examination of the victim in the case did not indicate any penetration or attempt of penetration.
It noted that, as per the version of the victim, the accused tried to "grope her breasts" under the influence of alcohol.
"Such evidence may support a charge of aggravated sexual assault under Section 10 of the POCSO Act, 2012, but prima facie does not indicate commission of the offence of attempted rape," the division bench observed.
It also observed that if after the final hearing, the charge is scaled down to just "aggravated sexual assault" from both "aggravated sexual assault" and "attempt to rape", the imprisonment period for the convict would also be scaled down between five and seven years from 12 years, which is applicable in case of "attempt to rape".
In this particular case, the convict has already spent 28 months behind bars.
The bench ordered that the operation of the order of conviction and sentence shall remain suspended till the disposal of the appeal or until further orders, whichever is earlier. It also stayed the payment of the fine till the disposal of the appeal.
However, at the same time, the division bench also clarified that its observations should have no impact on the hearing of the appeal.

New Delhi: A minor girl died after she was allegedly raped and stuffed into a suitcase in a bleeding condition in Delhi's Dayalpur area, a police official said on Sunday. The suitcase, in which the girl was found in an unconscious state, was found on the second floor of flat in Nehru Vihar on Saturday evening, hours after her family launched a hunt for her following her disappearance, the police said. Deputy Commissioner of Police (North East), Ashish Mishra, said, "At around 8.40 p.m. last night, a PCR call was received regarding a nine-year-old minor girl found in an injured condition." "Upon reaching the location at Gali No. 2 in Nehru Vihar, the Dayalpur police team found that a minor girl in an unconscious state had been taken to hospital by her father," he added. "Our team also reached the hospital, where doctors, after the preliminary examination, declared her dead. Signs of sexual assault were found," he said. A case has been registered at Dayalpur police station under Sections 103(1), among others, of the Bharatiya Nyaya Sanhita dealing with murder and Section 6 of the POCSO Act that deals with aggravated sexual assault, the police said. Soon after the detection of the suitcase, crime and forensic science laboratory teams inspected the spot, and multiple teams were deployed to trace the accused using CCTV footage collected from the area, the police added. The father of the deceased girl said, "We have not received any information yet. Now we are going to the mortuary for the child's post-mortem. We will find out more when we get there, as the police have called us." Earlier, the girl's family members raised an alarm when she failed to return after delivering ice at her aunt's place on Saturday afternoon. The girl's father said that inquiries in the colony revealed that a man had taken her to his flat, the police said. When the family reached the flat it was found locked. The house owner said the keys of the flat were with his brother, the police added. After the lock was broken open, the disrobed girl, in an unconscious state, was found in the suitcase, the police said.

During the initial investigation, when the women's statements were recorded, it was revealed that they are Bangladeshi nationals from poor families. The women were desperately seeking work to support their families, the police said. The victims told the police that the accused falsely promised them jobs in hospitals in Mumbai. Last month, they were allegedly brought to Mumbai by illegally crossing the international border between India and Bangladesh. The accused allegedly bribed some government officials at the border to facilitate their illegal entry into India. The group members also allegedly helped one of the three women in making an Aadhaar card in her name to conceal her Bangladeshi nationality, an officer said. The four accused have been booked under sections 143(3) [trafficking of person], 144(2) [Exploitation of a trafficked person], 336(3) [crime of forgery], and 3(5) [common intention] of the Bharatiya Nyaya Sanhita (BNS) and sections 4 and 5 of the Illegal Trafficking (Prevention) Act. The police are investigating whether the group trafficked women and forced them into the flesh trade in the past.
