'Can't Be A Silent Spectator': Calcutta HC Seeks Delhi Govt's Reply Over Bengal Migrants' Detention

The Calcutta High Court on Friday sought answers from the Delhi government regarding the alleged detention of migrant workers from West Bengal in Delhi. It directed the Delhi Chief Secretary to submit a report by July 16.
The High Court also instructed the West Bengal Chief Secretary to contact his Delhi counterpart and provide a report on the same day.
While hearing habeas corpus petitions from the relatives of those allegedly detained, the High Court asked the Delhi administration to clarify whether the migrants were detained.
The petitioners also sought direction to the authorities concerned for their release and production before the court.
The two petitions claimed that Sweety Bibi, Kurban Sheikh, their minor son, Sunali Khatun, Danish, and his minor grandson had been unlawfully detained in New Delhi.
The petitioners' advocate argued that Bengali-speaking individuals were detained in the national capital on suspicion of being Bangladeshi citizens without verifying their identities.
'In view of the nature of allegations made, prima facie, we are of the opinion that the writ petition is maintainable and this court cannot be a silent spectator," stated the division bench of Justice Tapabrata Chakraborty and Justice Reetobroto Kumar Mitra.
The court further directed the Delhi government to present relevant documents to clarify whether the individuals had been detained or were missing. The Delhi government must also specify if the detention was related to any court order and the grounds for it.
The court adjourned the matter till July 16.
Lawyers representing the West Bengal government submitted that the state authorities are taking necessary steps to obtain instructions from the Delhi administration.
Similar orders were issued by the Calcutta High Court to the Odisha government on Thursday regarding allegations that two migrant workers from West Bengal were under illegal detention in Odisha.
The court directed the Odisha government to clarify whether migrant workers Sainur Islam and Rakibul Islam were detained by the Odisha Police in Jagatsinghpur district.

Ajmal's predicament echoes across West Bengal, where thousands of migrant workers are trudging back to the state from cities such as Delhi and Gurugram against the backdrop of a growing backlash against 'illegal Bangladeshis'. According to state government sources, over 1,000 migrants from across India have returned so far, although they also admit that the actual numbers could be higher. Mosaraf Hussen, the TMC MLA from Itahar in Uttar Dinajpur and the party's minority cell chairman, claimed several migrants in his constituency had returned from Gurugram. Hussen has set up a help desk to assist the returning migrants. 'We will have to make plans for them if they start returning in large numbers,' he said. In the face of the arrivals, Chief Minister Mamata Banerjee has asked Labour Minister Moloy Ghatak and West Bengal Migrant Welfare Board chairman Samirul Islam to hold a meeting with the state chief secretary and explore avenues of employment for the migrants. 'As our CM has said, those migrant labourers who have returned or are returning to Bengal will be provided alternate avenues of income. There are enough employment opportunities in the state,' Islam, a Rajya Sabha MP from the Trinamool Congress, said. Of this, however, even the returning migrant workers remain sceptical. Although he allegedly spent several days in detention, Ajmal is still considering returning to Gurugram. 'We would make between Rs 25,000 to Rs 28,000/month at Gurugram. I have elderly parents, three brothers and a sister to take care of. What will we eat if we don't go to work outside?' he asked. In Malda's Chanchal, Mukul Hossain is afraid of returning to Gurugram although he knows he may have little choice. A mason, Hussain was allegedly picked up by the police on July 11, kept in detention for five days, and assaulted while in custody. Now back home, he wonders if he should return. 'First, I will try to start a business in Bengal. If we succeed, we will stay, but if we don't, we will have to return,' he said. 'The state government is saying that they will arrange work for us but the question is whether I can earn as much in Bengal as we did there [in the National capital Region]'. But those Bengali-speaking migrants who remain in NCR are finding it harder to find work. Noor Alam, a delivery executive working in Gurugram, was detained for two days last month and is now trying to return home to Chanchal. 'The problem is that, now, we aren't getting proper work here in Gurugram. Of the 25 Bengali families in our mohalla in Gurugram, 20 have returned. We're trying to go back but are having trouble finding train reservations,' he said. With just months to go for the state assembly polls, the migrants' return is snowballing into a political row, with the Opposition accusing the ruling Trinamool Congress of inaction. 'The TMC is doing cosmetic surgery but they are not trying to make industry here generate employment. They are shouting and trying to get political mileage. But they are not trying to solve the problem. Have you heard the West Bengal government talked with Delhi [or Haryana] governments? They only want the problem to linger,' senior Congress leader and former Baharampur MP Adhir Ranjan Chowdhury said. Labourers were coming 'in small groups' and not in 'large numbers', Asif Faruq, state secretary of the Parijayee Shramik Aikya Mancha – or the Migrant Labourers Unified Forum, said. But he also admitted there was 'lack of data' when it came to migrant workers and their movement. 'They are coming in small groups wherever they are detained or harassed by police in pockets in different states including Haryana. For instance, migrants from some pockets in Delhi are returning but others are still working there. However, it is also true that the nature of jobs they do outside and the money they earn is not possible here. We are waiting to see what the government has in store for them,' he said. Meanwhile, as the state continues to struggle for a response to the looming problem, some migrants remain in the national capital region, determined to stay on if they can. Among them is Alam Ali, another resident of Chanchal who works as a housekeeper in Gurugram. 'My father-in-law and I work in a housing society and earn Rs 12,000. We also wash cars, which makes us an additional Rs 5000-6000/month. Where will we get such a salary in Bengal? We may go to Bengal for some days but after normalcy returns, we will return,' he said.

Kannada actor Darshan Thoogudeepa was arrested in Bengaluru on Thursday, just hours after the Supreme Court cancelled the bail granted to him by the Karnataka high court in the Renukaswamy murder case. Police took him into custody near his Hosakerehalli residence soon after he returned to the city from an outstation trip. According to police, Gowda was picked up earlier in the day by the Annapoorneshwari Nagar police. Pradoosh S Rao, Lakshman M, and Nagaraj are among those detained. While cancelling the bail to the actor, a bench of justices JB Pardiwala and R Mahadevan said, 'Granting leniency to such persons despite grave charges of conspiracy and murder sends the wrong message to society and undermines public confidence in the justice system.' In a democracy governed by the rule of law, the bench said, 'no individual is exempt from legal accountability by virtue of status or social capital'. In the present case, it said, 'By treating A2's (Darshan) stature as a mitigating factor, the high court committed a manifest perversity in the exercise of its discretion, thereby warranting cancellation of bail.' Police officers said a copy of the Supreme Court order was submitted to the trial court to secure arrest warrants for all the accused before their remand to judicial custody. The order follows a special leave petition filed by the state government challenging the high court's decision in December 2024 to grant bail to the accused. Darshan, who had been away when news of the court's decision reached him, was contacted by police and asked to appear before investigators. He complied, arriving in a luxury SUV before switching to another vehicle to avoid the media assembled outside his apartment. He entered the premises through the back door. The murder case, began with Darshan's arrest in June 2024. Police allege he orchestrated the killing of Renukaswamy, a resident of Chitradurga, after the victim allegedly stalked and abused Gowda on social media. The actor was detained on June 11, 2024, in Mysuru while filming The Devil and was held in custody for 131 days. He was released on interim bail in October and granted regular bail in December. With the latest court order, Darshan is expected to be shifted to the Ballari Central Prison. He was previously housed there after being moved from the Parappana Agrahara Central Prison when images emerged of him smoking and mingling with high-profile inmates. Following that episode, Ballari prison authorities heightened security measures, including raising the perimeter wall to 25 feet and preparing a secure cell. The measures were taken after fans breached prison boundaries during his earlier detention, police officers said. The Supreme Court's decision comes a day before the scheduled release of the first song from The Devil. The film's team had announced on August 10 that the track 'Idre Nemdiyaag Irbek' (You should live in peace) would be released on Independence Day morning, an event now likely to be overshadowed by the arrest. For Renukaswamy's family, Thursday's ruling was a moment of relief. His father, Shivanagouda, welcomed the decision. 'Darshan's bail has been cancelled. There is an order to arrest him. This brings our faith back…The Supreme Court order reinstates the belief that no one can escape the law,' he said. Chief minister Siddaramaiah's legal advisor AS Ponnanna said the verdict would strengthen the prosecution's case. 'We had feared that the investigation would be hampered because Darshan was out on bail. There was a possibility that he could influence the witnesses while he was out. However, now all these challenges will be resolved with the order given by the Supreme Court,' he said. Soon after the court's order was received on Thursday morning, senior police officials briefed home minister G Parameshwara at the Vidhana Soudha. 'The law is the same for everyone. No one is above the law in the country. Everyone should respect the law of the land. The accused have the opportunity to fight for justice further, and that is also allowed by the law,' Parameshwara said.
