The Madhya Pradesh High Court has commuted the death sentence awarded by a trial court to a man convicted of raping a four-year-old minor girl.
A division bench, comprising Justices Vivek Agarwal and Devnarayan Mishra, observed in their order on June 19, 'No doubt that appellant's act was brutal as he has committed rape upon the victim of four years and three months of age and after committing rape also throttled her treating her dead and thrown the victim in such a place where she could not be searched and left the spot but it is also clear that he has not committed brutality.'
According to the prosecution, the convict entered the complainant's hut and requested a cot to sleep on. Later that night, he allegedly opened the gate of a nearby house where the victim and her parents was staying, abducted and raped her. Thereafter, he allegedly left the child in an unconscious state in a mango orchard, believing her to be dead.
The High Court was hearing a criminal appeal filed by the convict against a trial court judgment which found him guilty under Section 307 of the Indian Penal Code and Section 6 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act).
The high court acknowledged that the aggravating circumstance of this case was the age of the victim and the convict. The bench stated, 'There are aggravating circumstances that the victim was four years old and the rape was committed upon such a kid and offence was committed in such a way that the private part of the victim was torn and after committing the offence, the victim was thrown in the solitary place treating her that she had died.'
However, the bench also took note of the fact that the convict, aged 20, is uneducated and belongs to the tribal community and his parents never tried to give him education and did not take proper care of him. Therefore, he left his house and was earning, living and working in a restaurant, the court said.

More than 12 years after he went underground, the National Investigation Agency (NIA) on Friday arrested a key accused in the 2013 Kasaragod fake currency cases from the Mumbai airport, following his extradition from the United Arab Emirates. The accused, Moideenabha Ummer Beary alias Moideen, had been in the custody of UAE authorities since 2015 and was handed over to Indian officials after the completion of a simplified extradition process. He was wanted in connection with four cases registered by the NIA in 2013 following the seizure of fake Indian currency notes (FICN) in Kerala's Kasaragod district. Moideen, a native of Udupi district in Karnataka, was taken into NIA custody upon his arrival from Dubai and immediately flown to Kochi, where he was produced before a special NIA court in Ernakulam. NIA officials said Moideen had conspired with other accused to procure counterfeit currency worth Rs 31 lakh from the UAE. The fake notes were trafficked into India by an associate, Usman, through the Bengaluru airport and subsequently circulated in and around Kasaragod. Following the recovery of the FICN in 2013, NIA moved to revoke Moideen's Indian passport and obtained an Interpol Red Notice against him. He was tracked down and arrested in the UAE two years later. His extradition marks a significant step in the crackdown on cross-border fake currency operations, officials said. The NIA has already chargesheeted six people, including Moideen, under various sections of the Indian Penal Code in the case.

Four years after an assistant municipal commissioner of the Thane Municipal Corporation (TMC) was attacked with a knife during an anti-encroachment drive, causing her to lose three fingers, the attacker was sentenced to seven years in jail by a court in Thane. The court found Amarjitsingh Yadav, a hawker, guilty under sections including attempt to murder, assault or use of criminal force against a public servant and causing grievous hurt of the Indian Penal Code. On August 30, 2021, around 6.30pm, an anti-encroachment drive was underway at Kasarvadavali vegetable market in Thane. Assistant municipal commissioner Kalpita Pimple and security personnel accompanying her, Somnath Palve, were attacked by Yadav with a knife. While Pimple's three fingers had to be amputated due to the attack, Palve too suffered injuries on his finger. Special public prosecutor Shishir Hiray said the court had relied on eyewitnesses, the attack weapon and other evidence to prove the case against Yadav. The prosecution also examined medical experts, who deposed about the injuries caused to the two victims. Pimple and Palve also deposed before the court. Hiray said the injuries on their fingers were due to their attempt at stopping the attack. He had submitted before the court that the attack would have been fatal otherwise. Yadav had claimed innocence stating he was falsely implicated. The detailed order is yet to be made available. Additional sessions judge A S Bhagwat, while convicting Yadav, also directed him to pay a fine of Rs 20,500. It directed that it be paid equally to the two victims, Pimple and Palve.

Meghawadi police arrested a 24-year-old man and his 21-year-old woman friend on Thursday for allegedly sexually assaulting a 10-year-old girl with a screwdriver, causing injury to her private part. The accused also filmed the crime, the police said. According to the police, the girl's 36-year-old mother works as a supervisor in a catering service firm. She lives in a chawl. The accused, both waiters who work under her, also stayed with her. As per the police complaint, when the girl's mother was out at work between May 15 and June 14, the accused sexually assaulted the 10-year-old at least four times. Police said the 24-year-old man allegedly raped the girl several times, assaulted her with a screwdriver while his girlfriend filmed the crime. The man also allegedly assaulted the girl with blunt objects and threatened to make the video viral if she told her mother about it, police said. On Thursday, she told her mother about the sexual assault, who reported it to the police. 'Both accused have been arrested. They were produced before a special court, which remanded them in two-day police custody,' said Sambhaji Jadhav, senior inspector, Meghwadi police station. Police have pressed sections 64(1) (rape), 64(2)(i) (rape on a woman incapable of giving consent), 77 (voyeurism), 115 (voluntarily causing hurt), 352 (intentional insult by abusing), 351(3) (criminal intimidation by threatening to cause death or grievous hurt) of BNS; 4, 6, 8 and 12 of POCSO Act, and 66E and 67B of IT Act.
