The police said that last Tuesday, "at approximately 5:55 p.m., officers responded to a reported traffic collision in the 1000 block of West Hudson Boulevard.
"Upon arrival, police found that a 7-year-old juvenile male had been struck by a Jeep Cherokee being driven by a 76-year female driver.
"The preliminary investigation revealed that the child was attempting to cross the street outside of a crosswalk with another juvenile male, aged 10, when he entered the roadway and was hit."
UNSUPERVISED
Legend was initially taken to CaroMont Regional Medical Center with life-threatening injuries.
But he was later transferred to Levine Children's Hospital in Charlotte.
The police said, "Tragically, he succumbed to his injuries and was pronounced dead near 10 pm."
In regards to the double arrest, it added, "While the Gastonia Police Department offers its deepest sympathies to the family for the heartbreaking loss of their child, the investigation revealed that the children involved were unsupervised at the time the boy stepped into traffic.
"In such cases, adults must be held accountable for their responsibilities to ensure a safe environment for their children."
SUV DRIVER
Witness to the collision, Summer Williams said she had seen Legend dash out on to the road, as his older brother desperately tried to hold him back.
She added, "Even at night, I still see his (Legend's) face."
Cops confirmed that the SUV driver has not been arrested.
The statement said, "At this time, there is no evidence of speeding or wrongdoing on the part of the driver, therefore no charges have been filed.
"The driver continues to be cooperative and the incident remains under active investigation by the Gastonia Police Department's Traffic Division.
"Anyone who witnessed the crash or may have relevant information is urged to contact Corporal Carpenter with the Gastonia Police Department at 704-866-6702."

Four words a top detective said before 'last-ditch' Madeleine McCann search

Rainer Grimm, boss of the BKA, Germany 's equivalent of the FBI, is in Portugal overseeing the search which ended yesterday. Before the searches began he expressed a lack of confidence in the operation to his friend The head of the German force leading the fresh searches for Madeleine McCann confided in a friend before this week's search and shared a candid four word statement. This week German and Portuguese police descended on several properties in an area of southern Portugal close to Praia da Luz - where Madeleine went missing in 2007. The last time authorities conducted a search related to Madeleine's disappearance around this area was in 2023. German cops spent a week looking through the Barragem do Arade reservoir, around 30 miles from where Madeleine was last seen, after they got a tip-off. ‌ After three days searching the area this week detectives were pictured packing up their equipment, which included a digger and ground-penetrating radars, after three days searching the area in the estimated £300,000 operation. ‌ Investigators were pictured at several homes linked to prime suspect and convicted paedophile Christian Brueckner - who used to live in the area during the time the toddler vanished, while on holiday. A group of German and Portuguese officers stood around for a debrief as the search officially stopped - which ended in a round of applause and the teams shaking hands. The officers involved also hugged each other after the three day operation. Search teams discovered animal bones and pieces of adult clothing at these sites, according to Portuguese TV reports. Police however have not shared an official statement on what could have been discovered. The operation kicked off on Tuesday, June 3, with teams scouring through more than 20 plots of land east of Praia da Luz. This included places between the Ocean Club holiday resort where Madeleine vanished and the cottage where German authorities' prime suspect Christian Breuckner lived. Rainer Grimm, boss of the BKA, Germany 's equivalent of the FBI, is in Portugal overseeing the search which ended yesterday. His apparent lack of confidence in the operation to his pal echoed what many have seen as the 'last throw of the dice' for investigators. A friend of Mr Grimm wished him luck he responded: "Thanks, we need it," reports MailOnline. ‌ Convicted paedophile Brueckner, who is currently serving a seven-year prison sentence in Germany for the 2005 rape of an elderly woman at her Praia da Luz home, has denied any involvement in the disappearance of Madeleine. He is due to release in September and has previously made it clear that he plans to flee Germany when he is out of prison. Authorities fear that he could disappear when he walks free if they can't tie him to the toddler's disappearance before then. Parents are charged after their son, 7, is struck dead in a car accident

The grieving parents of a 7-year-old child who died hours after being hit by a car were charged with involuntary manslaughter after allowing him and his brother, 10, to walk home unaccompanied by an adult from a nearby grocery store. Jessica Ivey and Samuele Jenkins were charged two days after their son Legend died from injuries caused by being struck by a Jeep on May 27 in Gastonia, a rural town in North Carolina. The 76-year-old driver will not face any charges. The Food Lion store is two blocks away from their home. The parents said the children were with their mother when they asked to meet their father at the store, and she allowed them to leave, according to the Gaston Gazette. The brothers had to cross the busy, four-lane road, but attempted to go between crosswalks. Witnesses told WSOC-TV Gastonia that Legend stepped into traffic as his older brother attempted to hold him back. Jenkins said he was on the phone with his elder son when the younger child was hit. 'I heard my oldest son yell, 'Legend, no!' so I hung up and ran. I just ran to find them,' he told the local television station. Two days later, Gastonia police arrested the parents, who are being held on $1.5 million bond. 'In such cases, adults must be held accountable for their responsibilities to ensure a safe environment for their children,' police said in a statement. Gastonia police declined to comment to NBC News, but said in a statement that 'there is no evidence of speeding or wrongdoing on the part of the driver, therefore no charges have been filed. The driver continues to be cooperative and the incident remains under active investigation by the Gastonia Police Department's Traffic Division.' The parents' public defenders did not respond to a request for comment on Wednesday. Ivey, the mother, said before her arrest to WSOC that it was the first time she let the children walk alone. 'It was just devastating, I'm still in shock, I'm in shock,' she said. 'It's hard, I haven't stopped crying; my husband hasn't stopped crying. Honestly, I want justice for my baby.' Summer Williams was in her car and witnessed the event. She told WSOC that Legend, apparently unaware of oncoming traffic, jumped into the street to the surprise of his brother, who tried to stop him. Williams said she comforted the child until paramedics arrived. 'Even at night, I still see his face,' she said. 'Just letting him know that somebody was there and he wasn't alone. 'Stay with us, sweetheart. You're going to be all right. Stay with us,'' Williams said she told the child.
