Karnataka High Court rejects bail pleas of Ranya Rao, Tarun Konduru Raju in gold smuggling case

The Karnataka High Court Saturday rejected the bail petitions of Kannada actor Ranya Rao and Telugu actor Virat Konduru alias Tarun Konduru Raju in a gold smuggling case. A bench of Justice S Vishwajith Shetty passed the order. The full order is awaited.
Ranya Rao is accused of smuggling 14.2 kg of gold worth Rs 12.56 crore from Dubai. She was arrested on March 3 at the Bengaluru airport while allegedly attempting to evade customs duty to the tune of Rs 4.83 crore by strapping the gold on her body using bandages.
She moved the high court for bail after a sessions court denied the same, citing the alleged use of the hawala route to transfer funds to purchase the gold. A special court for economic offences had also rejected a bail application by the alleged hawala agent, Sahil Jain.
Previously, Ranya Rao's counsel had argued that there were procedural irregularities in the search carried out against her. It was argued that as per Section 102 of the Customs Act, the subject of the search had to be taken before a gazetted officer or magistrate, whereas in this case, the gazetted officer was also the investigating officer of the case. The counsel also stated that her relatives should have been informed of the arrest in writing and not just telephonically.
He also pointed out that Ranya Rao was a woman accused who had been imprisoned for 45 days, whereas bail was usually granted for offences under the Customs Act which attracted under seven years imprisonment.
On the other side, the Directorate of Revenue Intelligence (DRI) stated that apart from the seized amount of 14.2 kg, 100 kg of gold had been smuggled from Dubai by the accused, with there being evidence of smuggling by the actors in 11 out of 31 trips. The DRI also alleged that the two accused used Konduru's US passport to pass large quantities of gold through Dubai Customs checks, claiming that the gold was being taken to Geneva, Bangkok, and the US.
Meanwhile, a special court for economic offences has allowed the DRI to interrogate Ranya Rao for two days in prison.
The Centre has issued orders to detain the accused under the Conservation of Foreign Exchange and Prevention of Smuggling Activities (Cofeposa) Act, 1974. This would allow detention for up to a year even if bail is granted, as previously reported by the Indian Express.

The Supreme Court said Tuesday that those driving on highways should give warning signals to vehicles behind them if they intend to stop midway, while holding a car driver, who had not done so, guilty of contributory negligence, which led to a motorcyclist losing his left leg in a road accident in Tamil Nadu in 2017. A bench of Justices Sudhanshu Dhulia and Aravind Kumar made the remarks while enhancing the compensation payable to S Mohammed Hakkim, who was a third-year Engineering student in Coimbatore at the time of the accident. The accident happened on January 7, 2017, when Hakkim was riding on a motorcycle with his friend on the pillion. A car that was ahead of them suddenly applied the brakes, and Hakkim's motorcycle crashed into the car and fell towards the right side of the road. A bus drove over him, and his left leg had to be amputated during treatment. The top court held that Hakkim had a role in the accident by not maintaining the necessary distance, but held that the 'root cause of the accident is the sudden brakes applied by the car driver.' 'The car insurer has taken the stand that the appellant had hit the moving car from behind and thus, the car driver is not liable. On the other hand, the car driver admitted in his evidence that he had suddenly applied the brakes as his wife was pregnant and she had a vomiting sensation. In our view, the concurrent finding that the appellant was definitely negligent in not maintaining a sufficient distance from the vehicle moving ahead and driving the motorcycle without a valid license is correct,' the SC said in its judgment. 'But at the same time, it cannot be ignored that the root cause of the accident is the sudden brakes applied by the car driver. The explanation given by the car driver for suddenly stopping his car in the middle of a highway is not a reasonable explanation from any angle. On a highway, high speed of vehicles is expected, and if a driver intends to stop his vehicle, he has a responsibility to give a warning or signal to other vehicles moving behind on the road. In the present case, there is nothing on record to suggest that the car driver had taken any such precaution,' the court said. Liability for negligence The Motor Accident Claims Tribunal (MACT) fixed the compensation at Rs 91.62 lakh, but reduced it to Rs 73.29 lakh after attributing 20 per cent contributory negligence to Hakkim. MACT ordered the insurer of the bus to pay the amount, while exonerating the car insurer of all liabilities. On appeal, the Madras High Court held that since the accident occurred due to the car driver suddenly applying the brakes, he should also be made liable. The high court fixed the liability of the car driver, the bus driver, and Hakkim as 40 per cent, 30 per cent, and 30 per cent, respectively. The court also reduced the compensation payable to the motorcyclist from Rs 73.29 lakh to Rs 58.53 lakh along with interest. The Supreme Court enhanced the compensation, and directed that Hakkim be paid Rs. 91.39 lakh along with interest at the rate of 7.5 per cent per annum from the date of filing of the claim petition. 'Since both the offending vehicles (car as well as the bus) were insured at the time of the accident, the liability for the negligence of the car driver and bus driver shall be borne by them, ie, respondent no. 3 (car insurer) to the extent of 50% and respondent no.1 (bus insurer) to the extent of 30%, respectively.' The court directed that the amount be paid to him within four weeks of the order.

New Delhi: A Delhi court on Thursday deferred till August 2 the pronouncement of its decision on issuing a notice to businessman Robert Vadra, son-in-law of former Congress President Sonia Gandhi, in connection with a money laundering case linked to a land deal in Haryana's Shikohpur. The Enforcement Directorate (ED) had filed a prosecution complaint under the Prevention of Money Laundering Act (PMLA), claiming that Vadra's Skylight Hospitality 'fraudulently' purchased 3.53 acres of land situated in the village of Shikohpur in Haryana's Gurugram district through 'false declaration'. The Rouse Avenue Courts, which was slated to deliver the verdict on Thursday, deferred the pronouncement till August 2. Last week, the trial court had reserved its order regarding the issuance of a notice to Vadra, the husband of Congress MP Priyanka Gandhi Vadra. During the hearing, advocate Zoheb Hossain, appearing for the ED, stated that the sale deed falsely declared a payment of Rs 7.5 crore, whereas in reality, no such payment was made. This amount was paid at a later stage to evade stamp duty, a fact that has been confirmed by key witnesses, added Hossain. Further, the federal anti-money laundering agency claimed that Vadra, 'through his personal influence', obtained a commercial license on the land purchased. As per the ED, the land was later sold to DLF at a higher price, and this aspect of the case is still under investigation. In April this year, Vadra was questioned in multiple rounds by the ED, during which his statement was also recorded. The land purchase deal in question was executed in February 2008 when Congress was at the helm in Haryana, and Bhupinder Singh Hooda was the Chief Minister. The mutation process, which usually takes months, was done the next day. Months later, Vadra received a permit to develop a housing society on the land, and the value of the plot increased. He sold it to DLF in June at Rs 58 crore. Suspecting the proceeds to be part of a money laundering scheme, the ED has been probing the trail behind the windfall gains. In October 2012, IAS officer Ashok Khemka (now retired), who was then posted as the Director General of Land Consolidation and Land Records-cum-Inspector-General of Registration of Haryana, cancelled the land purchase deal, citing procedural irregularities. Later in 2013, an in-house government panel gave a clean chit to both Vadra as well as DLF. When the BJP-led government came to power, an FIR was registered by the Haryana Police against former Chief Minister Hooda, Vadra, and others.
