3 women charged with 106 graft counts over driving test bribe scheme

JOHOR BARU: Two former clerks and a driving licence candidate agent were charged at the Sessions Court here today with a total of 106 counts of accepting and abetting bribes related to the approval of computerised driving tests.
Nuratika Natasha Mohd Salleh, 25, and Nurieta Ahmad Pale, 36, pleaded not guilty to a combined 53 charges of accepting bribes between August and October last year, while their former employer, agency owner Siti Norafidah Othman, 45, denied the 53 charges of abetting the offences.
According to the charge sheet, Nuratika allegedly received RM48,741 through 29 online transactions from a 26-year-old woman as payment to ensure passing results for candidates in the first part of the computerised driving licence test. These transactions were reportedly conducted at a bank in Jalan Niaga 1, Kota Tinggi.
Meanwhile, Nurieta was charged with receiving RM21,172 through 24 online transfers from Nuratika as a reward for providing similar favours. Her transactions took place at a bank in Bandar Penawar, also in Kota Tinggi.
Siti Norafidah, who managed the agency supplying driving test candidates, was accused of abetting both former clerks in receiving the bribes totalling RM69,913. The payments were allegedly made via accounts at banks in Bandar Penawar and Felda Air Tawar.
All charges fall under Section 16(a)(A) and Section 28(1)(c) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, punishable under Section 24(1) of the same Act. Convictions carry a maximum sentence of 20 years in prison and a fine of not less than five times the amount of the bribe, or RM10,000, whichever is higher.
MACC deputy public prosecutor Fazal Lisam Abidin prosecuted, while Nuratika and Nurieta were represented by lawyers Syufri A. Samad and Naufal Amran, and Siti Norafidah was represented by Abdul Rahim Ali.
Judge Datuk Ahmad Kamal Arifin Ismail granted bail of RM7,000 each to Nuratika and Nurieta, and RM10,000 to Siti Norafidah, with conditions including monthly reporting to the Johor MACC office and surrendering their passports.
The court has set June 26 for document submission and further mention.

Former Malaysian Anti-Corruption Commission (MACC) Chief Commissioner Tan Sri Dzulkifli Ahmad has questioned the legality of the second seizure of Ilham Tower, suggesting the move may exceed the bounds of Malaysian law. Now a practising lawyer, Dzulkifli pointed out that the asset had already been seized under Section 38(1) of the MACC Act on Dec 18, 2023. He said action under Section 38 requires the Deputy Public Prosecutor (DPP) to be satisfied that the asset in question - Ilham Tower - either constitutes the proceeds of, or is evidence related to, a corruption offence. "If no charges are brought or civil forfeiture proceedings initiated before June 17, 2025 - the end of the statutory 18-month period - it raises a fundamental question as to whether the original seizure was justified," he said in a statement today. Dzulkifli, the MACC's third chief commissioner, added that although the MACC Act and the Anti-Money Laundering Act (AMLA) operate under different legal frameworks, two overlapping seizure orders on the same property may be seen as an overreach of authority. "This is because legal powers must be exercised based on necessity, fairness, and proportionality," he said. It was reported yesterday that Ilham Tower, located on Jalan Binjai, had once again been seized by MACC. The commission said it had obtained approval from the DPP to seize the building, which is linked to the late former finance minister Tun Daim Zainuddin. According to the agency, the latest seizure was carried out via an Immovable Property Seizure Notice dated June 4, 2025, under Section 51(1) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLATFPUAA). Dzulkifli said enforcement actions must be grounded in clear legal thresholds, not procedural convenience. "If AMLA is invoked merely to maintain control of the asset as the earlier MACC order nears expiry, it may undermine the rule of law and call into question the legitimacy of the original seizure," he said. He also noted that the absence of further action by June 18 would suggest that Ilham Tower was never genuinely linked to a corruption offence under the MACC Act. "This raises a critical question: why is there now a need for a new seizure order under Section 51 of AMLA? What new evidence, if any, justifies this action?" he asked. He added that the Ilham Tower case presents a significant test of how far enforcement and prosecutorial powers may be exercised within the law. "With the June 17 deadline approaching, all eyes are on the DPP's next move. Will there be a charge? Forfeiture? Or will the order lapse - signalling that the asset was wrongly targeted from the outset?" he said.

Judge Musli Ab Hamid convicted Tony Kuswadi Martin, 42, on his own guilty plea to a charge under Section 15(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 39C(1)(b) of the same Act. The Section provides for imprisonment of not less than five years and not more than seven years, and whipping of up to three strokes, upon conviction. Tony was also ordered to undergo two years of police supervision upon his release from prison. He was tested positive for the two drugs at the Kuching Narcotics Criminal Investigation Division office at around 2pm on June 2, 2025. It was informed that the accused has two prior convictions, in 2017 and 2022, for the same offence. SIBU (June 6): A police operation along Jalan Hua Kiew here on Thursday led to the arrest of a local man for suspected drug trafficking. Sibu police chief ACP Zulkipli Suhaili said the 29-year-old suspect was detained around 1.30pm after he was found in possession of 46 plastic packets containing a substance believed to be methamphetamine. 'The drugs had a gross weight of 60.3 grammes and estimated to be worth RM12,060. 'Also seized from the suspect was a sedan car estimated to be worth RM30,000,' he said in a statement today. Zulkipli said the suspect, who tested positive for methamphetamine and amphetamine, did not have any prior criminal record. The case, he added, is being investigated under Section 39B of the Dangerous Drugs Act 1952, which provides for the death sentence or life imprisonment, and not less than 15 strokes of the cane if not sentenced to death.
