Parents protest in city, say private schools denying RTE admissions

Jaipur: Parents of students selected for admission to private schools under Right to Education (RTE) protested at the education department's office, Shiksha Sankul, Monday alleging that the children were being denied admission by the private schools.

Parents said that if the admission process was not completed by Aug 31, the students would lose a year. Many parents also said they had removed their children from schools they were earlier enrolled at after they were selected under RTE.
"We applied for the admission as per the state govt's guidelines, and now when my child has been selected, the school is denying admission, stating that they will not give admission in nursery.
Why was the school allowed to be part of the RTE process if they are not following the govt's norms? Who is responsible for checking this? We are suffering for no fault of ours," said a parent, requesting anonymity.
Sanyukt Abhibhavak Sangh, a representative body of aggrieved parents in the state, said private schools were not following the state govt's directives, and despite complaints, action was not being taken.
According to data shared by the association, nearly 30,000 children selected under RTE have not been admitted, despite being chosen through a transparent lottery system. This year alone, 3.8 lakh applications were received for just 80,000 seats under the RTE quota.
"The state govt itself issued a lottery on April 9 for students selected under RTE, and on July 17, the education directorate also issued an order stating that all selected students must be given admissions.

And yet, schools are denying admission. What is the fault of students or parents? The department cannot even get its own orders implemented," said Abhishek Jain Bittu, spokesperson of the association.
Officials of education department said a committee was formed in the last week of July to examine all complaints regarding RTE admissions. "We are working on every complaint that we receive, and mediations are being done with private schools so that the admission process can be completed at the earliest," said an official.

The Punjab and Haryana high court (HC) has sought a comprehensive affidavit from the Punjab government on a contempt petition moved by a trust alleging violation of the HC's directions of February 2025, whereby the court had ordered implementation of Right to Education (RTE) provisions by private schools in the state. Taking note of the submissions, the high court has posted the matter for September 1, directing the government to file a comprehensive affidavit as regards to February 19 order and also about the directions issued by high court on April 9. The contempt petition was moved by the KS Raju Legal Trust, on whose public interest litigation the February order was passed. In the fresh plea, the petitioner mentioned that on February 19, the HC ordered all private unaided schools to reserve 25% of class 1 seats for students from the economically weaker section and directed the state to ensure compliance from the 2025–26 session. It was also told that on April 9 the court had asserted that that RTE Act-2009 be followed to the hilt while making admissions in class 1 and in case, there is any conflict between the provincial rules of 2011 and the Central Act of 2009, then the provisions of the Central Act would prevail. However, the orders have not been complied with by the state in letter and spirit, the plea stated. Taking note of the submissions, the high court has posted the matter for September 1, directing the government to file a comprehensive affidavit as regards to February 19 order and also about the directions issued by high court on April 9. Notably, in July, the high court also issued notice to Punjab on a plea from the same petitioner demanding a probe by the Central Bureau of Investigation (CBI) into alleged lapses in the implementation of Right to Education (RTE) provisions by private schools.

T'puram: The directorate of general education (DGE) on Tuesday issued a fresh circular warning govt and aided school as well as college teachers against offering private tuition classes. The circular directs all educational officers to take strict disciplinary action against violaters. The move comes in the wake of repeated complaints and findings that certain govt employees and aided teachers are offering coaching at PSC training centres, private tuition centres and parallel institutions, in direct violation of established regulations. The directive reinforces earlier govt orders, including those issued on July 6, 2010, March 12, 2020, and Nov 19, 2020, that prohibit govt-employed teachers from conducting paid tuition outside of their official teaching responsibilities. It also refers to the Right to Education Act, 2009 (Section 28, Chapter IV), which forbids teachers from providing private tuition to students. The DGE notes that engaging in such paid activities, whether directly, indirectly or under another name, constitutes a serious breach of professional conduct. He said no action that disrupts students' education would be permitted and strict measures would be taken in such instances. According to the Kerala Education Rules (KER), school managements or any individuals have no authority to close down schools. As per Chapter III, Rule 4(1) of the KER, schools must function with the approval of the govt. Any decision to shut down schools under any pretext will be considered a violation of students' right to education. Under the Right to Education (RTE) Act, 2009, it is the govt's responsibility to ensure free and compulsory education for children aged 6 to 14. Chapter II, Section 3 of the Act guarantees this right. If students' education is disrupted due to management disputes, it will be deemed a violation of this legislation. The minister added that the govt has the authority to take over and operate such schools during these circumstances. Kerala's state-run schools will soon reward students with 'grace marks" for developing reading habits, starting from the next academic year, State General Education Minister V Sivankutty announced on Wednesday. In a Facebook post, the minister said a dedicated period would be allocated for reading books, newspapers, and related activities as part of the initiative. 'Grace marks will be awarded from the next academic year to children who engage in activities that promote reading habits," Sivankutty said. The programme will cater to students across all school levels. For those in grades one to four, weekly sessions will focus on age-appropriate reading activities. Students in grades five to twelve will participate in similar sessions, with a focus on newspaper reading and follow-up exercises, he explained. To ensure effective implementation, teachers will be given training, and a handbook will be prepared to guide the reading-related activities. Sivankutty added that the Education Department is also considering the inclusion of a reading-focused segment in 'Kalolsavam," the state's annual school arts festival, to further encourage literacy and reading engagement among students. Sivankutty on Tuesday strongly rejected the Centre's assertion that more than 200 government schools in the state have been shut down. Calling the claim 'baseless" and a deliberate attempt to tarnish Kerala's image, the minister stressed that no government school has been closed in the state over the past nine years. In a Facebook post, Sivankutty clarified that the figures cited by the Centre actually refer to Multi Grade Learning Centres (MGLCs), which were launched in 1992 under the District Primary Education Programme (DPEP). These centres, he explained, could not function as schools after the implementation of the Right to Education (RTE) Act, prompting their phased closure.
