Anti-bullying Act proposal to be presented to Cabinet soon, says Azalina
She said discussions at the policy level are crucial, as each relevant ministry, such as the Women, Family and Community Development Ministry (KPWKM), Education Ministry (MoE), Higher Education Ministry (MoHE), and National Unity Ministry may have their views regarding the enforcement aspects of the law.
"After each ministry submits its feedback, the Legal Affairs Division (BHEUU) will conduct a detailed study and engagement sessions before the matter is brought to the policy level and subsequently to Parliament,' she said.
She was speaking at the Asean Law Forum 2025 themed 'Empowering Access to Justice in the Asean Economic Community: Bridging Legal Cooperation for Inclusive Growth in the Digital Era' at the Kuala Lumpur Convention Centre on Wednesday (Aug 20).
Azalina said the main issue currently is the absence of a specific definition of bullying or penalties for such offences under existing legal provisions.
She said bullying-related cases are currently dealt with under various laws including the Online Safety Act, the Anti-Sexual Harassment Act, labour laws as well as several provisions under the Penal Code.
As such, BHEUU will soon issue a list of Frequently Asked Questions (FAQs) to clarify the differences between the Penal Code and the Child Act, to avoid confusion among the public.
"Many misunderstand… children can still be charged under criminal law. However, the procedure is different. For example, they cannot be tried in an open court.
"I want to give assurance that wrong is still wrong. The law applies to everyone, whether children or adults,' she said.
Azalina also said that MoE has outlined comprehensive procedures in addressing bullying cases in schools through a detailed guideline document.
"I've seen the book, it's quite thick and it provides detailed, step-by-step instructions on what to do and how to resolve cases,' she said.
Prime Minister Datuk Seri Anwar Ibrahim, at the Finance Ministry's Monthly Assembly in Putrajaya earlier today, said the proposal to establish a tribunal on bullying cases involving students and children will also be brought to the Cabinet meeting.
The three-day Asean Law Forum 2025 gathered 58 speakers and moderators in 15 sessions, with over 300 participants from Asean and international bodies discussing various topics, including alternative dispute resolution, commercial law reform and human rights in the digital era.
Among those present were Deputy Prime Minister Datuk Seri Fadillah Yusof, Deputy Minister in the Prime Minister's Department (Law and Institutional Reform) M. Kulasegaran, Secretary of the United Nations Commission on International Trade Law (Uncitral) Anna Joubin-Bret, Timor-Leste's Justice Minister Sérgio de Jesus Fernandes da Costa Hornai and Laos' Deputy Justice Minister Ketsana Phommachanh. - Bernama

Govt to draft new act for early childhood education in 13MP
KUALA LUMPUR: The Education Ministry will draft a new Act on early childhood education to ensure comprehensive and effective regulatory oversight, said Education Minister Fadhlina Sidek. Speaking in the Dewan Rakyat, she said that as part of efforts to enhance educational outcomes, the government, under the 13th Malaysia Plan, will introduce a comprehensive transformation that addresses every level of learning. "In the context of early childhood education, a new Act will be drafted to ensure comprehensive and effective regulatory oversight," he said in her winding-up speech on the 13th Malaysia Plan. When tabling the 13th Malaysia Plan, Prime Minister Datuk Seri Anwar Ibrahim said the government will make preschool education compulsory from the age of five to enhance educational outcomes. Fadhlina added that she echoed Datuk Seri Saifuddin Abdullah (PN-Indera Mahkota)'s suggestion for preschool curriculum to be developed based on the developmental needs of children. She said the ministry would introduce the Preschool Curriculum 2026, which will be anchored in the School Curriculum Framework 2027. "This curriculum emphasises character building, self-confidence, values of compassion, and resilience through experiential approaches that are age-appropriate. "Accordingly, the national preschool curriculum will be made mandatory for all early childhood education institutions, with emphasis on human dignity (karamah insaniah), character development, critical thinking, and life skills. "To ensure its successful implementation, mastery of this curriculum will be prioritised," she added. She added that the ministry has also expanded access to preschool and leveraged on all available spaces, including in secondary schools, Teachers' Education Institute (IPG), vocational colleges, among others. "The priority is to ensure that parents and the community are encouraged and made aware of the importance of preschool education. "We also see that the new 2026 preschool curriculum is very important," she said. She added that under the 13th Malaysia Plan, the government will establish a National Education Council (NEC) tasked with coordinating, monitoring, and recommending strategic interventions. She said the ministry, along with the Higher Education Ministry, is working closely to prepare a Joint Cabinet Memorandum, which is expected to be tabled in mid-September 2025. In terms of membership, she said, the NEC will comprise representatives from various ministries, government agencies, academia, industry, NGOs, and GLCs to ensure that decisions made are inclusive. "The establishment of the NEC will serve to coordinate and monitor the implementation of policies, as well as to identify appropriate intervention measures to ensure that the education system remains relevant and effective," she said.

New Early Childhood Education Act On The Way
KUALA LUMPUR, Aug 20 (Bernama) -- A new act on early childhood education will be introduced to ensure comprehensive and effective regulation, said Education Minister Fadhlina Sidek. She said it is among the education reform strategies outlined under the 13th Malaysia Plan (13MP) aimed at strengthening governance in the country's education system. 'Governance at all levels of learning from preschool, primary, secondary and up to pre-university will be strengthened to enhance the effectiveness of service delivery more comprehensively,' she said during her winding-up speech on the 13MP for the Ministry of Education (MOE) in the Dewan Rakyat today. She added that MOE will also introduce the 2026 Preschool Curriculum, based on the 2027 School Curriculum Framework, emphasising character building, self-confidence, love, and resilience through age-appropriate experiential learning. 'In line with this, the national preschool curriculum will be made mandatory for all early childhood education institutions, with emphasis on human dignity values, character formation, critical thinking and life skills,' she said. 'To achieve this, enforcement of the Education Act 1996 will be strengthened,' she said. Meanwhile, Fadhlina said MOE remains committed to maintaining the Sijil Tinggi Persekolahan Malaysia (STPM) as an internationally recognised pre-university qualification. 'With about 50,000 to 55,000 enrolments annually, various measures are being and will continue to be implemented to attract SPM graduates, particularly through the Form Six Education Roadmap 2024-2030,' she said. The roadmap focuses on five key areas - image branding, infrastructure enhancement, administrative improvements, more flexible teaching and learning, and a curriculum benchmarked against international standards such as A-Levels.
