Karnataka HC to examine government's SOP after Bengaluru stampede

The Karnataka high court has said it wants to examine the government's standard operating procedures (SOPs) for crowd control during large public events, in wake of the June 4 stampede outside the M Chinnaswamy Stadium during the celebrations of Royal Challengers Bengaluru's (RCB) IPL victory. A bench of chief justice Vibhu Bakhru and justice CM Joshi asked advocate general Shashikiran Shetty whether such SOPs were in place and cited the stampede last week at the Mansadevi temple in Haridwar to underscore the importance of protocol in handling mass gatherings.
Shetty, informing the bench that the state did have an existing SOP in place and that it had been updated and released by the government on July 1, sought time to place the same on record. The court accepted the request.
The new SOPs, framed and made public by the government after the June 4 tragedy, emphasise 'early planning, inter-departmental coordination, behavioural risk assessment, and prioritisation of life safety, and de-escalation' during crowded events, among other things.
The state also informed the bench that was hearing a suo motu public interest litigation (PIL) initiated in the aftermath of the stampede, that the judicial commission's inquiry into the June 4 stampede was complete and that the report has been tabled before the cabinet, but was yet to be discussed.
Event management company DNA Entertainment Networks, which is a respondent party to the suo motu PIL, pointed out that while the cabinet is yet to take a call on the report and the parties to the matter were yet to receive a copy, sections of the media appear to have accessed the document. 'We are a party to the matter and still haven't received a copy. How is it that the media has all details?' senior advocate Sampath Kumar asked.
Kumar added that news reports were hampering DNA's image and urged the court to direct the state to give his client a copy of the full report. He made the same submissions before another bench of the high court that was presiding over related proceedings. He urged the bench of justices Jayant Banerji and Umesh Adiga — hearing the petition filed by DNA Entertainment challenging the judicial commission's inquiry and report — to direct the state to give a copy of such report to all parties.
The bench said it will consider DNA's arguments but directed the government to submit a copy of the report meanwhile, for 'its eyes only', to aid its adjudication. The advocate general agreed and said he will give the court a copy of the report by August 5, the next date of hearing on DNA's plea. The stampede on June 4 claimed 11 lives and injured several others.
Meanwhile, home minister G Parameshwara said that the former Bengaluru police commissioner B Dayananda, whose suspension was revoked by the government along with three other police officers, will not be reinstated in the same position, and will be instead given a post equivalent to his ranking.

Interestingly, Dayal had earlier created a commotion by claiming to have posted communal content on his Instagram handle two years back. He later clarified that while two contentious reports were posted from his account, but he did not post them from his account.

1 2 Jaipur: The Rajasthan High Court Wednesday declined to grant interim relief to 27-year-old cricketer Yash Dayal, who is facing allegations of raping a minor. The court refused to stay his arrest or halt police proceedings in the case. Justice Sudesh Bansal, while hearing Dayal's plea, observed that since the survivor was a minor when the alleged incident first took place, no protection from arrest could be considered at this stage. The court has called for the case diary from city police and listed the matter for further hearing on Aug 22. Yash Dayal, a fast bowler from Uttar Pradesh and a member of Royal Challengers Bangalore, the current IPL champion team, was accused of sexually assaulting the girl when she was 17. According to the survivor's lawyer, the incident occurred about two years ago, when she was a minor. It was also alleged that Dayal called the girl to a hotel in Sitapura during IPL-2025 and raped her again. Sanganer Sadar police registered the case on July 23. As per the petition, the survivor introduced herself as a cricketer and came in contact with Dayal in connection with her sporting career. Mumbai: BMC's deputy municipal commissioner (DMC) Sharad Ughade has been divested of his charge in the Information Technology (IT) department. Additional municipal commissioner Ashwini Joshi had pointed out that Ughade did not take any concrete action on the findings and recommendations made by the vigilance department regarding serious financial irregularities in the Rs 25-crore computer procurement tender process in 2022. The vigilance department had conducted the inquiry after former corporator Vinod Mishra alleged that a particular vendor was getting almost 80% of all tenders floated by BMC for IT hardware over the past decade, and a couple of vendors were monopolising the tenders. Following the probe, the department recorded adverse findings regarding the procurement process and recommended measures to be carried out by the IT department. The vigilance department also found an element of truth regarding drafting tender conditions by the IT department/consultant to favour certain bidders. He said: "The report highlighted serious irregularities in the computer procurement process. Despite the report, Amit Gadekar and Chandrakant Kathe, who were holding various positions in the IT department, continued to function there. Later, Gadekar was transferred to D-ward. Engineers from civil and mechanical and electrical engineering background were inexplicably appointed to the IT department and some of them were made IT managers. A thorough probe is warranted into all tenders awarded during the period, when Ughade held charge of the department, preferably by an IAS officer, to ensure impartiality." Following Daundkar's complaint, Joshi pointed out to the BMC chief that the financial irregularities and the recommendations mentioned in the vigilance report were when Ughade was IT department director. Further, as he did not take any concrete action regarding the irregularities in procurement and award of contracts, the post be given to another DMC, Joshi recommended. She added that the post of DMC IT department did not exist according to records, and the charge was taken away from the DMC general administration. She recommended that the IT department director charge be brought directly under the additional commissioner of eastern suburbs.
