Man charged with murder after 12 years on the run

PETALING JAYA : A car accessories worker who had been on the run from the police for the past 12 years after allegedly killing a nightclub bouncer was charged with murder today.
Ooi Chin Leng, 38, nodded when the charge was read to him in Mandarin before magistrate Aini Adilah Faizal at the Butterworth magistrates' court, reported Berita Harian.
No plea was recorded as murder cases fall under the jurisdiction of the High Court.
According to the charge, Ooi, along with an accomplice who is still at large, allegedly murdered Fouzi Hussen, 24, at Taman Desa Murni, Sungai Dua, at 5.25am on Jan 24, 2013.
The charge, framed under Section 302 of the Penal Code, provides for the death penalty or imprisonment of between 30 and 40 years. If not sentenced to death, Ooi may also be subject to not less than 12 strokes of the cane.
Deputy public prosecutor Nurameera Shahrul Azrin prosecuted while Ooi was unrepresented.
Nurameera did not offer bail and asked the court to set a date for Ooi's DNA test report as the case was from 2013 and he had just been arrested.
Aini Adilah denied bail and set July 23 for the next mention of the case, including Ooi's DNA profiling.

'Initial investigations revealed that Hafiz had lost control of his Volkswagen Jetta before crashing into the oncoming trailer,' said Lipis police chief Superintendent Ismail Man. 'The impact of the crash caused the trailer to graze two other vehicles. Hafiz died at the scene and his remains were taken to Lipis Hospital,' he said in a statement today. Police said the trailer, driven by a 41-year-old man, was travelling from Kelantan to Selangor. The three cars were heading in the opposite direction from Kuala Lumpur to Kelantan. None of the other drivers were injured in the crash. Police are investigating the case under reckless or dangerous driving provisions. Ismail urged witnesses or anyone with information about the crash to come forward to assist in the investigation. Several hours earlier, five people — including four siblings — were killed in a separate accident at Km7 of Jalan Jerantut-Maran in Jerantut.

IWK said its operations team was deployed immediately after the incident to assess the situation and implement safety measures. The affected area has been barricaded. In a statement today, IWK said the investigation revealed signs of illegal chemical discharge from a nearby factory, based on the presence of the unusual gas in the sewer network. It said it has notified the environment department and the National Water Services Commission (SPAN), and requested their assistance in identifying the source of the chemical spill. Although the sewer line remains operational with no blockages or structural damage, the blast displaced a manhole cover and damaged a road culvert. The manhole has since been temporarily secured. A CCTV inspection of the sewer system will be conducted once clearance is given by the relevant authorities, it said. Penang fire and rescue department assistant director John Sagun Francis confirmed that no injuries were reported. The single explosion occurred at about 11.30am along Lengkok Perindustrian Bukit Minyak 2, causing damage to the road. IPOH: Attorney General Tan Sri Mohd Dusuki Mokhtar should disclose further details on the decision by the Attorney General's Chambers (AGC) to classify the case of Teoh Beng Hock's 2009 death as No Further Action (NFA), says Ramkarpal Singh. In a statement Saturday (June 7), the legal representative for the late Teoh's family said the reason given by the AG that there was insufficient evidence to commence criminal proceedings was disappointing. Ramkarpal said his firm had on June 3 received a letter dated May 30 from the AGC to explain the decision to classify the case as NFA. "I have perused the said letter and discussed it with Teoh's family. "We will need more time to study it before deciding on the next course of action, which may include initiating judicial review proceedings against the AG," he said. "Teoh's family is considering taking legal action and will announce their decision on this in due course," he added. "It is disappointing that the AG has come to the conclusion that there is insufficient evidence as the police have had ample time to investigate this tragedy since 2009. "His findings, particularly on the question of why he says there is insufficient evidence as a general statement, does not, in any way, overcome the family's real concerns that such investigations were not properly and professionally conducted," the Bukit Gelugor MP said. The AGC had on May 22 issued a statement that the case would be classified as NFA, after having reviewed and studied all evidence in the investigation papers submitted by the police. In the letter issued, Mohd Dusuki said the decision to classify the case as NFA was not to deny responsibility. He said there needs to be sufficient evidence to prove beyond reasonable doubt before prosecution could be started against an individual. "Having gone through all available materials, including forensics reports, witness accounts and expert findings, the conclusion is that there is insufficient evidence to support any charges under the Penal Code. "The law cannot permit charges to be pressed based on doubt," he said. "If new or believable evidence comes up in the future, whether it be from a witness, document or forensics development, I will ensure that the case will be looked at again without hesitation," he added. He said the matter has already become a lesson and was also acknowledged by the government. "The people will not forget this incident, while institutional reform has already started to prevent a similar incident from recurring," he said. "The AGC will ensure all prosecution will continue to be implemented fairly, systematically and according to the law," he added. On Nov 21 last year, the Kuala Lumpur High Court had ordered the police to complete the investigation into Teoh's death within six months. This was after a review application by the late Teoh's family against the Inspector-General of Police, the police's director of criminal investigation, the police and the Malaysian government, as the respondents, was allowed. Teoh, the political secretary to former Seri Kembangan assemblyman Ean Yong Hian Wah, was found dead after giving a statement at the Malaysian Anti-Corruption Commission (MACC) office on the 14th floor of Plaza Masalam in Shah Alam, Selangor.
