Bihar electoral roll revision process is ‘voter-friendly, not exclusionary', says Supreme Court
The court said that in comparison, during the summary revision of voter rolls in 2003, there were only seven acceptable documents.
A bench of Justices Surya Kant and Joymalya Bagchi made the observation while hearing a clutch of petitions challenging the voter roll revision in Bihar ahead of the Assembly elections, expected in October or November.
The petitioners have raised concerns about the exclusion of Aadhaar cards as standalone valid proof for the revision process.
They have termed the decision ' absurd ' since Aadhaar is the most widely held identity document.
However, the court on Wednesday verbally observed that the Election Commission appeared to have given citizens more options.
'We understand your exclusionary argument maybe with regard to Aadhaar,' The Indian Express quoted Bagchi as saying. 'The expansion of number of documents from what was followed in a summary revision to an intensive revision is, in fact, voter-friendly and not voter-exclusionary.'
However, Advocate Abhishek Manu Singhvi, appearing for the petitioners, contended that while the number of permissible documents had increased, most had low coverage in Bihar. He added that only 1%-2% of voters held passports in the state, PTI reported.
"If we see the availability of documents with the population in Bihar it can be seen the coverage is very low," he said.
On Tuesday, the court had said that including citizens and excluding non-citizens from voter rolls fell within the Election Commission's remit. It also noted that it is not the Election Commission, but the Aadhaar Act that says the unique identification number is not proof of citizenship.
However, it had objected to the practice of allowing prospective voters to only submit a self-declaration of citizenship to be included in the voter rolls.
Bihar voter roll revision
The revision of the electoral rolls in Bihar was announced by the Election Commission on June 24.
As part of the exercise, persons whose names were not on the 2003 voter list needed to submit proof of eligibility to vote.
Voters born before July 1, 1987, were required to show proof of their date and place of birth, while those born between July 1, 1987, and December 2, 2004, had to also submit documents establishing the date and place of birth of one of their parents.
Those born after December 2, 2004, needed proof of date of birth for themselves and both parents.
The draft voter list, published on August 1, comprises electors who submitted their enumeration forms to the poll panel between June 24 and July 26. They will now have to produce proof of citizenship to make it to the final list that will be published on September 30.

Sonia Gandhi is daughter-in-law of India for 59 years: Jagga Reddy
Hyderabad: Telangana PCC working president T Jagga Reddy said here on Friday that party senior leader Sonia Gandhi is daughter-in-law of India for 59 years. At a press conference, he observed: 'BJP leaders are talking about Sonia Gandhi and Rahul Gandhi; speaking as if untrue things are facts, making it a job to sling mud at the Gandhi family; BJP, with no history of sacrifice, throws accusations at Indira and Rajiv who sacrificed their lives; it's a family of sacrifice; this is a sad matter'. Reddy went on to state: 'BJP leaders who talk about 'Dharma – don't you even have this understanding? BJP, with no history of sacrifice, throws accusations at the family of Indira and Rajiv who sacrificed their lives; do any BJP leaders have the great virtues that Sonia and Rahul possess? When the entire nation elected Sonia to be Prime Minister, she made Manmohan Singh the PM and provided good governance; are BJP leaders ready for a debate on Sonia's quality of sacrifice? When Manmohan Singh asked Rahul Gandhi to become PM, Rahul told him, 'You yourself should be PM', a great act of renunciation; Delhi BJP leaders, can you make Advani the Prime Minister, the man who built your party, and show such sacrifice?' He pointed out that Rahul exposed that BJP came to power twice through fraudulent votes and now BJP leaders are attacking Sonia. 'Rahul proved that the Election Commission bends to BJP's wishes; even the Supreme Court revealed this; that's why BJP leaders, unable to digest it, are targeting Sonia,' he said. 'BJP leaders had no role in the freedom movement. If you ask Modi and Amit Shah's parents, they will acknowledge the greatness of the Gandhi family. BJP leaders who talk about 'Dharma' – don't you know how inheritance works? Do you not even have the basic understanding that a wife takes her husband's caste? What kind of people are you? Rahul's family is a Kashmiri Brahmin family,' he claimed. He alleged that 'BJP leaders are fools'. 'Even people of this country accepted Sonia Gandhi as one of this nation's women; she has upheld the traditions of this country. After Rajiv Gandhi died, Sonia lived in anonymity for seven years; she entered politics only when people wanted her to; she studied the parties and politics of the country. At the request of Congress activists, Sonia worked as the party president; even when allies requested, she refused to take the oath as PM; when asked Rahul also refused; Sonia and Rahul made Manmohan Singh the PM,' he explained. According to Reddy, 'If I don't get an MLA ticket, I will fight – people say, but in contrast, even when offered the PM's seat, Sonia and Rahul refused to take it. Would BJP leaders make such a sacrifice? Do any BJP leaders have the great qualities that Sonia and Rahul have? Do you have the capacity to sacrifice? If BJP is in power today, it is because of the sacrifices of L K Advani and A B Vajpayee. Do you have the ability to discuss the topic of sacrifice? If you truly had the spirit of sacrifice, Advani would have become PM. Then why are you talking about Sonia? You have no moral right to talk about Sonia. Are BJP people speaking with wisdom, or do they not even understand what they're saying?'

SC ordering EC to publish details of 65 lakh deleted voters during on Bihar SIR is welcome
The Supreme Court's directive to the Election Commission to be transparent on the Special Intensive Revision (SIR) of electoral rolls in Bihar is significant and welcome. The Court asked the EC to publish detailed district-wise lists of the 65 lakh voters whose names had been omitted from the draft electoral roll published on August 1. These lists must specify the precise reason for each deletion, be it death, migration, or duplication, and be both physically available at local administrative offices and searchable online. The Court mandated that news of these deletions be widely publicised in Bihar through both vernacular and English newspapers, as well as electronic and social media. Amid the confusion and apprehensions unleashed by the SIR exercise in Bihar, the Court's intervention is reassuring. The SC order recognises the complexity of the exercise, both in scale and due to its constricted timelines in the poll-bound state. At the same time, it sends a message that the EC's conduct is being watched. For Bihar's migrant workers, Dalits, small farmers, daily wagers and poor, the demand for relatively difficult to procure documents from those who do not feature in the 2003 electoral roll, is an onerous one. As this newspaper has highlighted in a series of ground reports, the shifting of the burden of proof on to the vulnerable voter in what has morphed into a citizenship test has sparked widespread fears of disenfranchisement. The EC's refusal to accept the Court's suggestion to consider Aadhaar, Voter ID and ration card as proof underlines the challenge. But the Court's insistence on full transparency on the deletions in the face of the EC's resistance is heartening. The SC has not stayed or stopped the SIR process in Bihar, recognising the EC's constitutional mandate and authority, but it has instituted a check: 'The powers (to do so) are prima facie traceable, so we do not wish to interdict… but your manner has to be reasonable, has to give certain comfort to citizens. Should not strain a person to become eligible,' it said. Article 324 of the Constitution gives the EC the powers of superintendence, direction and control of elections. However, it cannot hide behind that Article and those powers and view transparency as an inconvenience. The EC's conduct of the SIR in Bihar sets a template — the exercise will be conducted across states. Going ahead, the SC's intervention draws some much-needed red lines.
