Groundbreaking of ‘Pakistan Digital Leap' held

ISLAMABAD: The Higher Education Commission (HEC) on Friday hosted the groundbreaking 'Pakistan Digital Leap' event, marking a major milestone in the country's journey towards digitalising its higher education sector.
The event was graced by vice chancellors, members of the corporate sector, and prominent stakeholders of the higher education sector of Pakistan, who witnessed the unveiling of cutting-edge digital infrastructure leading to an all-inclusive ecosystem built with innovative technologies that will revolutionise the learning landscape for millions of students across the country.
The event showcased the remarkable strategic IT initiatives that were managed through HEDP a flagship project of HEC in collaboration with the World Bank. This project has positively impacted the lives of six million students across Pakistan, leveraging innovative technologies that are pioneering in the country. The event itself was symbolic as the chairman HEC appeared as an holographic Avatar and hosted the event taking the title of becoming the first ever Hologram Host in the history of Pakistan.
HEC's strategic IT initiatives includes Astrolabes data centers, As-Sadeem cloud computing solutions, Al-Meissa HPC, Maktab ERP-SLCS, Al-Fihri LMS, Jidar Network Security, and Smart Classroom. These initiatives will further enhance the digital infrastructure of Pakistan's higher education sector, providing students with access to world-class education and skills. The event featured a state-of-the-art digital infrastructure representation, showcasing HEC's achievements in establishing: 7000 Km of fibre connectivity, 20,000 Wi-Fi points in 96 Higher Education Institutions (HEIs) and several more IT based features in the HEIs across the country.
The event marked a significant leap in Pakistan's higher education sector, paving the way for a more digitally empowered and educated society as the pilot project of digitising 25 HEIs across the country is performing well and creating a demand to implement HEC's IT initiatives in public HEIs across the country.

LAHORE: Tax recovery from banks on behalf of taxpayers on same day after issuance of a notice is unlawful, said tax practitioners. They said the department was legally not empowered to affect immediate recovery from a taxpayer's bank or third party on the same day notice under Section 140, particularly where such notice follows the decision of the Commissioner (Appeals) Inland Revenue. It is a common practice that department amends tax returns to raise demands worth billions of rupees and issue notices on that same day under Section 140 to recover the amount from the taxpayer's bank accounts within less than 30 minutes after uploading the decision on the FBR web portal. In some cases, a similar course of action occurs even late at night on the same day. The departmental sources said Section 140 of the ITO authorizes the Commissioner Inland Revenue to effectuate recovery of outstanding tax dues. Additionally, Rule 210c(3) of the Income Tax Recovery Rules, 2002 states that the amount mentioned in the notice is to be paid on the day the notice is served. However, the tax practitioners have pointed out that Section 140(1) clearly requires the commissioner to fix a specific future date in the notice for payment. In most of cases, recovery is initiated within hours of the appellate order, denying them any meaningful opportunity to comply or challenge the demand. This conduct violates the procedural safeguards built into the Ordinance and breached constitutional rights of taxpayers. Issuing recovery notices on the same day when the appellate orders were uploaded, and attaching bank accounts within minutes or hours, violated the principle of fair notice and procedural justice, they stressed. According to these circles, the tax recovery is not a grab-and-go process. Even coercive measures must adhere to proper legal procedures. ST fraud cases: Arrest warrants only in case of fake, flying invoices: FBR

ISLAMABAD: Addressing concerns of business community, the Federal Board of Revenue (FBR) on Monday announced that the warrant of arrest from judge would only be obtained in the sales tax fraud cases of fake and flying invoices. According to a sales tax explanatory circular issued by the FBR on Monday, the FBR clarified arrest related provisions of the Sales Tax Act 1990. One of the major demands of the business community was to limit the arrest powers to the issues of fake/ flying invoices. The FBR has clarified to the business community that the warrant of arrest from judge under subsection (9) of Section 37A of the Sales Tax Act may be obtained primarily in the sales tax frauds which are heinous or material including fake and flying invoices. Under this subsection, the following pre-conditions shall also apply as is the case of arrest under subsection (8) of section 37A: (i) The accused may tamper with documents. (ii) The accused may abscond. (iii) The accused does not help investigations despite three served notices. In addition to that the board will separately notify the detailed procedure, preconditions and restrictions through an sales tax general order (STGO) for the smooth operation of subsections (8) and (9) of Section 37A of the Sales Tax Act, FBR added. The FBR has also separated criminal and civil liability to differentiate between non-compliance and fraudulent activities. Sub-section (1) of section 11E has been substituted where by non-payment of tax through collusion or deliberate act are excluded from its scope, because the provisions of law already exist in this Act under section 37A for initiation of criminal proceedings in such non-payments. Similarly, the provisions of section 11E shall not be applicable to the extent where proceedings have been initiated under section 37A. This differential between proceedings under section 11E and section 37A is important as the former deals with non-compliance where as latter deals with the fraudulent activities.
