The court said it could not 'shut its eyes to the request of such a bright kid who is seeking the help of his father to get admission to higher studies after arranging fees'
The Kerala High Court has allowed a convict, sentenced to life imprisonment for patricide, a seven-day parole to assist his child in securing admission to Class 11, highlighting the importance of a father's role in a child's education.
The order was issued on June 10 by Justice P V Kunhikrishnan. The mother of the child had approached the prison authorities to secure the parole. However, it was denied citing lack of provisions. Following this, she approached the high court.
The child had scored an outstanding six A+ and two A grades in the SSLC examination. The court directed that the mark list be produced and observed that it could not 'shut its eyes to the request of such a bright kid who is seeking the help of his father to get admission to higher studies after arranging fees and other things".
'The basic rights of the convict include the right of a father to ensure good education for his child," the court said. 'A father's presence plays a vital role in a child's higher education journey by offering emotional support, guidance and mentorship."
Justice Kunhikrishnan noted that while convicts lose certain rights during imprisonment, their children should not be deprived of parental support during crucial educational transitions.
'The basic rights of the convict include the right of a father to get good education to his child. A father's presence plays a vital role in child's higher education journey by offering emotional support, guidance and mentorship. It's true that when a convict is in jail, he will lose some of his rights. But, the child of the convict should get the presence of his father for few days for a successful education year," said the order.
On this observation, the court granted the prisoner seven days of emergency leave for a period of one week from June 12 to June 18 to assist in arranging the child's admission and related formalities.
The convict will execute a bond for Rs 1 lakh with two solvent sureties each for the like sum and he shall return back to the Central Prison and Correctional Home, Thavanur at 4pm on June 18, the court ordered.
The prisoner was awarded life imprisonment by a Palakkad court in 2023 for murdering his father in 2018 following a scuffle related to family property.

Pharma dept refuses to name 30 docs penalised for Paris, Monaco trip

NEW DELHI: Despite a Centre-appointed panel under the Department of Pharmaceuticals (DoP) reprimanding AbbVie Healthcare India Pvt Ltd for violating the uniform code for pharmaceutical marketing practice (UCPMP) by sponsoring trips to Monaco and Paris, in France, for 30 doctors worth Rs 1.91 crore, the department has refused to share the names of the 'offending' doctors against whom action was to be initiated. Revealing the names would involve disclosing personal information of individuals and it was not in public interest, the department said, defending its decision. Notably, the refusal to share the names of the doctors by the DoP under the Ministry of Chemicals and Fertilisers comes five months after activist Dr K V Babu filed an RTI over the matter. Moreover, the DoP is yet to share the names of the doctors with the National Medical Commission (NMC), which was asked by the Apex Committee for Pharma Marketing Practices to take action against the '30 offending healthcare professionals as per Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002' in its order on December 23, 2024. As per the norms, the doctor's licenses can be suspended if found guilty of violating the code of ethics. In its order, the committee also directed the Central Board of Direct Taxes to evaluate the tax liability of AbbVie Healthcare India Pvt Ltd, a subsidiary of US-based pharmaceutical company AbbVie Inc, for unethical marketing practices, along with the 30 doctors, and to take action in accordance with the provisions of the Income Tax Act, 1961.

Gaming authority questions TNPL over surrogate ads of betting apps

CHENNAI: The Tamil Nadu Online Gaming Authority (TNOGA) has sought explanation from the Tamil Nadu Premier League (TNPL) regarding advertisement of offshore betting apps at its tournament being held in Coimbatore. The TNPL is an eight-team, franchise-based cricket competition organised by the Tamil Nadu Cricket Association (TNCA) where international and popular IPL cricketers from Tamil Nadu like R Ashwin, Sai Kishore, Shahrukh Khan, and T Natarajan are participating. It is telecast on TV and live-streaming apps. A senior TNOGA official said that they had a meeting with the TNPL Chief Executive Officer (CEO) Prasanna Shankar at their office in MRC Nagar in Chennai on Wednesday (June 11). This was a few days after TNOGA sought an explanation after receiving multiple grievance emails from residents of Tamil Nadu, pointing out that TNPL teams have enlisted multiple betting apps like dafabet, 1xBet, MELBET, Cricadda, Pin-up Cricket and JSK1 as main sponsors. These apps are promoted through surrogate advertising like dafanews, MELBAT, Cricadda news, and JSK1 news, etc. TNIE had recently reported on the wide prevalence of surrogate advertising in TNPL. According to the official, the surrogate advertising of offshore betting apps by TNPL has been found to be 'prima facie objectionable'. The TNOGA official stated that even surrogate advertisement of online betting apps is not allowed as per Section 8 of the TN Prohibition of Online Gaming and Regulation of Online Games Act, which bans the direct or indirect promotion of online gambling. Section 16(2) allows for a punishment of one year prison term or Rs 5 lakh fine for those violating Section 8.

Ponmudy case: Madras HC notice to DGP, Chennai commissioner

CHENNAI: The Madras High Court on Friday issued notices to the Director General of Police/Head of Police Force of Tamil Nadu and the Greater Chennai Commissioner of Police on a suo motu writ petition taken up by the court for registering a criminal case against DMK MLA and former minister K Ponmudy for his derogatory remarks against Saivism and Vaishnavism. The order to take up a suo motu case was passed by Justice N Anand Venkatesh in April, following which it was numbered with the concurrence of the Chief Justice and came up for hearing before Justice P Velmurugan on Friday. The controversial remark was made by Ponmudy at an event organised by Thanthai Periyar Dravidar Kazhagam in Chennai on April 8 in which he recalled a 'joke' frequently used in the past on the platforms of the Dravidian movement, with references to symbols used in Saivism, Vaishnavism and sex workers. After the issue snowballed into a controversy, Ponmudy was first stripped of his party post as deputy general secretary and later his cabinet berth. Justice Anand Venkatesh had earlier asked the Tamil Nadu police to register an FIR against Ponmudy for his remarks. However, on learning that no FIR has been registered when the case came up again for hearing on April 23, he directed the court's registry to take up a suo motu writ petition in this regard.
