said any irregularity that might have caused a loss to the exchequer could be examined by the assembly, which sanctioned it, and the panel was its extension.
In a letter to the former chief minister, Gupta referred to Practice and Procedure in Parliament, a treatise that summarises the main functions of PAC, and said the committee "examines cases involving losses, nugatory expenditure and financial irregularities". He added that PAC was an extension of the assembly, which examines all such issues.
Atishi wrote to the speaker earlier this month, stating that PAC of Delhi Assembly cannot examine the three CAG reports on liquor supply, public health and vehicular air pollution, which were tabled in the house during the first session after the formation of BJP govt and were referred to the panel after a discussion among the MLAs.
The AAP functionary also mentioned in her letter that following the amendment of GNCTD Act, the assembly couldn't make any rule to enable itself or its committees to consider the day-to-day administration of the capital or conduct inquiries in relation to administrative decisions. "For all practical purposes, this amendment takes away all powers of assembly committees," Atishi claimed.
She added that the rules of procedure and conduct of business in National Capital Territory of Delhi also limited the roles of PAC to the examination of appropriation of accounts of the capital and CAG reports thereon.

"However, the three reports currently before PAC are not regarding appropriation accounts of NCT of Delhi. In fact, these reports concern themselves with policy matters and day-to-day administrative decisions taken by NCT of Delhi," the Kalkaji MLA said in her letter, adding that the CAG reports couldn't be "examined, inquired into, and a report prepared on them, when GNCTD Act expressly forbids" it.
Responding to the letter, Gupta said Atishi's interpretation of the rules was "bereft of any merit".
"In fact, it is the constitutional obligation of the CAG to present its reports to the assembly and for PAC and COGU (committee on govt undertakings) to examine it. Any irregularity, which has caused or may have caused loss to the exchequer, can be examined by the assembly, which sanctioned it," the speaker wrote.
He added that the rules of procedure also empowered all committees to "examine and submit" reports on matters that were not directly connected.
"The committees will dutifully dispose of their legislative obligations as laid down by the Constitution. The existing powers of the committees, within the boundaries of the Constitution and GNCTD Act, are sufficient to fulfil their duties, and there need be no apprehension that the committee will be handicapped in its working," Gupta stated in the letter.

Delhi Chief Minister Rekha Gupta announced a Rs 24,000-crore infrastructure overhaul for the Capital. Addressing a press conference Wednesday, Gupta said major arterial roads — Rohtak Road (Punjabi Bagh to Nangloi), Ashram to Badarpur, and MG Road — have now been handed over to the National Highways Authority of India (NHAI). These roads will be upgraded into signal-free corridors with complete supporting infrastructure, including drainage, side lanes, and real-time monitoring systems. 'Earlier, multiple agencies led to fragmented execution and chronic waterlogging. Now, NHAI will be the single-point authority, with support from the Delhi Public Works Department,' she said. The press conference was held following a high-level meeting chaired by Union Road and Transport Minister Nitin Gadkari. The meeting was also attended by Lieutenant Governor V K Saxena, Union MoS Harsh Malhotra, Delhi Cabinet Ministers, MPs, and senior officials from key departments. Gupta underlined several critical initiatives aimed at easing congestion and reducing pollution. These include: -A 7-km underground tunnel from Shiv Murti to Nelson Mandela Road -An elevated road from INA to the airport (eventually connecting Faridabad and Gurgaon) -Extensions of Urban Extension Road-II linking Alipur to Tronica City and the Delhi–Dehradun route. -A feasibility study is also underway for a tunnel from Sarai Kale Khan to IGI Airport. – A 20-km link road from Inderlok Metro Station along the Munak Canal to Sonipat has been proposed. Gupta said this new route would relieve traffic from Mukarba Chowk and benefit thousands of daily commuters travelling between Delhi and Haryana. The CM said the NHAI is currently executing road and transport projects worth Rs 35,000 crore across the Capital. This comes in addition to Rs 64,000-crore worth of completed works, covering 1,578 km of roads. Furthermore, Detailed Project Reports (DPRs) for upcoming projects worth Rs 24,000 crore — spanning 128 km — have been prepared and await rollout. The NHAI has also sanctioned Rs 150 crore for the construction of Road Over Bridges (ROBs) and Under Bridges (RUBs) to remove bottlenecks near railway crossings. Gupta expressed her gratitude to PM Narendra Modi and Minister Gadkari, stating, 'With Rs 1.25 lakh crore worth of decongestion projects in Delhi, the Centre has shown unparalleled commitment to transforming Delhi into a clean, green, and world-class city.' The Chief Minister also highlighted NHAI's eco-friendly practices, such as using inert solid waste and construction debris from Delhi's landfills in road construction.

It is contradictory for a welfare government to establish more hospitals on the one hand and simultaneously establish Tasmac liquor shops on the other hand. This is not in consonance with Constitutional ethos, observed the Madurai Bench of the Madras High Court while directing the closure of a Tasmac shop in Dindigul. A Division Bench of Justices S.M. Subramaniam and A.D. Maria Clete said when Right to Health is a fundamental right, the State must ensure that the prohibition is slowly implemented in a phased manner to reduce harm to public health. The court was hearing the public interest litigation petition filed by K. Kannan of Dindigul. The petitioner sought a direction to the authorities to close a Tasmac shop located on Tiruchi road in Dindigul. He said the road was used by school children. The children and other road users were finding it difficult to use the road freely and peacefully, he said. In the counter affidavit, Dindigul District Tasmac Manager submitted that the claim the liquor shop was located close to school, health and religious institutions was incorrect. The shop was located within Corporation limits, where the prohibited distance was 50 meters as per Rule 8 of Tamil Nadu Liquor Retail Vending (in Shops and Bars) Rules, 2003. Since the Tasmac shop was situated in a commercial area, the proviso to Rule 8 of the Rules states that the distance restriction shall not apply. The court said it was of the considered view that mere guidelines and rules fixing certain distances cannot be the sole criterion. In the present case, the road was used by children to reach their school and it served as a direct pathway. Consequently, the Tasmac shop would undoubtedly cause public nuisance to the road users, children attending the school and persons going to the Church. The judges said, the rules setting minimum distances are regulatory thresholds, but they do not exhaust all public health and welfare concerns. Mere compliance with the distance rule does not validate a location if the broader environment is harmful. Undoubtedly, a Tasmac shop may cause nuisance to the road users in the locality, particularly, to the children during school hours. It is the duty of the State to ensure that no such nuisance is caused to the citizens and road users. Besides, Article 47 of the Constitution directs that the State shall regard raising the level of nutrition and standard of living of its people and improvement of public health as among its primary duties and in particular the State shall endeavour to bring about prohibition of the consumption except for medical purposes of intoxicating drinks and of drugs which are injurious to health. It is a Constitutional philosophy and the Directive principles insist that a welfare government should strive wholeheartedly to enforce prohibition, rather than establish more Tasmac shops which adversely affect public health. Closure of one Tasmac shop would not cause any prejudice but would rather benefit the public at large, the court observed and directed the authorities to close the Tasmac shop in two weeks. The judges posted the matter for reporting compliance on June 18.
