An anti-discrimination complaint arising from an alpaca being used as an assistance animal in an IGA supermarket has been referred to the Magistrates Court for determination.
The complaint by Abbygail-Nigella Borst and Desmond Gaull against IGA Everyday Orford was initially made to the state's Anti-Discrimination Commissioner, who then referred it to the Tasmanian Civil and Administrative Tribunal.
The pair filed a complaint after they entered the store in December 2023 with an alpaca named Violet, described as an assistance animal, and were asked to leave as livestock was not permitted in the store.
They alleged the direct and indirect discrimination, as well as humiliating, intimidating, insulting or ridiculing conduct by the respondent.
The discrimination was on the basis that Ms Borst had a disability and that the Disability Discrimination Act had been breached.
She provided a medical certificate to the Anti-Discrimination Commissioner in which her physician stated that Violent was used as part of her therapy.
The store argued that the animal should not be allowed within the store in accordance with its obligations under the state's Food Act and the Food Standards Australia and New Zealand Act.
In making his decision, TASCAT senior member Robert Winter said he did not consider the matter being progressed through the tribunal as the appropriate course of action, and transferred the complaint to the Magistrates Court.
A video recently appeared online from what appears to be security camera vision from within an IGA supermarket at Sheffield.
It captures a person with an alpaca at a checkout.
The supermarket later stated that an alpaca could not be used as an assistance animal and apologised for any discomfort that may have been caused to customers.
The Disability Discrimination Act does not define what can or cannot be used as an assistance animal.
Sections of the act allow a person to request that information to confirm another person's need to have an assistance animal with them in a particular place, and for the animal to be trained to meet standards of hygiene and behaviour appropriate for being in a public place.

A 24-year-old woman visiting Western Australia has been remanded in custody after allegedly critically injuring a man in an e-scooter crash over the weekend. The passenger on the scooter, a 26-year-old woman, was also taken to hospital with non-life-threatening injuries. The 24-year-old rider was treated by paramedics for minor injuries. She has been charged with dangerous driving occasioning grievous bodily harm, and bodily harm, while under the influence of alcohol. Ms Kemp, who turns 25 on Wednesday, faced the Perth Magistrates Court on Monday morning and was denied bail. The court heard she was visiting WA and the prosecution argued there was a potential risk of her leaving the state. The magistrate noted Ms Kemp "looks younger than she is". "The surrender of a passport … doesn't stop someone jumping in a motor car on a huge continent and heading off into the ether," he said. Ms Kemp was remanded in custody and is next due to appear before the Perth Magistrates Court on Tuesday.

Two alleged car thieves in regional Victoria have been charged with more than 60 offences between them, after they were allegedly involved in more than 20 incidents between April 29 and May 28, 2025. Victoria Police alleges the incidents occurred across multiple suburbs in the Bendigo region, including Castlemaine, Epsom, Flora Hill, Ironbark, Jackass Flat, Junortoun, Kangaroo Flat, Kennington, North Bendigo, and White Hills. Police executed four search warrants on May 28 at addresses in California Gully, Bendigo, North Bendigo and Kangaroo Flat, and allegedly seized 'multiple items of interest' including a stolen Subaru, a Holden Colorado, stolen credit cards, tools connected to alleged car thefts, and an imitation firearm. The investigation remains ongoing, though police detailed the pair's spate of offences. A man's attempt to import a series of exotic animals into Australia – some of which died during the ill-fated voyage – has been exposed after the plot was foiled by border force officials. Queensland man Jesse Sayeg was this week handed a nine-month jail term after pleading guilty in Caloundra Magistrates Court to three offences related to the illegal importation of live exotic animals. The case was cracked open in March 2023 when Australian Border Force (ABF) officers became suspicious of a package sent from the Philippines. A strong odour from the package prompted them to alert the Department of Agriculture, Fisheries and Forestry (DAFF). A Queensland man has been handed a nine-month prison sentence after admitting his involvement in a global wildlife trafficking ring that smuggled exotic animals into Australia. A DAFF veterinarian opened the package to discover three snakes, six iguanas, three soft shell turtles and three tarantulas stuffed into calico drawstring bags. Many of the animals were dead. The discovery launched a two-year, multi-agency investigation dubbed Operation Cascade, which uncovered a broader criminal network spanning three Australian states including Queensland, Victoria and Western Australia. Breaches of Australia's biosecurity laws are treated with the utmost seriousness, carrying penalties of up to 10 years' imprisonment and fines as high as $1.65 million for individuals, or $8.25 million for companies.
