
Evan Fitzgerald case shows why gardaí cannot operate on a ‘trust us' basis
The truism that policing exists in a state of perpetual controversy punctuated by crises has been brought into sharp focus recently. Controversies involving
An Garda Síochána
and the cases of
Tina Satchwell
(Dingivan),
Michael Gaine
and now Evan Fitzgerald are, to put it mildly, concerning.
It must irritate conscientious and professional gardaí to listen to those of us who do not have to contend with the varied and enormous challenges of policing as we comment with the benefit of hindsight or opine from a position of academic expertise.
But the unique nature of policing and the exceptional powers vested in sworn police officers require that a policing service is accountable whenever there is a question mark over its competence. Effective oversight and accountability are not an impediment to policing. These are, indeed, a necessary condition if it is to be done effectively.
It is simply untenable to seek to operate on a 'trust us' basis. Trust must be earned and not presumed and it must never be taken for granted even if surveys show a high degree of public trust in policing.

To operate as an accountable policing service, Garda management must be comfortable with the duty to provide evidence-based justification in various settings where transparency is required.
To be fair, the current Garda Commissioner has been diligent in his engagement with the
Policing Authority
(now the PCSA) and Oireachtas committees. His successor will also have to engage, perhaps less visibly, with the newly established Board of An Garda Síochána.
The media play a crucial role in ensuring robust accountability. But an appropriate balance is not always maintained between crime stories that are clearly Garda-sourced and investigative journalism that probes issues of competence or corruption in relation to policing.

Both can coexist, but there is self-evidently a prevalence of what is called 'copaganda' in much coverage of crime and criminal justice matters. Influencing or shaping media coverage of crime is no proxy for accountability. Recently acknowledged improvements in the reliability and credibility of Garda crime data should be the primary basis upon which An Garda Síochána presents in the public square, not manipulative or salacious briefings. However, it is unlikely that these can ever be eliminated as a news currency of value.
The Tina Satchwell (Dingivan) case is now being reviewed at the request of the Garda Commissioner with a report to be presented in due course to the Policing and Community Safety Authority and the Minister for Justice. The Michael Gaine murder investigation, which is live, is being peer-reviewed in a routine manner.
The Evan Fitzgerald case – in which, thankfully, a higher victim count was avoided –
raises a number of disturbing questions

On what basis was the young man from Kiltegan, Co Wicklow, assessed as sufficiently low risk for gardaí to consent to bail being granted? Why did it take the public
intervention of the judge
involved to correct a media report that gardaí had objected to bail being granted?
Why did it take until the Garda Commissioner appeared before an Oireachtas committee for the story to emerge that non-functioning
ammunition had been supplied to Fitzgerald by An Garda Síochána
in a controlled delivery as part of an undercover operation?
On what basis did
Fiosrú
(formerly
Gsoc
) reach the conclusion, in uncharacteristically quick time, that no further investigation was required?
The
recruitment of a new Garda Commissioner
presents an opportunity, within the framework of new structures that should have been in place much sooner, to address problems of policing culture that have frustrated the efforts of the current commissioner to drive a reform agenda. The role of the new Garda Board will be of vital importance in this connection, and if there are tensions between Garda management and the board, that could actually be a positive sign.
Garda representative bodies will squander whatever political capital they may have if they do not engage in a more constructive manner with the new commissioner. Maintaining an oppositional stance to reforms that have been implemented and are unlikely to be reversed is futile. Personalising disagreements with garda management is a waste of energy.
In the period from 2017-2018 when the
Commission on the Future of Policing
consulted with rank-and-file members of An Garda Síochána and middle management, it was crystal clear that there was a keen appetite for reform within the policing service. Many ideas put forward, especially by younger gardaí, were excellent and were adopted enthusiastically by the commission.
The time lost in implementing the recommendations of the commission is regrettable, but many of the reforms implemented – which are probably not as transformational as sometimes claimed – provide a solid basis upon which to proceed with a degree of confidence.
The new commissioner will start with an unenviable list of ongoing controversies. Their job is to ensure that these do not become crises. This is a slightly better context than the one in which the current commissioner commenced his tenure, which was, most definitely, a context of deep crisis.

Be wary of holiday scams as summer picks up, banks warn public
Consumers are being warned to be on 'high alert' for a seasonal rise in scams linked to last-minute travel deals. FraudSmart, the fraud awareness initiative developed by Banking & Payments Federation Ireland (BPFI) – the industry group for the banks – said it was issuing the warning because holidaymakers are being specifically targeted by fraudsters. 'Fraudsters are targeting holidaymakers with offers, particularly touting 'recent cancellations' or 'limited time offers' at discounted prices through highly convincing fake websites, online adverts and social media links,' the group warned. BPFI head of financial crime, Niamh Davenport, said: 'With the summer season upon us, fraudsters are ramping up activity to take advantage of holidaymakers looking for last-minute getaways and deals.' 'It's important to take a moment and double check that the offer is authentic by visiting the official website of the travel company directly rather than clicking on a link in an email or advert,' she said, adding that the BPFIs' tool also offered consumers an easy and free way to verify the legitimacy of a website or link before making a booking. 'If you pause before you pay, it can make the difference between the holiday of a lifetime or a holiday disaster,' Ms Davenport said. 'Travel scams can be incredibly convincing and often appear on fake and copycat websites featuring logos and layouts that closely mimic well-known brands. 'The scams are targeted at consumers through online adverts and social media posts, often imitating legitimate travel companies or well-known booking platforms,' she said. 'However, once payment is made – often by bank transfer – the website or link disappears, leaving victims without a booking and out of pocket. 'Some victims may even receive a fake booking confirmation and only discover the scam after they have travelled to the destination and find the accommodation doesn't exist when they arrive.' Anyone who believes they may be a victim of such an approach is encouraged to contact An Garda Síochána, she added.

As an Irish person in Australia there is one question I'm always asked
'Are you staying or going?' It's the sort of question someone asks you when you're fretting indecisively inside the half-open door of a pub on a very cold Sunday afternoon. They were peacefully enjoying their carvery, but now they're getting slapped on the back of the neck by a frozen, metallic wind and your indecision is an unpleasant distraction. It isn't entirely a real question; it's not the sort that seeks an answer. Really, it is a statement. A nudge. A prompt for you to go out or come in, but to cease loitering in liminal places, letting in the chill and making people uncomfortable. As an emigrant to Australia , and an Irish immigrant in Australia, I have been asked this question in countless contexts since the big move. My cat's vet asked, 'Are you staying or going?' when she wanted to know which vaccinations the cat might need. My aunt and uncle asked, 'Are you staying or going?' because they might hope we'd come home, but also because it is anathema to their generation to be always gallivanting over the earth and not settling in one place to lead a meaningful and happy life amid familiar people and familiar surroundings. My brother wonders (but is too polite to ask), 'Are you staying or going?' because he worries, as a good brother generally must, that I'm far away and have lived in three countries in the past eight years. I imagine he wonders whether this scenario emerges from a desire to live in this way, or a necessity to do so. READ MORE As a person living in Canberra, the Australian capital, where politics is done but culture is mostly a government initiative rather than an organic and emergent feature of life the way it is in other capital cities, transience is standard. People in the military are here for temporary postings. They stay a year or so and then they move on. Public servants do this too. Diplomats and politicians, spooks and consultants and journalists and attachés. While it does, of course, have a fixed population, many of whom provide services to and for the more transient inhabitants of Canberra, the city is considered by many Australians as an unexciting place to live. [ Emigration: 'From a distance, I have relearned how to be Irish' Opens in new window ] At a bit over two hours' drive away, Sydney is the place those with time and means escape to at every opportunity. The centre of Canberra empties out at weekends and on holidays. When you meet a new person here, they generally presume you're not here forever. For this reason, it can be a challenging place to put down roots. An Irish person I was chatting with once referred to the city as 'a backwater', which I found interesting. 'Who would want to live there?' he asked me, scoffing pompously, asking another question that isn't a question. 'Well,' I considered, 'anyone who perhaps wants to live in decent, affordable rental accommodation without housemates in their 30s. Anyone who is weary of the frenzied overcrowding in big European cities with terrible, oversubscribed public services, or who wants a safe place where it's possible to both work and raise children. Anyone who wants to access medical care when they need it or to see a GP who remembers them each time they go in. Or anyone who wants a quiet, slow pace of life. Anyone like that, really.' Yet, 'Are you staying or going?' isn't just an annoying question that other people ask you as an emigrant. It's the annoying question that you ask yourself. Unless things at 'home' (wherever a person's home may be) are very bad indeed, nobody thinks to ask a person who has always lived in their native country whether they'll stay there. Most people stay vaguely where they originate unless there's a powerful external reason to go. The Famine did it for us, as have consecutive crises and economic downturns and incompetent governments. [ These days, the emigration experience is both alien and familiar at the same time Opens in new window ] Once you've gone, though, it's another matter. There will always be the people who want you home again, but the act of leaving once generates the possibility of leaving again. If you can leave home, you can leave anywhere. You can, theoretically speaking, live anywhere if you meet the criteria and they'll let you in (easier said than done, of course, but you get my point). The real upheaval of emigration is the way that it reorients your relationship to where you live and have lived. When my grandfather's father, who was born in Australia to Irish parents, made the decision along with his younger brother to return to Ireland, it was a one-way trip. They would have understood the irrevocable magnitude of that decision. Then, you emigrated once, and you lived out that decision no matter what it meant for you. The people you left behind were people you would probably never see again. Now, things are different. Many Irish people who have emigrated to Australia in previous waves have done so with every intention of coming home again, and a lot of them did. We accept a stint in Australia as an Irish rite of passage, but we feel tender about those who don't return. The present wave going to Australia have little incentive to come home again, sadly. [ Ireland's grocery prices are still soaring. How can that be? Opens in new window ] Modern living offers no permanence. No job stability that resembles anything like that our parents had. A cost of living all over the western world that limits people's option to live where they might ideally choose, whether that place is 'home' or not. But I have been long enough in Australia now to feel the question simmering with an urgency it didn't hold before – 'Am I staying or going?' At some point, if the intention is to settle, then you have to start doing that. If it isn't, then you need to consider what life might look like in two or more years, what you'd like to be doing with it, and what is achievable in your circumstances. Body of teenage boy (17) recovered from river Barrow by Garda divers
The body of a teenage boy (17) has been recovered from the river Barrow. The body was found by Garda divers at about 11pm last night. The teenager is understood to have been swimming with a friend when he got into difficulty at about 6.30pm in the Milford area of Co Carlow, 8km from Carlow town. The student's friend tried to help him but also got into difficulty in the strong currents. The friend managed to swim to safety and raise the alarm. READ MORE Gardaí and emergency services from Carlow town were quickly on the scene, and a search got under way involving emergency services and the Garda Water Unit. The teenager was a transition year student in a secondary school in Carlow town. The scene remains cordoned off by gardaí.
