
SC delivers split verdict on income tax appeal involving foreign firm
The case involved foreign drilling companies, including Shelf Drilling Ron Tappmeyer Ltd.
The bench comprising Justices B V Nagarathna and Satish Chandra Sharma, delivered divergent opinions on the legal interpretation of Sections 144C and 153 of the Income Tax Act, 1961.
These provisions relate to the timelines and procedures for assessment in cases involving non-resident assessees.
The dispute centred on whether the time period provided under Section 144C for the issuance of draft assessment orders should be treated independently or subsumed within the overall limitation period prescribed under Section 153 for completing assessments.
Justice Nagarathna rejected the appeal of the revenue department and concluded that the high court was correct in holding that assessment proceedings initiated under Section 144C in these cases were time-barred, as the final orders could not be passed within the extended deadline of September 30, 2021.
He noted that rigid interpretation of timelines under Section 153 could result in a denial of fair opportunity to the assessees and breach the principles of natural justice.
With the judges delivering conflicting decisions, the matter would now be placed before the Chief Justice of India on the administrative side for taking appropriate directions of listing the matter before a larger bench.
The pleas arose from a batch of petitions filed by non-resident assessees before the Bombay High Court, which were allowed via a common judgment dated August 4, 2023.
The assessees, engaged in offshore drilling activities, had opted out of the presumptive taxation scheme under Section 44BB for the assessment year (AY) 2014–15 and declared significant losses in their returns.

Jammu Rail Division auctions LCD monitors to raise revenue
Agency: PTI New Delhi, Aug 12 (PTI) The Jammu Rail Division has auctioned all LCD monitors installed at ticket reservation counters and other places in the whole division to publicity companies for one to five years, to increase revenue. 'On August 11, 2025, we declared the result of the e-auction, which was held on July 4, 2025. We have awarded the contract to various firms for Rs 9,00,990 for the next one year and Rs 53,15,841 for the next five years," a railway official said. According to railways, the Digital Display Information System (DDIS)-LCD monitors have been placed outside each Ticket Reservation Counter, integrated with the Railway Ticket System (CRIS). 'The screen is thoughtfully divided into two distinct sections. The lower 30 per cent is dedicated to displaying real-time ticket information for each commuter, which is essential for verification before ticket booking," the official said. The remaining 70 per cent is used for presenting entertainment content and ads to commuters awaiting their turn, he said. At the Pathankot Cantt Railway Station of Jammu Division, the Pay and Use toilet block has been allotted to a company for operation for Rs 7,66,669 for the first year and Rs 23,00,007 for the next three years, the official said. The division also auctioned Seating-cum-Luggage (SLR) trains. 'SLRs of train numbers 12588, 16032 and 12476 were allotted for various trips for Rs 5,19,379, Rs 1,17,32,805 and Rs 22,44,040, respectively, for two years," the official said. Similarly, SLRs for train numbers 12478 and 14692 were allotted for various trips for Rs 22,38,979 and Rs 21,36,645 for two years. Uchit Singhal, Senior Divisional Commercial Manager, Jammu Division, said, 'This system is a non-revenue income system operated by the Commercial Department in Indian Railways, which includes commercial promotion, parking, pay and use parcel leasing, ATM, etc. Its allocation has been done successfully through e-auction." Sebi proposes standard code for smooth transfer of securities to heirs
Capital markets regulator Sebi on Tuesday proposed the introduction of a standard reason code to streamline the transfer of securities from nominees to legal heirs and ensure appropriate tax treatment for such transactions. In a consultation paper, Sebi suggested introducing a specific reason code 'TLH' (Transmission to Legal Heirs) to be used by registrars, depositories and other reporting entities while intimating the Central Board of Direct Taxes about such transmissions. The move seeks to enable proper application of the provisions of the Income Tax Act, 1961. Currently, transmission of securities from nominee to legal heir of the original holder, some transactions are being treated as normal sale of securities. This has resulted in capital gains tax being levied on nominees, even though clause (iii) of Section 47 of the Act does not consider such transmissions as "transfers" for tax purposes, Sebi said. The regulator noted that the nominee merely acts as a trustee for the benefit of legal heirs of the original security holder and ultimately the securities which belong to the legal heir(s) are transmitted by the nominee to such legal heir(s). The proposal follows deliberations by a working group comprising registrars to an issue and share transfer agents (RTAs), which engaged with multiple stakeholders. Based on the working group's recommendations, the markets watchdog has sought to make the reporting process more consistent and transparent. The procedural requirements for transmission of securities will continue governed under the Sebi's LODR (Listing Obligations and Disclosures Requirements) Rules, 2015, and the Master Circular for RTAs dated June 23, 2025, as updated from time to time. The Securities and Exchange Board of India (Sebi) has invited public comments on the draft circular till September 2. Sebi said RTAs, listed issuers, depositories and depository participants will be required to make necessary system changes to adopt the 'TLH' code within three months of the issuance of this circular.
