Geng Upik leader, accomplice jailed for organised crime, drug links

KOTA KINABALU: Two individuals, including the leader of 'Geng Upik', were sentenced to prison by the High Court here today.
Datuk Maslan Sani, 42, who was identified as the leader, was sentenced to five years' imprisonment after pleading guilty to being a member of the organised crime group between 2015 and 2023.
Nelson Yen Yee Chung, 47, was sentenced to three years' imprisonment after pleading guilty to an alternative charge of aiding the organised crime group.
Both accused entered their pleas before Judge Datuk Dr Lim Hock Leng.
Maslan was charged under Section 130V(1) of the Penal Code, which provides for a prison sentence of up to 20 years.
Meanwhile, the alternative charge against Nelson was framed under Section 130W of the Penal Code, which carries a maximum sentence of 10 years' imprisonment upon conviction.
According to the facts of the case, Maslan was arrested at 2.30am on Dec 25, 2023, at an entertainment outlet in Penampang on suspicion of involvement in the organised crime group.
Investigations showed the accused played the role of group leader and was involved in drug trafficking activities alongside other members to gain material benefits.
The investigation also revealed that the organised crime group 'Geng Upik' was involved in drug trafficking activities connected to several serious offences, including three cases in Tawau and one in Manggatal.
In Tawau, authorities seized 53kg of syabu linked to 'Geng Upik'. The investigation also led to the arrest of an individual who assisted the group, namely Syafilah Pawawoi, who was sentenced to 12 years in prison for drug offences.
Another individual who also allegedly assisted 'Geng Upik' is currently on trial at the Tawau High Court under Section 39B of the Dangerous Drugs Act 1952.
In Manggatal, the group was linked to the seizure of 4.6kg of syabu.
In Nelson's case, he was arrested on Dec 25, 2023 in Inanam. The investigation found, among other things, that the accused had assisted the organised crime group by attending meetings and helping to manage its business and financial affairs.
Both accused, through their respective lawyers, asked for a lenient sentence.
Lawyer Hamid Ismail, representing Maslan, said that the accused is a divorcee with nine children, aged between three and 18, to support.
He also informed the court that the accused was a first-time offender and expressed remorse for his actions.
Lawyers Datuk Ram Singh and Prem Elmer Ganasan, representing Nelson, informed the court that this was his (Nelson's) first offence and that he regretted his actions.
The prosecution was conducted by deputy public prosecutors Datuk Nazran Mohd Sham, Lina Hanini Ismail, Siti Hajar Mat Radzi, and Nur Ainaa Ridzwan.
Meanwhile, the trial of three other individuals – Zulkahar Dusing, 38, Rahman Burijin, 44, and Jaisalfian Jaineh @ Zaini, 45 – who are facing charges of being members of 'Geng Upik', is set to take place from July 15 to July 18.
In total, 15 individuals have been charged in connection with the 'Geng Upik' case. However, previously, 10 individuals had pleaded guilty to the alternative charge of aiding an organised crime group and were sentenced to three years' imprisonment each.

Padang Besar district police chief Assistant Commissioner Mohd Shokri Abdullah said preliminary investigations into the 8.31am incident revealed that the facility housed 20 elderly residents, one of whom is believed to have started the fire. "Closed-circuit television (CCTV) footage from the care centre showed that the blaze was believed to have been ignited by an 81-year-old male resident. "The suspect allegedly started the fire in a cupboard in the kitchen area, which then spread to the main hall, destroying about 50 per cent of the space," he said in a statement today. Shokri said investigations later found that the act was fuelled by the suspect's dissatisfaction with the centre's caretaker. "The suspect was reportedly upset after being refused permission to travel to Kangar to get a hearing aid with his girlfriend, who is also a resident at the centre. "The estimated losses are still being assessed," he said, adding that the suspect has been arrested and later released on police bail. The case is being investigated under Section 435 of the Penal Code for mischief by fire, which carries a maximum 14 years' imprisonment and a fine upon conviction. Meanwhile, a Perlis Fire and Rescue Department spokesman said the blaze damaged about 50 per cent of the building's structure. "Firefighters from the Padang Besar fire and rescue station were dispatched to the scene after we received an emergency call at 8.32am. "They used a 60-metre hose line with two water jets to bring the fire under control by 9.31am. "No injuries were reported, and the operation ended at 9.34am," the spokesman said.

PUTRAJAYA: A Chinese national was arrested after allegedly behaving aggressively and injuring an Immigration counter officer during a departure check at Kuala Lumpur International Airport (KLIA) Terminal 1, yesterday. The incident occurred at 7.40pm when the woman, accompanied by a man and two children, approached the counter for immigration clearance. The officer on duty discovered that they had no records of entry into Malaysia and referred the matter to a supervisor for further verification. The Malaysian Border Control and Protection Agency (MCBA) said the suspect became agitated when instructed to allow other passengers to proceed while checks were carried out. She reportedly hurled abuse at the officer, pulled at her headscarf, and pushed her head towards a pillar in front of the counter. "A brief scuffle ensued, and the suspect refused to calm down despite repeated instructions. MCBA enforcement officers then called in the Aviation Security (AVSEC) team to diffuse the situation," MCBA said in a statement today. The officer sustained swelling around her left eye, a headache on the right side of her head, and body aches, and was subsequently referred to Cyberjaya Hospital for treatment. A police report has been lodged, and the suspect remains in custody for investigation under Section 186 of the Penal Code for obstructing a public servant in the discharge of their duties, Section 332 for causing injury to a public servant, and Section 353 for using criminal force to deter a public servant from performing their duty.

TANGKAK: A 60-year-old woman lost RM695,375 after falling victim to an online investment scam that was impersonating a global investment management firm. Tangkak OCPD Supt Roslan Mohd Talib said the victim came across the offer on Facebook and contacted the suspect via WhatsApp. She was instructed to download an app via a link sent by the suspect. "Lured by promises of 100% returns, the victim made 16 transfers to four mule accounts between July 2 and Aug 13," he said in a statement on Thursday (Aug 14). The victim lodged a police report on Thursday after realising she had been scammed, with the case now being investigated under Section 420 of the Penal Code for cheating. – Bernama
