Arizona's water director wants a fight over growth? He's getting it
But no matter how he spins it, his argument fails — both legally and as a matter of sound water policy.
The Arizona Department of Water Resources' new 'unmet demand' rule, unilaterally imposed without legislative approval and without allowing those most impacted to have a voice in the rulemaking process, is now driving up housing costs for all Arizonans and threatening our state's economic growth.
Yet writing in these pages, Director Buschatzke boldly asserts that Gov. Katie Hobbs 'designated me to defend Arizona residents' right to enjoy an assured water supply.'
No. Despite Buschatzke's apparent desire to act as a mini czar with unilateral power to determine this state's water policy, his authority — like all government power — is constrained by Arizona law.
And that law is crystal clear: When regulatory agencies like ADWR attempt to impose sweeping policies — such as halting all new home construction across large parts of the Valley — they must do so through formal rulemaking, allowing for public input.
Instead, Buschatzke sidestepped this requirement and imposed his homebuilding moratorium with the stroke of a pen. The Goldwater Institute, where I work, is now suing the agency to halt the illegal rule.
This may shock career bureaucrats like Buschatzke, but Arizona is not a command-and-control, Soviet-style government. We live in a republic.
That means administrative agencies must act with authorization from our elected lawmakers. The Arizona Legislature has codified this basic principle of democratic government in state law, which says that administrative agencies can only impose rules that are 'specifically authorized' by state law.
Buschatzke's legal defense collapses on this front, too. He claims that his actions are justified under Arizona's Groundwater Management Act. Yet, he cannot point to a single provision granting him the broad power he now asserts — because no such provision exists.
On the contrary, the law is clear: To demonstrate an assured water supply, homebuilders must show a 100-year groundwater supply for the 'proposed use' of a subdivision.
In other words, if builders want to develop homes, they must prove they have enough water for that project for 100 years — a requirement that homebuilders have historically shown and can show now.
Buschatzke's so-called 'unmet demand' rule turns this requirement on its head. He argues that if a projected groundwater shortfall exists anywhere in a management area, then no groundwater can be considered available for any use across the entire region.
This interpretation is not just legally indefensible — it's absurd. It violates the law and defies common sense.
Homebuilders in Arizona don't just prove a 100-year water supply — they also replenish virtually every gallon of groundwater they use across metro Phoenix. And this has been the requirement since 1995.
No other water user faces this requirement. Semiconductor factories, for example, are exempt from the 'unmet demand' rule and can pump unlimited amounts of water without replenishing a drop.
Meanwhile, homebuilders are forced to replace almost everything they use — yet they're the ones being shut down.

Buschatzke also claims that his policy is not 'new.'
Yet his agency's rule marks the first time in Arizona's history that the government has prohibited new home construction on groundwater in specific areas of Maricopa County — sadly, the very areas where affordable housing is most needed.
If you care about unelected bureaucrats dictating Arizona's water policy, you should be alarmed by ADWR's 'unmet demand' rule.
If you care about affordable housing, you should be outraged by ADWR's reckless policy, which — at the governor's direction — will continue pricing thousands of Arizonans out of homeownership.
And if you care about the rule of law, you should be deeply troubled by Buschatzke's defiant defense of his agency's lawlessness.
Buschatzke promised a 'fight' over these rules.
When you trample the rights of Arizonans — and crush the dreams of everyday families trying to achieve homeownership — that's a fight we're ready to take.

Mexican boxer Chavez Jr. deported from US over alleged cartel ties
Former champion boxer Julio Cesar Chavez Jr. has been detained in Mexico after deportation by the United States to face shock charges of involvement with a drug cartel, Mexican authorities said Tuesday. The son of boxing icon Julio Cesar Chavez stands accused of serving as a henchman for the powerful Sinaloa drug cartel, which Washington designated a foreign terrorist organization this year, and of trafficking firearms and explosives. Acccording to Mexican media, which claim to have had access to the case files, Chavez, 39, was allegedly a "hitman" used to punish members of the cartel. "He hangs them (and) grabs them like a punching bag," the Reforma newspaper reported, citing testimony in the prosecutor's documents. The Attorney General's Office has withheld details of the indictment. Chavez was handed over Monday and transferred to a prison in Mexico's northwest Sonora state, according to information on the country's National Detention Registry. "He was deported," President Claudia Sheinbaum told reporters, adding there was an active arrest warrant for him in Mexico. US authorities arrested Chavez in July for being in the United States illegally. They also said he was wanted in Mexico for alleged ties to the Sinaloa cartel, one of six Mexican drug trafficking groups designated as terrorist organizations by the United States. The Department of Homeland Security (DHS), which oversees US immigration enforcement, said Chavez had entered the United States legally in 2023 on a tourist visa that was valid until February 2024. He applied for permanent residency in April, 2024 "based on his marriage to a US citizen, who is connected to the Sinaloa Cartel through a prior relationship with the now-deceased son of the infamous cartel leader Joaquin 'El Chapo' Guzman," DHS said in its July 3 arrest announcement. His extradition comes as US President Donald Trump cracks down on immigrants as part of a promise to deport millions of people. - Boxing legacy - Chavez's arrest by Immigration and Customs Enforcement (ICE) agents in Los Angeles occured four days after his lopsided loss to YouTuber-turned-boxer Jake Paul before a sell-out crowd in California. Once a top-rated boxer, Chavez won the WBC middleweight world title in 2011 and successfully defended it three times. But his career has also included multiple suspensions and fines for failed drug tests. Homeland Security said that in addition to the active warrant in Mexico, Chavez had criminal convictions in the United States, including for possession of an assault weapon, in January 2024 in Los Angeles. The Los Angeles Times reported at the time that police said they had found Chavez in possession of two AR-style hard-to-trace "ghost" rifles. DHS in its announcement had expressed astonishment that the administration of Trump's predecessor Joe Biden had not prioritized Chavez's deportation. "Under President Trump, no one is above the law -- including world-famous athletes," DHS Assistant Secretary Tricia McLaughlin said in the announcement. After his US arrest, the boxer's defense team sought to prevent his prosecution in Mexico by filing multiple legal appeals, which were rejected by the Mexican courts. Boxer Julio César Chávez Jr. arrested, jailed after being deported to Mexico
Boxer Julio César Chávez Jr. was deported from the United States and entered a prison in the northern Mexico state of Sonora, according to the country's national arrest registry. Chávez had been arrested in the U.S. in July and Mexican president Claudia Sheinbaum confirmed on Tuesday, Aug. 19 that the 39-year-old had been deported to Mexico. A former middleweight world champion, Chávez was arrested July 2 in Southern California and then detained by ICE, according to the Department of Homeland Security. Mexican prosecutors allege he acted as a henchman for the Sinaloa Cartel, which Washington designated a foreign terrorist organization earlier this year. Chavez Jr's lawyer and family have rejected the accusations. Mexico's national arrest registry showed that he was arrested at a checkpoint in the border city of Nogales and transferred to a federal institution in Sonora's capital of Hermosillo. Chávez is a Mexican citizen and was being processed for expedited removal from the United States after his arrest, according to DHS, which said Chávez has an active arrest warrant in Mexico for his involvement in organized crime and trafficking firearms, ammunition, and explosives. His arrest came four days after losing a high-profile boxing match to celebrity boxer Jake Paul. Chávez, the son of legendary Mexican fighter Julio César Chávez Sr., held the WBC middleweight title in 2011 and 2012. He was critical of immigration raids in Los Angeles. In August 2023, Chávez entered the country legally with a B2 tourist visa that was valid until February 2024. Chávez was on a scooter by his home in Studio City, a neighborhood in Los Angeles, when he was detained by ICE agents, according to the Associated Press, which also reported Chàvez would appear in court Monday. In January 2024, Chávez was arrested in Los Angeles on charges of felony gun possession charges after police said they found him in possession of two AR-style ghost rifles, according to ESPN and the Los Angeles Times. He pleaded not guilty to the gun possession charges and agreed to enter a residential treatment program, according to those reports. Court records indicate Chávez was granted pretrial diversion. As of the last progress report on June 18, he was still in the program, said Greg Risling of the Los Angeles County District Attorney's June 25. In its press release, DHS stated former President Joe Biden's administration allowed Chávez to reenter the country in January and paroled him into the country at the San Ysidro port of entry in California. Chávez Jr. says ICE immigration raids 'scared me' Chávez trained in Los Angeles before the fight against Paul and addressed the immigration raids that triggered protests in the city's downtown. "It even scared me, to tell you the truth, it is very ugly,' he told the Los Angeles Times for a story published June 23. 'I don't understand the situation, why so much violence. There are many good people and you are setting an example of violence to the community.' He also addressed federal agents wearing masks and not identifying themselves while targeting workers who appeared to be immigrants, according to the Los Angeles Times. 'Seeing children left alone because their parents are grabbed,'' Chávez said. '... That is common sense, we are people and we are going to feel bad when we see that situation.''
