
Police discipline should not be hidden from the public
It sounds like the kind of thing you'd see in a gritty crime drama out of 1970s Chicago.
Veteran police officers actually on the wrong side of the law, dealing drugs and taking part in break-and-enters and extortion — even taking pictures of a half-clad deceased woman and sharing them with others. Stealing police ammunition from training sessions and passing it on to people outside the police force, and sharing confidential police information with other outsiders.
Those are some of the allegations, and criminal charges, levelled against Const. Elston Bostock, a 22-year veteran of the Winnipeg Police Service. The charges against Bostock were announced Thursday by WPS Chief Gene Bowers, along with a slew of other charges for three other general patrol officers, some of whom are alleged to have been working in concert with Bostock.

'These are very serious allegations which go directly against the values of the Winnipeg Police Service, tarnishing our reputation and eroding the public's confidence,' Chief Bowers told a news conference, calling it a 'very sad day for the service.'
Absolutely true. Now, the vast majority of upstanding WPS officers will bear a stain on their collective reputations for the actions of a very few.
Actions, by the way, that allegedly stretch back for years.
Part of Chief Bowers' comments on the charges yesterday included the fact that he has written to Justice Minister Matt Wiebe to establish a uniform code of conduct for police, and to give the WPS the ability to publicly disclose disciplinary actions taken against officers.
Wiebe has agreed with the idea of the uniform code of conduct and says his department is working to put such a code together. But he's been remarkably non-committal on the idea of releasing the results of disciplinary actions.
Winnipeg Police Union President Corey Wiles, meanwhile, took a different view.
'I expect (Bowers) also recognizes that, whatever he is looking at, the (Winnipeg Police Union) will always act to ensure the privacy rights of its members — just like the members of other public-sector unions, and just like those of individual Canadians — are always respected.'
With all due respect to privacy rights, those rights don't extend unilaterally to those in a position of power who have been found to have abused that position.
When the medical establishment sits in judgment on the conduct of doctors, keeping those decisions confidential does nothing to build trust. Keeping misconduct by teachers out of the public eye? It creates the same lack of confidence in the process.
That's why the Free Press has steadfastly argued for disciplinary actions to be publicly available across a broad spectrum of professions.

Not to identify victims or to put their mistreatment on show, but to demonstrate to the public that improper actions have clear consequences, even when someone in a position of trust and power is the one who is committing them.
Keeping disciplinary action under wraps does nothing to build confidence in the disciplinary process — in fact, it can make those who file complaints feel as though those conducting the investigation are on the side of the alleged offender. And it makes other victims feel as though the deck is stacked against them before they even start.
Chief Bowers is making the right move, even though it is likely to be unpopular within his own force. Justice Minister Wiebe should make the right move as well, and act to make disciplinary decisions public.
And police union president Wiles should recognize that hiding police malfeasance undermines public trust in each and every one of his union members.
Sunshine disinfects, as the saying goes. And this particularly rank little abscess in the police service is overdue for both a lancing and some permanent, public confidence-building sunlight.

Charges withdrawn against Interlake teacher
School employees are being warned not to text students in the wake of now-withdrawn charges against an Interlake teacher accused of sending late-night messages inviting a teenage girl to join him in a hot tub. The man was charged July 28 with luring a child via telecommunications and sexual interference, court records show. The student's father — whose name is not being published to protect the underage teen — said he sat in on Wednesday's court hearing and was frustrated to hear both counts had been dropped. The accused's employer — Lakeshore School Division — and Manitoba's commissioner of teacher professional conduct confirmed that separate investigations are ongoing. An iPhone text message conversation reviewed by the Free Press suggests that at about 11:30 p.m. on Dec. 13 the teacher asked a then-16-year-old girl he taught and coached to join him in his hot tub. The opening text of the exchange — released by the student's family — declares: 'Party time!!!!' In response to the recipient's multiple questions about the sender's identity, the instigator replied with a teacher's last name and 'You coming(?)' That followup text was later modified, replacing that name with another; iPhone users can edit a message within 15 minutes of sending it. The texter's number was the same as the one a teacher at the girl's school had used to communicate with her and other student athletes in a text group chat. Karyn Kibsey of the Canadian Centre for Child Protection said cases such as this one underscore the need for schools to have clear policies on staff and student communications. Correspondence should be 'transparent, accountable, tied to a clear professionally sanctioned purpose, and authorized by school administrators,' the senior manager of education and training said in a statement. It should also respect appropriate boundaries in terms of subject manner, medium, timing and frequency, Kibsey said. The organization's 2022 review of roughly 300 cases of misconduct or criminal charges of a sexual nature involving Canadian teachers found 'inappropriate use of communication' was the most common violating behaviour. 'This type of boundary transgression is also often a precursor for further, more severe forms of harm against students,' Kibsey said. The recent charges provided 'a little bit of validation' as an Interlake family has been grappling with gossip in their hometown, the girl's father said. After attending court Wednesday, he expressed concerns that his daughter would be perceived as a liar. 'Is she supposed to get felt up or groped or raped before they do something?' he said in an interview as he recalled an earlier conversation he had with the presiding Crown attorney, who informed him there wasn't enough evidence to back criminal charges. The father said he was told RCMP discovered the suspect's phone had been 'wiped clean' upon seizing it. Police detectives had the girl's iPhone in their possession for several months as part of the investigation. Mounties confirmed that the investigation involved a single student. Both of her parents said other students teased and blamed their daughter for the well-liked teacher's sudden disappearance last year. The household received a July 30 letter from the provincial Justice Department to inform them of the rights of child victims in Manitoba. The family has felt 'in the dark' for the better part of the last eight months, the father said. He recalled contacting school administration immediately to inform them of the texts and warn that his daughter would not be attending if the teacher in question remained on duty. Both he and his wife said the principal made hurtful remarks when they met with her before the winter break. The teen was made to feel responsible for the situation, they said. Lakeshore administration acknowledged a staff member had been charged with offences under the Criminal Code of Canada related to interactions with minors. Donald Nikkel, superintendent of human resources, said in a statement that the division has taken undisclosed 'interim measures.' Nikkel noted division's investigative process, which he said prioritizes 'student safety and well-being while ensuring a fair process for staff,' is separate from both the courts and commissioner's office. Manitoba's public teacher registry shows the educator in question remains in good standing. Commissioner Bobbi Taillefer confirmed his certificate has not been suspended pending the outcome of an ongoing disciplinary process. 'What I can say is, at this current state, he is not in the classroom,' said the government appointee who oversaw the rollout of a new disciplinary process at the start of the calendar year. Asked about her advice on contacting students outside instructional hours, Taillefer said she has long been a proponent of corresponding directly with guardians. 'Electronic communications should be with parents and not students,' she said, noting she has urged colleagues not to contact students directly throughout her 30-year career in various school and union roles. We broke the story. AI is breaking the internet.
In the summer of 2019, Free Press investigative reporter Ryan Thorpe went undercover for a meeting with a local recruiter for a neo-Nazi group at a secluded park in St. Boniface. The man he met while infiltrating a white nationalist hate group turned out to be a Canadian Armed Forces reservist from Beausejour by the name of Patrik Mathews. In short order, Thorpe would uncover a story that would ultimately lead to a Maryland courtroom where Mathews would be sentenced to nine years in prison for what the FBI said was a plan to incite a race war in the United States. But five years later, all the work Thorpe did as part of our Homegrown Hate investigation is no longer part of the record as it's now defined by the 'intelligence' of Google's Gemini artificial intelligence search platform. Instead, this new approach to search for information delivers a summary — minus any links, sources or reason to look any further than the answer Google has just provided — when you type 'Patrik Mathews' into that search window: Patrik Mathews' biography, as summarized by a Google Gemini query. Take note how that summary makes no mention of the Free Press as the source of the investigation or Thorpe as the journalist – including the fact he had to contend with death threats as the FBI learned members of The Base were planning to kill him for exposing Mathews. In this AI-powered future of search, there is no reward for being the originating source: no links for readers to click to read more, and therefore no revenue to pay for that journalism – not even any recognition. Instead, what greets you is the 'answer' by way of an AI overview. That might be good for tech titans like Google who want to keep users looking at their pages. But it's yet another gut punch to content creators like the Free Press who rely on search engines to send readers our way. 'Large language models (LLMS) are harming publishers in two ways,' notes Paul Deegan, president of News Media Canada. 'First, AI companies are flagrantly scraping and summarizing content directly from published news articles via retrieval-augmented generation. Second, because AI overviews are significantly more comprehensive than the snippets associated with traditional links, users may feel they have no reason to click through to the source article on a publisher's website. 'With the user staying within Big Tech's increasingly tall-walled garden, rather than being directed electronically to news websites via links, publishers are deprived of audience, and their ability to sell advertising and subscriptions is significantly diminished. 'No clicks mean no cash for news businesses. Yet, AI companies are selling ads against copyrighted (and often paywalled) content as well as subscriptions for their premium products.' The harm to publishers' bottom lines isn't the worst of the problem with AI summaries. Accuracy is also a problem: a report by BBC earlier this year examining AI chatbots by Google, Microsoft, OpenAI and Perplexity found 'significant inaccuracies' in more than half of their summaries of news stories. That's a study of news-article summaries; you might also have read funny stories about AI search results suggesting people eat a rock every day or put glue on their pizza, or less hilarious stories about it suggesting a mix of vinegar and bleach for home cleaning (a recipe for poisonous chlorine gas). This happens because AI generates text by making plausible predictions based on training data; nobody is checking for truth in its sources or its answers. The scale and scope of AI's errors and distortions is not known — not to audiences and media companies, not to regulators, lawmakers, academics or even the companies responsible for the AI chatbots. And as AI summaries and chats become more integrated into search systems, people rely on them more, so they're less likely to bother to double-check the information AI tells them. Not just to pay investigative journalists, but to pay others in the newsroom to verify our work is accurate and objective, and to host the information on websites and apps for audiences to read it… if they can find it. If generative AI continues to crawl 'without consent, credit and compensation,' what does that mean for the long-term future of information we can trust — and for that matter, for human intelligence?

Conservatives aiming to amend Criminal Code so immigration status won't be a factor in sentencing

Ontario Court judge Paul O'Marra wrote that a criminal record would likely prevent the offender from sponsoring his wife to also become a permanent resident, as well as delay the offender's eligibility for Canadian citizenship and jeopardize his ability to become a licensed engineer. Article content O'Marra concluded that 'a custodial sentence would be unduly harsh' and instead handed down a conditional discharge with 12 months of probation, which included three months of house arrest. In establishing the basis for his reasoning, he wrote: 'The Pham decision stands for the principle that collateral consequences, while not determinative, can justify a lower sentence within the legal range to avoid disproportionate hardship,' Article content In an Alberta case cited by Rempel Garner, a man in Canada on a visitor's permit was accused of groping an 18-year-old woman in a nightclub twice. The judge ruled that 'in consideration of the devastating collateral immigration consequences to recording a conviction, I conclude that the appropriate sentence for Mr. Singh is a conditional discharge with a probation order of maximum duration, 3 years.' Article content Article content Rempel Garner insists that when 'it comes to sentencing non-citizens, Canada has essentially adopted a system of two-tier justice where judges can and have given lighter sentences to individuals who are non-citizens.' Courts have been more lenient on non-citizens since 2013, at times going light on sex offenders to help them remain in Canada. Article content Acknowledging that the vast majority of immigrants and temporary residents in Canada abide by the law, she said 'removing non-citizens convicted of serious crimes is a no-brainer. Conservatives will always fight to protect Canadians, the value of our citizenship and the safety of every person who lives here. Becoming a Canadian is a privilege, not a right.'
