23andMe bankruptcy underscores health privacy gaps

The demise of 23andMe illustrates the vulnerable state of Americans' health data, as med tech companies vacuum up more personal information with little regulatory oversight.
Why it matters: Fitness trackers, wellness apps, genetic tests and other direct-to-consumer tools that capture personal health information aren't subject to federal health data privacy laws. That could open the door to fraud or discrimination.
"We're getting into an era where we have more entities sitting on these big datasets," said Sara Gerke, an associate law professor at the University of Illinois Urbana-Champaign.
Catch up quick: 23andMe filed for bankruptcy Sunday to facilitate a sale of the company, which has been in financial distress and saw its board of directors quit last year.
That raises questions about what an acquiring company would do with the genetic and personal data of the more than 15 million people who have provided saliva samples for 23andMe's testing kits.
Where it stands: 23andMe said in a release that the bankruptcy filing won't change the way it protects customer data and that data privacy will be a key consideration in a future sale.
But as things currently stand, a buyer could change the privacy policy after the sale.
Some consumer advocates have suggested people proactively remove their information from the company's files. California Attorney General Rob Bonta on Friday advised 23andMe consumers to take advantage of state privacy laws and ask the company to delete their data and destroy their genetic material.
23andMe's privacy policy states that it keeps certain genetic information to comply with legal requirements and other "limited information" related to your account, even if you delete it.
Additionally, if data has already been used for research, it may only be partially removed, Gerke said. More than 80% of 23andMe customers consent to participate in research, according to the company.
Zoom out: In reality, there isn't much federal protection for customer data shared with 23andMe, or other companies that circle the health care space but aren't actually health providers.
The landmark health privacy law HIPAA only applies to health providers, insurers, clearinghouses and their business associates, leaving a big gap as the market for consumer and digital health gadgets grows.
The Federal Trade Commission acts as a watchdog to make sure companies don't deceive consumers and act in accordance with the data privacy terms and conditions they've set up.
But those privacy policies are "frequently long, lengthy documents written by lawyers that are hard to decipher," said Andrew Crawford, senior counsel of privacy and data at the Center for Democracy and Technology.
At the end of the day, "there is no government law or regulator that is really saying this is what happens to this data, and this is what you have to do," noted Lisa Pierce Reisz, an attorney at Epstein Becker Green.
States have tried to fill that gap, creating what's at best a patchwork health privacy system.
20 states have their own comprehensive consumer data privacy laws, according to Bloomberg Law. Washington and Nevada also have laws that specifically safeguard health data that falls outside of federal health privacy requirements.
"I think we're going to see more of that, and that's going to be challenging, especially for companies that operate across states," said Shannon Britton Hartsfield, a partner at Holland & Knight.
What we're watching: Federal lawmakers last year introduced a draft bipartisan data privacy bill, and efforts are underway in Congress this year to come up with legislation for a comprehensive privacy protections.
But a national privacy law remains a long shot at the moment, said the University of Illinois' Gerke. Expanding the scope of HIPAA or the 2008 Genetic Information Nondiscrimination Act to apply to entities that collect genetic information could be an easier fix, she said.
The bottom line: Once you give your personal information to a company, you lose some control over it, Pierce Reisz said.

Young Americans are embracing thrifting as a way to save and stand out St. Petersburg, Florida — Brooklyn Karasack loves to thrift and sew. She thrifts in her hometown of St. Petersburg, Florida, and then uses her grandmother's sewing machine to whip up her fantastical creations. "This is probably $3 or something like that," Karasack told CBS News, referring to an old pillowcase she turned into a tote bag as an example of her work. Her creativity has paid off. The 28-year-old, who works as an auditor during the day, has more than 800,000 online followers, who watch her take her thrift store finds on her social accounts and turn the old items into new ideas. Karasack said she got into thrifting and sewing after deciding to stop buying fast fashion. Fast fashion, a term for low-priced, trendy clothes made by companies like H&M, Forever 21 and others, has become a big contributor to textile waste, producing 92 million tons a year, according to Global Fashion Agenda's Pulse of the Fashion Industry report. A piece of clothing is worn only seven to ten times, on average, before being thrown out, according to Uniform Market. She said that after she started thrifting, she hasn't "bought anything fast fashion." Karasack isn't alone in turning toward thrifting. With a trade war underway, Americans worried about costs have flocked to the used clothing market. Thrifting is an easy way to avoid tariffs, with prices generally 50% to 75% off of retail. The secondhand market is expected to more than double by 2028, growing 6.4 times faster than the broader retail sector, according to a 2024 resale report from Thredup, an online thrift store. Small businesses are also jumping on the trend — Sew Pinellas offers beginner sewing classes for DIYers of all ages. They've been full since they began last year. Sewing jumps in popularity during economic slowdowns, data from Statista shows that 26% of 18- to 29-year-olds engage in some form of sewing activity. Kristen Hester, who manages Out Of The Closet, a thrift store with 24 locations, says customers now expect thrift stores to offer more. Customers used to think of thrifting happening in a charity shop where everything is thrown around and they had to dig through dirty bins. Hester grew up thrifting with her mom and likens it to a treasure hunt, but notes back then it wasn't as popular as it is today. "Thrift stores had stuff that the regular retail stores just didn't have," Hester said. "...You think of a small little charity shop, where maybe everything is thrown around; you have to dig through dirty bins." The 38-year-old says that her store is "more of a curated, boutique experience." Out of The Closet, like many secondhand shops, is mission-driven. When you shop or donate at Out of the Closet, 96 cents of every dollar made goes to the AIDS Healthcare Foundation's HIV prevention and treatment services, the shop said. She adds, "It really has created this really cool kind of niche community where everybody is just so accepting. Everybody's in the same mindset. Everyone is happy to be there."

June 12 (UPI) -- The House-passed budget reconciliation bill promoted by the Trump administration would benefit higher earners at the expense of lower-income Americans, the nonpartisan Congressional Budget Office reported Thursday. The CBO's findings said between 2026 and 2034, after-tax federal benefits "would decrease for households toward the bottom of the income distribution, whereas resources would increase for households in the middle and top of the income distribution," the report said. "If you are a hardworking American that is struggling to take care of your family, you are going to love this legislation," Republican House Speaker Mike Johnson said during an interview on Fox News last week. But the CBO report indicates that the top 10% of earners would receive the highest tax cuts. The CBO analysis shows that households earning up to $107,000 yearly will see an average tax cut of $1,200 annually through 2034. People making up to $138,000 annually will see a $1,750 tax cut; those earning up to $178,000 will see a $2,400 yearly benefit; those bringing in $242,000 will see a $3,650 benefit; and households earning up to $682,000 a year can expect an annual $13,500 tax benefit. A recent analysis by the Joint Taxation Committee reflected the results of the CBO report and also suggested that lower income Americans would benefit less from the legislation than higher earners. The budget bill, which has seen staunch opposition from Democrats, faith leaders and social service advocates, faces a tough road in the Senate, where even some members of the GOP have expressed concern about the depth of the cuts, especially to Medicaid services and SNAP benefits, which would fall most squarely on the most vulnerable Americans. Academics and scientists have also been critical of proposed reductions in research funding in the budget bill while adding trillions of dollars to the national debt.
