The accused, identified as Joshua Oscar Nevis, allegedly posed as the victim's employer and tricked him into transferring the money. Fraud via WhatsApp Impersonation According to officials, the victim received a WhatsApp message from an unknown number where the sender pretended to be his boss, requesting urgent funds for a project. Believing it to be genuine, the complainant transferred Rs 1.3 crore into Nevis's ICICI Bank account. The fraud came to light after the transaction was flagged, leading to the registration of an FIR on April 20 under multiple provisions of the Bharatiya Nyaya Sanhita (BNS). Police teams led by SP Cyber Crime Geetanjali Khandelwal tracked Nevis to Mumbai, where he was arrested on August 13. During interrogation, he admitted to handing over his banking instruments and SIM card to contacts on Telegram, which were then misused in the scam. Authorities suspect a wider network is involved, and further investigation is underway. The Cyber Crime unit has warned the public against such impersonation schemes, advising people not to transfer money for 'verification,' to avoid arrest, or to resolve fabricated cases. Citizens have been urged to cross-check suspicious requests through local police or the Cyber Crime Helpline. 'Fund insufficient': Gurgaon man gets 5 months jail for Rs 11.6 lakh cheque bounce; city court orders full repayment with interest
GURGAON: Five years after the cheque was returned by the bank for insufficient balance, a city court awarded five months of imprisonment to the convict and directed him to settle the pending amount with interest to the complainant. The complainant, Munesh, had a friendly relationship with the convict, Satish, as the two had been neighbours and classmates since childhood. Between 2012 and 2017, Satish borrowed Rs 15 lakh from Munesh for business and personal expenses, promising to repay or transfer property in lieu of the debt. He reiterated this in a 2018 affidavit, pledging repayment within 24 months. In Feb 2020, Munesh demanded repayment. Satish returned Rs 3.40 lakh through bank transfer and sought more time. In July 2020, Satish issued a cheque for Rs 11.60 lakh, which bounced in Oct with the remark "fund insufficient". The court held it proved that the cheque in question was issued by the accused in discharge of his legally enforceable debt or liability, and convicted Satish of cheque bounce. Judicial Magistrate Ist Class (JMiC) Priya Gupta, in her order, observed that leniency in cases involving economic offences is not warranted and is against the very object of the legislation. Satish was awarded five months of simple imprisonment and was directed to pay Rs 15.10 lakh (cheque amount along with interest) to the complainant. Tribunal awards Rs 29 lakh compensation to family of man killed in road accident
Agency: Thane, Aug 20 (PTI) The Motor Accident Claims Tribunal (MACT) in Maharashtra's Thane has ordered an insurance company and a truck owner to pay a compensation of nearly Rs 29 lakh to the family of a pharmacist who was killed in a road accident in 2020. The order was passed on Tuesday by the tribunal presided over by member R V Mohite. In the petition, 28-year-old victim Sachin Ashok Gavhane's parents sought a compensation of Rs 80 lakh. The tribunal determined the actual compensation based on the deceased person's income, dependency and legal precedents. On August 1, 2020, Sachin was riding his motorcycle from Kalyan in Thane district to Vashi in Navi Mumbai when a truck hit him on the Shil Phata-Mahape Road. He succumbed to his injuries before reaching the hospital. Police registered a case of negligent driving against the truck driver. In the order, the tribunal said, 'The truck had not only dashed the motorcycle from its back side, but its speed was such that the truck driver could not control the vehicle for about 8 feet…The driver of the truck was driving the offending vehicle in a rash and negligent manner." The insurance company contested liability citing absence of a valid licence. However, the tribunal rejected this contention, saying, 'The insurance company has failed to prove that the driver of the offending truck was not holding valid driving licence at the time of the accident. There is no wilful breach of terms and conditions of insurance policy by the owner of the offending vehicle." On the compensation, the tribunal noted that Sachin was working as a pharmacist at a medical store in Navi Mumbai's Vashi, earning Rs 19,300 per month. After applying the multiplier method and considering the future prospects, loss of consortium, funeral expenses and other heads, the tribunal fixed the total compensation at Rs 28,93,040. The tribunal ordered joint and several liability of the owner of the offending vehicle and the insurance company, directing payment within one month. Out of the total compensation, Rs 10 lakh will go to the father and Rs 18.93 lakh to the mother, with a portion mandated to be invested in fixed deposits. The claimants are entitled to get 9 per cent interest per annum from the date of petition till the amount is deposited, it said.
