Jamestown mayor criticizes Legislature over property tax reform

May 8—JAMESTOWN — Mayor Dwaine Heinrich criticized the North Dakota Legislature for creating "chaos at the local level" over property tax reform while also touting the progress that has been made in Jamestown.
Heinrich said the Legislature's passage of House Bill 1176 is "very positive action" and means millions of extra dollars for Jamestown residents. He said HB 1176 grants a $1,600 property tax buydown on every taxable primary residence in the state but also caps the amount local political subdivisions can raise levies at 3% yearly.
"From a local political subdivision standpoint, the disappointing part of the property tax buydown discussion was the unnecessary false narrative surrounding the property tax issue and the blatant political pandering made part of the process," he said. "If political pandering were an Olympic event, some North Dakota legislators would be sporting shiny new gold medals, unless of course they were disqualified for the use of steroids or other performance enhancing drugs."
Heinrich delivered the State of the City address on Thursday, May 8, at North Dakota Farmers Union.
He criticized the passage of HB 1176 in its current form, expressed frustration with a housing development bill that failed and touted economic development in the Jamestown area in the past 47 years.
Heinrich said the 3% cap on raising levies annually is not workable for the city of Jamestown. He said local political subdivisions will need to find other ways to raise money.
Heinrich said the city of Jamestown receives about $5 million in property taxes for its general fund that is used by police, fire and municipal court. He said sometimes health insurance costs increase annually by 10%.
"We have no control over the costs of police cars, fire equipment and other supplies that we must purchase," he said. "On these budgets, costs over which we have no control likely will exceed the 3% cap. This without any pay raises for employees or cost-of-living raises. A 3% cap for many political subdivisions across the state is simply going to create chaos for many of our cities who do not have access to large per-capita tax bases or other funds."
Using approximate numbers, Heinrich said the city of Jamestown's per-capita value of taxable real property — which is fourth lowest in the state — is about $39,000 compared to the city of Wahpeton and $33,000 and the city of Bismarck at $66,000. He said Bismarck has the highest per capita value of taxable real property in the state while Wahpeton has the lowest.
"It would follow that in Wahpeton the taxes or mill levies would have to be twice as high as in Bismarck to raise the same number of dollars per capita," he said. "Given that there is often an economy in scale, that puts even a greater burden on communities with lower population and lower property valuation per capita."
Heinrich also said a recent article on property taxes shows North Dakota ranks 34th out of 50 states for property tax burden. When looking at the total tax burden per capita in the nation, North Dakota ranks 43rd, he said.
Heinrich said the city of Jamestown received another setback in its attempt to develop residential lots with the Legislature killing Senate Bill 2225.
"We are now back at the drawing board and we will continue until we are successful," he said.
Senate Bill 2225 would have established the Housing for Opportunity, Mobility and Empowerment (HOME) grant program in the North Dakota Department of Commerce. The program would have provided grant dollars for one-third of the infrastructure costs for residential development projects. The local political subdivision and the developer of the residential lots would each provide one-third of the costs for residential development projects.
Heinrich said the Jamestown/Stutsman Development Corp., the city of Jamestown and Stutsman County were proactive and approved potential funding to use the program.
The JSDC Board of Directors had approved in March a forgivable loan of $1 million to the city of Jamestown that will be used as matching dollars for a grant program that helps create residential housing development. The funding was contingent on approval of Senate Bill 2225 in the state Legislature.
Heinrich said one challenge for Jamestown is overcoming news by social media and negative comments about the city. He said some negative comments include Jamestown remaining the same for years and no new development going on.
In his 47 years of living in Jamestown, he said the University of Jamestown has gone through a "remarkable" transformation, a new high school has been built, and the Jamestown Civic Center has become the host to state girls basketball tournaments.
Heinrich said the I-94 Business Park in Jamestown and the Spiritwood Energy Park Association's industrial park at Spiritwood are also the result of positive forward-thinking individuals in the community.
"All of these things did not happen by accident," he said. "They happened because of you."
Moving forward, Heinrich said a large portion of aged infrastructure is getting replaced, including aged water lines and water mains.
"Constantly failing water lines creates a huge expense to you, the city taxpayers, as it is very expensive to dig up and repair failed waterlines particularly during the winter months," he said.
He said the city is fortunate to have expert grant writers who have helped Jamestown receive millions of collars for projects. He said the $9 million water main replacement project will be completed without using any locally generated tax dollars.
Heinrich also said the Legislature revised the "Operation Prairie Dog" program. He said there isn't enough information on the changes to the program to fully understand the impacts to the city.
"What I do understand is the Prairie Dog bucket was moved up in the oil funding stream to almost certainly guaranteed funds, but it looks to me that the guarantee will be about $3.5 million instead of the $5 million per biennium we have received the last couple of sessions," he said.
Heinrich added that additional funding was added to the North Dakota Department of Transportation's budget that will go directly to cities and more grant funding might be available.

Minnesota lawmakers extend tax breaks for Big Tech data centers

(Photo by Nicole Neri/Minnesota Reformer) The Legislature passed a bipartisan bill Monday that extends tax breaks for some of the country's most profitable technology companies on their data centers up to the year 2077, in a win for both Big Tech and the trade unions that build the data warehouses. The once boutique tax subsidy has exploded in cost in recent years, as tech companies chased the benefit to meet ever increasing demand for computing power. In fiscal year 2015, the state estimated a sales tax break for data center purchases of computers, servers and other equipment costs the state about $6 million. That number is projected to explode to $114 million in fiscal year 2025 — a 1,800% increase — according to state tax expenditure reports. Minnesota currently has 42 data centers, with the majority spread across the metro. Nationwide, tech companies are rapidly building data centers — warehouses with computer servers used to power the internet and, increasingly, AI — to store and process data. As Gov. Tim Walz and his fellow Democrats in the divided Legislature confronted a worsening fiscal outlook, however, they looked to the data center tax breaks. They settled on revoking the sales tax exemption on electricity bills, which are massive because of data center energy requirements. Curbing this tax break alone will bring in an estimated $140 million over the next four years. But lawmakers also gave Big Tech a win, extending the expiration of the state's sales tax break for data centers on purchases of computers, servers, software and cooling and energy equipment. Minnesota law currently allows data centers this sales tax exemption on technology equipment for 20 years, up to the year 2042. The bill passed Monday will extend the tax break to 35 years with a sunset date of 2042. This means that a data center that makes its first purchase in 2042 could continue claiming the exemption until 2077. Sen. Ann Rest, DFL-New Hope, has been negotiating for the data center sales tax break throughout the session. Rest, the Senate's chief author of the data center bill, said the Legislature can use the tax breaks as leverage to ensure proper regulation of the nascent industry. 'This is the beginning of how we can bring a new industrial age that is one that we are going to control,' Rest said Monday. The bill also includes a new annual fee on large-scale data centers between $2 million and $5 million to go to the Department of Commerce's weatherization account, which grants energy upgrades to low-income Minnesotans. The bill also requires public utilities to offer a clean energy tariff for data center companies, i.e, the company can pay an additional fee to the utility for the utility to fund the development of clean energy technology that the data center could one day consume. Rep. Athena Hollins, DFL-St. Paul, voted against the bill. 'I am anti-tax breaks for billionaires. When we are saying that we are trying to incentivize people to come to our state to build these facilities, we are saying that the tax burden is going to lie on our constituents,' Hollins said Monday. The sales tax exemption on technology equipment — even with the elimination of the sales tax break on electricity — is expected to cost Minnesota $133 million in fiscal year 2027 and jump to $219 million in fiscal year 2029 as the number of data centers increases and they purchase more equipment, according to the Department of Revenue. The data center tax breaks are a huge win for building trade unions, which warned lawmakers that Minnesota will lose jobs if it can't compete with neighboring states to entice tech giants to build their data centers here. Amazon recently announced it was suspending construction of a data center in Becker, citing regulatory uncertainty. Meanwhile, the company announced a $20 billion data center project in Pennsylvania, where Gov. Josh Shapiro — a potential Walz rival for the 2028 Democratic presidential nomination — stood with construction workers to make the announcement. The Minnesota data centers package included a provision requiring that companies must pay workers a prevailing wage to build the data centers, which ensures much of the construction will be done by unionized companies. The House passed the bill 85-43 and the Senate 40-26. Walz is expected to sign the data centers package.

Texas Set To Roll Out Country's Biggest School Choice Initiative

(Texas Scorecard) – After decades of campaigning by education reform advocates, Texas is set to enact the nation's largest education savings account program, opening new options for up to 100,000 students. The state will spend the next year preparing for the program's 2026-2027 launch. Gov. Greg Abbott signed Senate Bill 2, which creates the ESA program, into law on May 3. An ESA allots funds to parents for use toward a range of educational expenses, including private school tuition, tutoring, and online learning. The program, which has been allocated $1 billion by the Legislature, will support up to 100,000 students, making it the largest launch of a universal school choice program in the nation, according to the governor. Most students will receive $10,000. However, special needs students will receive $11,500, and homeschool students are eligible for $2,000. The ESA program will be managed by the Texas comptroller. The comptroller will maintain a list of pre-approved vendors and educational providers, but participating families will also be able to request approval for other vendors and educational providers to suit their needs. A specific provision in the legislation dictates that no rule or action may prohibit or restrict religious or institutional values when distributing funds. In addition, it prevents limitations on participating parents when 'determining the methods or curriculum to educate students.' If the program is not maxed out the first year, a weighted lottery will determine who is next in line to receive funding. Once the program is rolled out, students will be considered in the following order: Siblings of currently participating students All other students Former students who have previously been enrolled in the program but have since stopped for a period of time The program further prioritizes students based on household income and disability status: Households 500 percent below the federal poverty line whose participating child has a disability Households 200 percent below the poverty line, which are expected to be the largest qualifying group Households 200 percent above the poverty line Households 500 percent above the poverty line No more than 20 percent of the funding will go towards the latter priority group, though it's unlikely to reach that amount. The comptroller's office will provide further details on the application process in 2026. In addition to school choice, lawmakers also passed House Bill 2, which covers public school finance. The total K-12 education funding for the 2026–2027 biennium is about $80 billion out of a $338 billion state budget. HB 2 increases the basic allotment per student from $6,160 to $6,215, which districts can use to meet a variety of needs, while the rest of the funding is earmarked to expand teacher incentives and create more grant funding. However, additional oversight of public education was also a priority of lawmakers. Senate Bill 12 increases parental control and oversight in K-12 education, limits DEI-related activities, and enhances transparency and accountability in Texas schools. It also bans instruction or programming regarding gender identity and sexual orientation.
