Ex-MD claims trial to misusing position over appointment of husband and funds transfer

KUALA LUMPUR: A former managing director of an oil and gas company claimed trial at the Sessions Court, here, today to a charge of misusing her position to appoint her husband to the firm.
Farah Sabryna Nasarudin, 46, also pleaded not guilty to ordering the transfer of RM786,209.30 from the company to her bank account, for her benefit, and that of her Australian husband.
She claimed trial after the charge was read out to her before judge Hamidah Mohamed Deril.
According to the charge sheet, she had allegedly used her position as the managing director of Asiapac Oil & Gas Sdn Bhd to appoint her husband, Daniel Frederick Wall, as the company's technical adviser and had instructed the transfer of the funds.
She had allegedly not obtained the agreement or ratification of the company's general meeting.
The alleged offences occurred at the company based at Q Sentral in Jalan Sentral between Jan 27, 2021 and July 28, 2023.
The charge under Section 218(1)(d) of the Companies Act, punishable under Section 218 (2) carries a jail term of up to five years or a maximum RM3 million fine or both upon conviction.
Deputy public prosecutor Nur Shakila Shariff urged the court to set bail at RM30,000 and to order the accuse to surrender her passport to the court until disposal of the case.
Defence lawyer A. Narainasami asked for a lower bail as the accused is supporting five school going children and an aged mother.
Hamidah allowed bail of RM20,000 with one surety and set Sept 3 for mention.

Kamirin Ebit pleaded guilty before Magistrate Marilyn Kelvin to committing the offence against his 39-year-old wife by saying 'Ku sembelih kau pun boleh bah (I can slaughter you too)', on June 12, this year, at 10pm, in front of a house at Angkasa Apartment, Menggatal. The court heard from the prosecution that on the night of the incident, the complainant was at home when an argument broke out with Kamirin, who is her husband. During the quarrel, he threatened her with the said words, causing her to fear for her safety. She later lodged a police report which led to Kamirin arrest on July 4. Meanwhile, a 23-year-old man was sentenced to seven months jail for keeping a stolen car. Baru Junie pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to keeping a stolen Proton Saga belonging to one Winona Emmanuel, on May 26, this year, at 12.05am, at the traffic light, Jalan Tuaran Bypass, Manggatal – Tuaran. The charge is framed under Section 411 of the Penal Code which carries a jail term of between six months and five years and liability of a fine on conviction. The prosecution informed the court that the car was reported stolen from a workshop in Putatan on May 25. In the same court, a 35-year-old man was jailed six months for a similar offence. Walter Jumain admitted to keeping stolen items comprising several identity cards, bank cards, a car key, an Apple Watch, and a laptop belonging to one Jude Ooi on July 24, at 9.30am in a rented room at Putatan town. The court heard from the prosecution that the said items were reported missing from the complainant's house in Penampang on July 24. An 82-year-old Australian man was arrested on July 24 while transiting through Changi Airport for another flight. - ST SINGAPORE: An 82-year-old Australian man was arrested for allegedly stealing two boxes of perfume at Changi Airport Terminal 1. In a statement on Friday (Aug 1), the police said they were alerted to a case of shop theft at about 9.30am on March 18 in the airport terminal's transit area. A box of perfume valued at S$149 was found missing from a display shelf at The Shilla Cosmetics and Perfumes outlet. Officers from the Airport Police Division identified the man through CCTV footage. He was allegedly seen leaving the store with the unpaid item earlier that day, but had already left Singapore. Investigations later found that he had also allegedly taken another box of the same perfume from the same outlet on March 13. He had also left Singapore on that occasion. The man was arrested on July 24 while transiting through Changi Airport for another is slated to be charged on Aug 4.

Back to KUL In other news, Firefly will soon relocate its jet operations from the Sultan Abdul Aziz Shah Airport or Subang Skypark (SZB) to the Kuala Lumpur International Airport (KUL) Terminal 1. The airline's turboprop services will remain in SZB, to ensure ongoing connectivity to key destinations. Effective Aug 19, the relocation is part of Malaysia Aviation Group's long-term network optimisation plan. In a press release, MAG group managing director Datuk Captain Izham Ismail said, 'The move to KUL allows Firefly to scale its jet operations more efficiently, improve passenger connectivity and better leverage MAG's shared capabilities in engineering, ground handling and catering. 'This decision reinforces our commitment to strengthening KUL as the main aviation hub, while continuing to offer accessible air travel options across the country.' The move will be rolled out in phases, beginning with the first flight to Tawau, Sabah on Aug 19. Batik to Bangkok Batik Air recently flew its inaugural direct flight from the Don Mueang International Airport (DMK) in Bangkok, Thailand to SZB. The flight marked a significant milestone in strengthening air connectivity between Malaysia and Thailand, according to Tourism Malaysia. The agency said that Batik Air's new daily service not only underscores the airline's commitment to position SZB as a key city airport hub, but also supports national efforts to boost inbound tourism.
