HC asks Haryana to detail experience of young HCS officer posted as HSSC secy

Chandigarh: The appointment of Chinmai Garg, a young Haryana Civil Service (HCS) officer of the 2023 batch, as secretary of the Haryana Staff Selection Commission (HSSC) has come under the scanner of the Punjab and Haryana high court.
The court had earlier asked the state govt to appoint an experienced person to the post.
The court granted two weeks to the counsel of the Haryana govt to get instructions about the experience of the new incumbent, with respect to conducting exams like the controller of examination (CoE) of any state university. Justice Harkesh Manuja passed these orders while hearing a contempt petition filed by one Dhana Ram.
During the hearing on Aug 4, the state counsel referred to an office order dated Aug 3, issued by the secretary, Haryana, whereby Garg was posted as secretary, HSSC, as well as controller of examination, HSSC.
The court observed that the order dated May 31, 2024, passed by the court, showed that a direction was issued to the chief secretary, Haryana, to take steps to appoint a suitable candidate as secretary of the HSSC, who was experienced in conducting exams as the controller of examination of a state university.
The relevant portion of the May order read: "Keeping in view our finding relating to conducting of examination without declaring the result of CET finally by the commission, we direct the chief secretary, Haryana, to take steps to appoint a suitable candidate having experience of conducting examinations as secretary of the Haryana Staff Selection Commission like the controller of examination of any state universities.
"
The next hearing is scheduled for Aug 20.

Stating that the denial of promotion to an HIV/AIDS positive woman employee of the Central Reserve Police Force (CRPF) was 'discriminatory', the Gujarat High Court has directed the CRPF to promote the petitioner to the post of Inspector (Ministerial), while also declaring as 'ultra vires' the provisions of a 2008 Standing Order and the 2011 CRPF Assistant Commandant Recruitment Rules that were cited in denying promotion to the petitioner. A division bench of Chief Justice Sunita Agarwal and Justice DN Ray, in its August 5 order, noted that the denial or discontinuation or unfair treatment in relation to employment is 'clearly prohibited' under the HIV/AIDS (Prevention & Control) Act, 2017. While stating that the Act has been enacted to ensure equal opportunity of employment and with the need to protect and secure the human rights of persons who are HIV/AIDS positive, the court directed the CRPF to grant promotion to the petitioner with effect from the date her juniors were promoted. The court said, 'The petitioner shall be entitled to full benefits including continuity of service to the post of Inspector (Ministerial) from the date the juniors to the petitioners were/was promoted. The petitioner shall also be considered for promotion to the (subsequent) post of Assistant Commandant (Ministerial) by placing her in the gradation list along with her juniors and a special DPC (Department Promotional Committee) be conducted to consider the candidature of the petitioner to the said post…' Granting time of two months, the court said, 'Upon consideration, if the petitioner is found fit on all other aspects, she shall be given promotion to the post of Assistant Commandant (Ministerial) from the date the junior(s) to her have been promoted against the vacancies of the year 2024-25… (The respondent is) required to revise pay and re-fix the pay-scale of the petitioner from the date of her entitlement to promotion on the post of Inspector (Ministerial) and further on the post of Assistant Commandant (Ministerial) and shall pay the arrears including all consequential benefits to the said posts.' The bench considered the arguments put forth by the petitioner as well as the advocates representing the respondents and stated that the case 'presented a very sorry state of affairs at the ends of the respondent authorities including the Ministry of Home Affairs, Government of India in perpetuating discrimination by not bringing necessary amendments in the Standing Order No.04/2008 and the recruitment/appointment Rules, which prescribe blanket restriction for promotion or appointment to persons who are not kept in medical category Shape I, specifically HIV/AID +ve personnel.' The court order stated that the court has reached 'an irresistible conclusion' that the petitioner has been discriminated in denial of promotion to the post of Inspector (Ministerial) from the date of her entitlement on the premise that she was in Shape III category in the medical report dated April 16, 2015. The petitioner had contended that she was promoted to the post of Inspector (Ministerial) only on August 23, 2019, and therefore also denied the subsequent promotion to the post of Assistant Commandant (Ministerial). The court noted that 'no efforts seem to have been made' to bring the Standing Order and the Rules governing the services of CRPF personnel in line with the Human Immunodeficiency Virus (HIV) and Acquired Immune Deficiency Syndrome (AIDS) (Prevention and Control) Act, 2017 so as to remove 'discrimination' against the 'protected persons' within the meaning of the Act. Declaring the 2008 Standing Order as well as the Rule 5 of the Central Reserve Police Force, Assistant Commandant (Ministerial), Group 'A' Post, Recruitment Rules, 2011, as 'ultra vires', the court said that it was 'contrary to the National HIV Counseling and Testing Guidelines, 2024 as also discriminatory and arbitrary, being violative of Articles 14, 16 and 21 of the Constitution of India.' The court order stated that the clauses are 'required to be suitably amended to remove any kind of discrimination, directly or indirectly, expressly or by effect which denies or withholds any benefit, opportunity or advantage from any person or category of persons being HIV/AIDS +ve person(s)… by bringing suitable amendments as early as possible. For the purpose of medical assessment of HIV/AIDS +ve person.' 'SHAPE-1' signifies that a combatised serving personnel is fully fit for all duties. The acronym SHAPE represents: S (Psychological), H (Hearing), A (Appendages), P (Physical Capacity), and E (Eyesight). A SHAPE-1 rating indicates that all these aspects are assessed as being in good condition. Functional capacity for duties in the CPF under each factor is graded in the scale from 1 to 5, indicating declining functional efficiency and increasing employability limitations.

MUMBAI: The Supreme Court on Wednesday directed the Maharashtra government to put an end to the functioning of hand-pulled rickshaws in Matheran within six months and switch to e-rickshaws, while calling the practice 'inhuman' and 'against the basic concept of human dignity'. While referring to a scheme in Gujarat where the government issued e-rickshaws to locals in Kevadia on rent, the apex court told the Maharashtra government to come up with similar schemes and also ordered the setting up of Matheran Monitoring Committee, under the chairmanship of the district collector, which will be responsible to identify the people to whom the e-rickshaw licenses shall be issued. The court added that the beneficiaries could also include tribal women to ensure them a steady livelihood. The bench also noted that the state government should not make an excuse of a lack of funds and said, 'We clarify that non-availability of funds cannot be an excuse for non-implementation of the aforesaid scheme. We earnestly hope that the state would tender necessary assistance in stopping such an inhumane practice.' The court also told the state authorities to lay concrete paver blocks in Matheran and allow the local body to lay only clay paver blocks in the market area of the hill town, while making it clear that no paver blocks should be laid on the internal roads or the trekking routes of the hill town, which is the only pedestrian hill station in Asia and has been identified as an Ecologically Sensitive Zone (ESZ) by the Ministry of Environment and Forest and Climate Change.

New Delhi: The Supreme Court on Wednesday directed all states to survey orphaned children who were denied education under the Right of Children to Free and Compulsory Education Act. A bench of Justice BV Nagarathna and Justice KV Viswanathan asked the Centre to consider including data of such children in the upcoming census, scheduled to be carried out in 2027. The apex court was hearing a plea raising concerns for orphans in need of care and protection. The bench further directed the states to survey orphaned children who had been granted admission in schools under the provisions of the Act. The petitioner said schemes of the Centre and the state govts for protection and care of orphans were inadequate, requiring consideration. "States to make a survey of the orphan children who have already been granted admission under the provisions of the Act as well as a survey of the children who have been denied such right to free and compulsory education under the Act and if so, for what reasons," the top court said. The states would have to return with their respective affidavits. It came on record that several states, including Gujarat, Delhi, Meghalaya and Sikkim, had already issued notifications to include orphaned children within the 25% quota for those belonging to weaker sections and disadvantaged groups as prescribed in Section 12 (1) (c) of the law. The bench said other states might also consider issuing similar notification and file a related affidavit on record. It posted the matter for Sept 9. The petitioner sought directions to the Centre to consider having a data of orphans in the upcoming census. When the petitioner said the Centre should be asked to file a detailed affidavit on the aspects raised in the plea, the bench said it would consider all the issues. The bench observed there were Juvenile Justice Committee in all high courts and national consultations were also being held on these issues. The petitioner contended that India gives a lot of support and lot of opportunities to children of weaker sections such as scholarships, reservations, jobs, loans, etc., but there was nothing for orphans. She said Unicef estimates 25 million orphans in India. BOX SC order on Lucknow lawyer's PIL The PIL was filed by Lucknow-based social activist and lawyer Poulomi Pavini Shukla. "This direction is a welcome as well as necessary step, in order to provide quality education to orphan children in the country," said Shukla. India has more than 2 crore orphan children, according to Unicef estimates. Shukla also raised the demand of enumerating orphan children in the upcoming census. The Solicitor General, appearing on behalf of central govt responded affirmatively that orphan children should be included in the census data collection and said he would seek instruction. After filing of her PIL, various states have brought in steps for orphans welfare, including providing reservation to orphan children.
