
Not Bersatu's practice to pay its bureau chiefs, says Muhyiddin's ex-officer
KUALA LUMPUR: The High Court today heard that Parti Pribumi Bersatu Malaysia (Bersatu) did not pay individuals who led its internal bureaus, including its former legal head Mohamed Haniff Khatri Abdulla.
Marzuki Mohamad, the former principal private secretary to party president Tan Sri Muhyiddin Yassin, testified that no payments were made to prominent lawyer Haniff, who headed the legal and constitutional bureau during the party's early years as it was the practice, reported FMT.
Marzuki, now a university lecturer, was quoted as saying that,"Two other lawyers also offered their services voluntarily. It was standard practice not to offer remuneration."
He was testifying in a 2021 suit filed by Haniff to claim RM12.5 million in legal fees from Bersatu.
Apart from Marzuki, Haniff had named Muhyiddin, deputy president Datuk Seri Hamzah Zainudin and treasurer Mohamed Salleh Bajuri as co-defendants.
Haniff claimed he received no response on the multiple invoices he had issued between January and March 2021 while Bersatu, in their defence, claimed that Haniff's services from 2016 to 2020 were offered pro-bono.
Questioned by Haniff's lawyer Nizamuddin Hamid on whether he knew Haniff was never a party member, Marzuki said he had never asked.
On Haniff's invoices and reminders, Marzuki said he had not seen them and that he had learned of Haniff's lawsuit via media reports.
Judge Datuk Akhtar Tahir set Aug 25 to deliver his decision after Bersatu lawyer Chetan Jethwani said the defence had closed its case.

Bersatu's RM195 million bank account freeze stays, court rules
KUALA LUMPUR: Parti Pribumi Bersatu Malaysia's (Bersatu) bank account containing RM195 million will continue to be frozen pending the outcome of two judicial review applications and related criminal proceedings, the High Court ruled recently. Judicial Commissioner Gan Techiong made the ruling in CIMB Bank's application seeking a court declaration on whether it should maintain the freeze on the account or release the funds following conflicting instructions from the Malaysian Anti-Corruption Commission (MACC) and Bersatu's executive secretary, Datuk Muhammad Suhaimi Yahya. The bank filed the interpleader application after receiving a letter of demand from Suhaimi seeking the release of the funds, which were deposited into the party's account by Bukhary Equity Sdn Bhd. CIMB, as the sole plaintiff, named the MACC, the public prosecutor and Suhaimi as defendants. Gan said the dispute could not be resolved summarily, as the issues raised were already the subject of pending judicial review proceedings and a criminal trial involving former prime minister and Bersatu president Tan Sri Muhyiddin Yassin. "The disputes between the defendants are not suitable to be determined summarily by this court in hearing the bank's interpleader. "They are questions of law and disputed facts forming the subject matters of the judicial review applications at the Special Powers Division of this court and the aforesaid criminal prosecution at the Sessions Court – all of which are still pending hearing and trial, respectively. "If this court is to delve deeper, the effect would be to usurp the domain of other courts that ought to be making the final determination on a wider range of issues," he said in his ground of judgment dated April 9 this year. He said Muhyiddin had been charged in March 2023 in his capacity as Bersatu's president over funds allegedly received by the party, which fulfilled the requirement under Section 52A of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLA) to sustain the seizure order on the account. Gan said a society like Bersatu does not have a separate legal personality, as the law allows charges to be brought against its office bearers. The court said in this case, the president (Muhyiddin) was charged in relation to the very funds in question. The court also rejected a late 376-page affidavit filed by Suhaimi's lawyers, saying it was inadmissible as it was filed without leave of court and at a very late stage of proceedings. "The fact that such a lengthy affidavit was filed at the eleventh hour reinforces my view that the matter is not suitable to be summarily determined in this interpleader." Gan then ordered CIMB to continue holding the funds until the High Court's Special Powers Division disposes of the judicial review applications filed by Muhyiddin and Suhaimi, which are still pending. The first judicial review challenges the legality of the freezing order issued by MACC in January 2023, while the second seeks to quash the seizure order issued by the public prosecutor in April of the same year. Leave to proceed with both reviews was granted last year, but the substantive hearings have yet to take place. Muhyiddin is facing four charges under the MACC Act and two under AMLA involving a total of RM200 million, including RM195 million allegedly transferred into the Bersatu account held with CIMB Islamic Bank. Lawyers Sathya Kumardas and Daud Sulaiman appeared for the bank while senior federal counsel Nurhafizza Azizan and federal counsel Mohammad Salehuddin Md Ali represented the MACC and the public prosecutor. Bersatu was represented by lawyers Chethan Jethwani and Tang Jia Yearn.

PETALING JAYA: The Kangar High Court dismissed a bid by Sports Toto Malaysia and four others to revive their gaming business in Perlis, saying the application failed to identify any 'official decision' that could be made subject to judicial review. Justice Arik Sanusi Yeop Johari said the applicants had not identified any decision by the Perikatan Nasional-led state government that had impacted their livelihood. Advertisement Instead, they relied on printed and online news reports about the state's purported refusal to issue lottery operators licences for business premises, the judge said. 'The applicants only cited printed and online news reports (about the purported decision). 'These news reports cannot be considered an 'official decision' made by the state government, and thus the application is frivolous,' Arik said in a judgment issued last week. The judgment set out the grounds for a decision he had handed down last year. The applicants – STM Lottery Sdn Bhd, Leong Jenn Kiang, Chin Soo Shian, C Santha and Yip Kok Chyun – are appealing the decision to the Court of Appeal. They are seeking to quash the Kangar municipal council's decision not to renew the licences for their business premises, thereby preventing them from operating their lottery business. They contend that matters relating to the issuance of gaming licences are within the purview of federal law. For that reason, they said the state authorities' decision was irrational, ultra vires the powers vested in the municipal council and the state government, and contravened the Federal Constitution. However, Arik said the application for leave to bring judicial review proceedings was bound to fail for lack of a formal decision. The judge added that even if such a decision had been made, the matter was one of policy. 'The court does inquire into policy making decisions,' he said. The applicants' appeal will come up for case management in the Court of Appeal on June 16. Parallel case in Kedah Meanwhile, a High Court in Alor Setar last year quashed the Kedah government's refusal to renew the licences of several pool betting agents, their companies and officers. The court held that the state government had overstepped its powers under the Federal Constitution in doing so. It said pool betting and lotteries were matters within the federal government's purview, and that the state government had no power to ban them. The state government's appeal from that decision was heard by the Court of Appeal on May 26, which has reserved its judgment. ‘Geng Upik' Datuk among jailed

Kota Kinabalu: Two individuals, including a Datuk, who acted as the leader of the organised crime 'Geng Upik' group, were sentenced on Thursday to between three and five years by the High Court for their involvement in the organised crime group. Businessmen Datuk Maslan Sani, 42, and Nelson Yen Yee Chung, 47, pleaded guilty separately before Judge Datuk Dr Lim Hock Leng to the charge against them, respectively. Advertisement Maslan was sentenced to five years in jail for being a member of the 'Geng Upik' between 2015 and Dec 24, 2023, here. The charge, under Section 130V(1) of the Penal Code carries a jail term of between five and 20 years, on conviction. Yen was handed three years' jail after pleading guilty to the alternative charge of assisting 'Geng Upik' to further the interest of the group between 2023 and Dec 24, 2023. The alternative charge under Section 130W of the Penal Code carries an imprisonment of up to 10 years. Dr Lim ordered Maslan and Yen to serve the sentence from the date of their arrest on Dec 25, 2023. When delivering the sentence, the judge said the court considered that both accused were first-time offenders who pleaded guilty early, showed genuine remorse, and in doing so saved the court and all parties' significant time, effort and expense. Addressing Maslan directly, the judge hoped that he would not get involved in such matters again and that this would be the last time he would have to see him in court for a similar case. Earlier, in presenting the facts in Maslan's case, Deputy Public Prosecutor (DPP) Datuk Nazran Mohd Sham informed the court that a police superintendent had lodged a police report on Nov 23, 2023 regarding intelligence on 'Geng Upik,' which was involved in dangerous drug trafficking activities. Maslan was arrested by police on Dec 25, 2023, at 2.30am, at an entertainment venue in the town of Koidupan, Penampang, while Nelson Yee was arrested at 6.45am, on Dec 25, 2023 in an apartment here, both on suspicion of being involved in the organised crime group. Investigations revealed by the investigating officer, found that Maslan was identified as a member of 'Geng Upik' and was directly involved in the group's drug trafficking activities between 2015 and Dec 25, 2023. It was also revealed that Maslan played a leading role in the group, coordinating the trafficking of dangerous drugs together with other group members, with the aim of deriving material gain. Meanwhile, in Yen's case, the court heard that investigations revealed the accused had assisted the organised crime group, among other things, by attending their meetings and helping to manage the group's business and financial affairs. Further investigations disclosed that Yen had supported the 'Geng Upik' in advancing the group's interests. The prosecution further informed the court that the investigation also found that 'Geng Upik' had engaged in dangerous drug trafficking in several serious offence cases: Tawau (three) and Manggatal (one). The serious offences in Tawau include: In 2016, an arrest under Section 39B involving an individual who had assisted 'Geng Upik', namely Syafilah Pawawoi, who was convicted and sentenced to 12 years' imprisonment; in Manggatal in 2017 involved an arrest with the seizure of 4.6kg of syabu with evidence indicating that the seized drugs were linked to 'Geng Upik.' In 2020, an arrest involving the seizure of 53kg of syabu with evidence indicating that the seized drugs were linked to 'Geng Upik'; in 2023, an arrest involving an individual involved in assisting 'Geng Upik' under Section 39B, currently undergoing trial at the Tawau High Court. In mitigation, counsel Hamid Ismail, who represented Maslan, applied for a five-year sentence to commence from the date of his arrest, submitting, among other things, that Maslan's guilty plea had saved considerable time for all parties, that he had been a first-time offender, a divorcee with nine children to care for, had regretted his actions, had shown remorse, and had promised not to commit the same offence. Meanwhile, counsel Datuk Ram Singh representing Yen, applied for two years' imprisonment sentence from the date of his arrest, by submitting among others, that Yen had pleaded guilty before the start of the trial, was a first offender, remorseful and would not commit a similar offence and that he was unaware 'Geng Upik' was genuinely involved in drug-related activities. The prosecution pressed the need to consider the public interest and the imposition of a deterrent sentence, given the seriousness of the offence committed by both accused. Maslan and Yen were among 15 individuals charged with committing the offence. However, on March 18 and 20, this year, 10 of them were each sentenced to three years after pleading guilty to the alternative charge of assisting an organised criminal group to further the interest of the group between June 15 and Dec 24, 2023. The alternative charges under Section 130W of the Penal Code were offered by the prosecution to the 10 individuals following the acceptance of their representation letters to the prosecution. The 10 were Mahathir Jibarail, 49, Mohd Faridzul Asmahadi, 32, Mohd Fikri Asme, 29, and Manan Ungok @ Salleh, 52, Mohd Fauzie Rablin, 34, Fazrul Bahar, 33, Shahlan Shah Abdul Samad, 38, Mazlan Mahmud, 49, Alkan Abraham, 36, and Norsyafilah Pawawoi, 28. Meanwhile, the trial dates, which had been fixed for July 15 to 18, were maintained for the three remaining accused — Zulkahar Dusing, 38; former Tawau CID Officer Insp Rahman Burijin, 44; and General Operations Force member Sgt Jaisalfian Jaineh @ Zaini, 45.
