
Bombay high court's Aurangabad bench hears Somnath Suryawanshi custodial death petition' Prakash Ambedkar seeks SIT probe

on Monday raised the demand for a court-monitored independent SIT to probe into Somnath Suryawanshi's death in judicial custody on Dec 16, 2024.
Ambedkar raised the demand as the Aurangabad bench of the Bombay high court heard a petition filed by Vijayabai Suryawanshi, mother of Somnath Suryawanshi (35). Somnath was arrested in connection with the protests that had turned violent over the desecration of the Indian Constitution monument in Parbhani.
Appearing for the family in the court, VBA chief Ambedkar, besides demanding a court-monitored independent Special Investigation Team (SIT), also spoke about the "lack of a clear legal mechanism" to take further action under Section 196 of BNSS.
The matter was heard by the HC division bench of Justice Vibha Kankanwadi and Justice Sanjay Deshmukh.
Following the SOP, a CID committee was appointed by the state govt to investigate the custodial death and prepared a report. However, the high court during one of the earlier hearings stayed the CID's proceedings before the report could be finalised.
Chief govt pleader Amarjeetsingh Girase, who represented the state during the hearing, said, "During the course of Monday's hearing, we on behalf of the state submitted that the inquiry by the SIT was completed.
We (SIT) recorded the statements of more than 190 people and collected all relevant documents as well as electronic evidence crucial for this case. As the HC during the last hearing directed us not to finalise anything, today we sought permission to submit the final inquiry report.

While Ambedkar, who was present along with a battery of lawyers, strongly pitched for directives to the state to address "the legal gap" in BNSS.
"There is a void in the law about what should follow after a judicial magistrate conducts an inquiry in custodial death cases. We urged the HC to address this legal gap," he told the media after the hearing.
"The second major demand was for the formation of a court-monitored SIT to conduct an independent investigation. "Since the custodial death occurred while Somnath was in judicial custody, it is inappropriate for the same police machinery to carry out the probe.
The court heard our request positively. We are expecting an order on this soon," he added.
Authorities had initially attributed Somnath's death to cardiac arrest. A postmortem report, however, indicated injuries consistent with physical assault.

Prohibitory orders were imposed in Assam's Dhubri town following communal tensions, officials said. Demonstrations were held in the town on Monday to protest the alleged throwing of meat near a temple. Police had to use tear gas shells to bring the situation under control, they said. Issuing an order under section 163 of BNSS, District Magistrate Dibakar Nath on Monday said the restrictions shall come into force with immediate effect and remain in force until further order. "It has been brought to my notice that there is a likelihood of breach of peace and public tranquillity in the areas falling under the jurisdiction of Dhubri Police Station due to communal tension, riot risk, violent protests, etc," he said. Accordingly, he ordered all shops and markets in the Dhubri town area to remain closed and prohibited the assembly of five or more people in any public places. Organising any rally, procession, meeting, or demonstration has also been strictly prohibited, the order mentioned. It exempted the movements of emergency services from the purview of the restrictions, it said. "As the circumstances of the situation do not admit service of notice in due time, this order is passed ex-parte," it added. While speaking to reporters, Nath said, 'I appeal to everyone to maintain peace, and there is no need to panic and get emotional. All must stay indoors and respect each other.' A suspected cow head was found near a temple on Sunday, another officer said. Protesting it, a mob attacked vegetable vendors and e-rickshaw drivers near Dhubri Magistrate Colony and New Market, he said. Nath said that sufficient forces have been mobilised from both state and central agencies, and they have been deployed across the town. Asked if curfew will be imposed, he said, 'There will be no curfew, but a kind of semi-curfew will be there. All shops and markets will be closed. I request all not to pay heed to rumours, and one community must respect the other.' The district administration held meetings between the Hindu and Muslim communities on Sunday and requested both sides to maintain peace. Chief Minister Himanta Biswa Sarma on Sunday said a number of cattle were allegedly slaughtered illegally at several places on Eid, on Saturday, and parts of the meat were thrown at multiple locations across the state. Chandigarh: GMCH-32 to fill UT pool seats based on NEET-PG merit despite exceeding all-India quota
Government Medical College and Hospital (GMCH), Sector 32, has stuck with the decision of filling half of the state quota seats for admission to PG courses (MD/MS) for the 2024-25 session on the basis of rank obtained in NEET-PG 2024 despite facing opposition from parents for exceeding the all-India quota of 50%. The PG medical courses seats are divided into state and all-India quota. Earlier, in Chandigarh, the state quota pool was further divided into institutional preference and residence/domicile based. However, on January 29, a three-judge bench of the Supreme Court (SC) had ruled that the domicile quota for admission to PG courses at GMCH-32 is not allowed. On April 9, based on the apex court's judgement, the UT administration had issued a notice to convert the UT Chandigarh pool seats of the state quota into institutional preference for the third counselling round of admissions to the PG courses. Some students had then approached the high court (HC) against the UT administration's notice and for sharing grievances due to other reasons. The HC had dismissed the pleas in its order on May 27 and directed the UT administration to carry out admissions in accordance with the SC's judgement of January 29 and decisions of the HC division bench on April 23, 2019. Following the HC's order on May 27, the UT administration had again notified about the third counselling round on June 3, stating that filling of the UT pool seats of the state quota will be held on all-India merit basis of NEET - PG. This notice has been challenged by a parent in the HC for exceeding the all-India quota limit. The hearing for the case is scheduled for Tuesday. Regarding the June 3 notice, GMCH-32 stated that the third counselling round for the remaining state quota seats will be held on the basis of institutional preference and rank obtained in NEET - PG. Parents are opposing this decision, stating that withhalf of the state quota seats being filled through all-India merit basis, the all-India quota would go up to 75%, exceeding the 50% limit demarcated for it. While some parents, whose wards are enrolled in medical courses outside Chandigarh, are favouring the decision, the other group, whose wards are studying at GMCH, is favouring institutional preference. The UT administration has been unable to keep its stance stable regarding the admission. A parent who has filed a petition against the notice released recently by the administration termed it arbitrary and said it to be favouring applicants seeking admission through the all-India quota. Health secretary Ajay Chagti said, 'We are going to go ahead with the third counselling as per our June 3 notice that is based on HC's judgement which was upheld by the SC in January. In our clarification plea regarding the remaining seats under the state quota, the SC had directed us in March to go ahead as per the HC's judgment. In the HC's decision on May 27, same directions were issued.'
